Aspetti criminologici delle nuove norme sull'illecito amministrativo
Nella prima parte del lavoro gli Autori esaminano sommariamente, fra i principi generali introdotti dalla legge n. 689/81, quelli che sembrano rivestire maggior interesse dal punto di vista criminologico, e sottolineano l’importanza delle innovazioni che il legislatore ha introdotto sul piano dei principi attraverso la trasposizione in ambito amministrativo di molti degli schemi di impostazione generale, finora tipici del diritto penale, che accentuano l’attenzione al dato personologico e soggettivo del reato; operazione, questa, la cui importanza e necessità è stata evidenziata da penalisti e criminologi ormai da molto tempo. Si è inteso inoltre richiamare l’attenzione sulle difficoltà - che trascendono questo ambito, ma la cui portata ai fini della reale applicazione della nuova normativa non può essere sottovalutata - che emergono in riferimento agli accertamenti in materia di valutazione della personalità dell’autore dell’illecito amministrativo

Gli AA., dopo aver richiamato in sintetica rassegna i problemi inerenti la liceità o meno dell’intervento di sterilizzazione volontaria a scopo contraccettivo, ne sottolineano i risvolti di tipo psicologico così come gli aspetti di specifico interesse medico-legale, concernenti la potestà terapeutica nell’esercizio della professione medica ed il rapporto medico-paziente, con particolare riguardo alle tematiche della responsabilità professionale e del dovere di informazione.Sotto quest’ultimo profilo, presenta particolare interesse la disamina dei principi informatori della disciplina normativa civilistica e canonistica, ispirante rispettivamente al superamento dell’impotenza sia “coeundi” che “generandi”, in se considerata, quale causa di annullamento del matrimonio. Essa assume, attualmente, tale rilevanza solo qualora configuri un “errore essenziale sulle qualità personali” del coniuge sul piano del diritto civile (art. 122 c.c.), laddove il fine essenziale del matrimonio è individuabile nella “comunione di vita, spirituale e materiale, fra i coniugi”. Ma, con “modernità” non minore, anche nel diritto canonico si assiste ad un progressivo distacco della concezione della capacità procreata come fine primario del matrimonio (storicamente correlata fin dal XVI secolo alla nozione di “verum semen”) attraverso gli interventi riformatori ed innovativi che, iniziati dal Concilio Vaticano II, sono stati proseguiti e consolidati dalle pronunzie della S. Congregazione per la Dottrina della Fede ed infine recepite dal nuovo Codex Iuris Canonici (art. 1084 e 1098 C.J.C.)

Sheep and goats alpine summer grazing and sanitary risk for wildlife- A three-years survey was carried out in sheep and goats during summer pasturing in the Orobie Alps (North Italy) within an Interreg III A project aimed to recovering tetraonids habitat. Selected pathogens of zoonotic and wildlife importance were tested. Antibodies against to Tick-Borne Encephalitis Virus (TBEV) and Mycobacterium avium subsp. paratuberculosis (MAP) were not detected. among 266 goats and one among 182 sheep resulted seropositive for Q-fever. A prevalence of 4% and 10,9% for Pestivirus was detected respectively in goats and sheep, with only adult animals affected and no seroconvertion through three years. Antibodies against Bovine respiratory
syncitial virus (BRSV) were detected in young and adult animals with seroprevalences of 19,6 in goats and 79,1% in sheep and no seroconvertion through three years. The role of the above pathogens are discussed in an alpine sustainable land use perspective
Bovine respiratory syncytial virus seroprevalence and risk factors in endemic dairy cattle herds
The herd seroprevalence of bovine respiratory syncytial virus (BRSV) was studied in 59 dairy cattle herds using serology on random selected animals stratified by two age classes (heifers, cows). Risk factors for primary infections in heifers were investigated using a questionnaire on management conditions and data on bovine viral diarrhoea (BVD) status. At least one seropositive cow was present in all the herds. In 25% of the herds all individual were seropositive and 22% of herds had all heifers seronegative. Analysis of the influence of risk factors retained summer pasture and BVD status. In particular, absence of summer pasture and the BVD positive status of heifers were associated with an increased risk of BRSV infection in heifers group
REPEATED MRI SCANS DURING ACTIVE SURVEILLANCE FOR PROSTATE CANCER: NATURAL HISTORY OF PROSTATIC LESIONS AND UPGRADING RATES OVER TIME
Objectives
To test upgrading rates in patients on Active Surveillance (AS) for prostate cancer (PCa) after serial multiparametric magnetic resonance imaging (mpMRI) scans.
Materials and methods
Retrospective analysis of 558 patients. Five different criteria of mpMRI progression were used: 1) PI-RADS score increase; 2) lesion size increase; 3) EPE score increase; 4) overall mpMRI progression; 5) number of criteria for mpMRI progression (0 vs. 1 vs. 2-3). Moreover, two definitions of PCa upgrading were evaluated:1) ISUP GG≥2 with >10% of pattern 4; 2) ISUP GG≥3. The estimated annual percent changes (EAPC) methodology depicted temporal trends of mpMRI progression criteria. Sensitivity, specificity, positive predictive (PPV) and negative predictive value (NPV) of mpMRI progression criteria were analysed. Multivariable logistic regression models tested PCa upgrading rates.
Results
Lower rates over time of all mpMRI progression criteria were observed. The NPV of serial mpMRIs spans from 90.5 to 93.5% (ISUP GG≥2 with >10% of pattern 4 PCa upgrading) and from 98 to 99% (ISUP GG≥3 PCa upgrading), according to the different mpMRI progression criteria. A PSA-D cut-off of 0.15 ng/ml/ml sub stratified those patients who could skip a prostate biopsy. In multivariable logistic regression models testing PCa upgrading rates, all five mentioned mpMRI progression criteria achieved independent predictor status.
Conclusions:
During AS, approximately 27% of patients experience mpMRI progression at first repeated scan. However, the rates of mpMRI progression decrease over time at subsequent mpMRIs. Patients with stable mpMRI findings and with PSA-D<0.15 ng/ml/ml could safely skip surveillance biopsies. Conversely, patients who experience mpMRI progression should undergo a prostate biopsy
Diffusive author(s), cohesive author: Analysis of S/N (1994)
This study indicates the ways in which various aspects of the author(s) are brought forth in Dumb type’s performance art, the S/N production. Previous research has suggested a non-hierarchical organization of Dumb type and the absence of a “privileged author” in Dumb type’s collaborative work, S/N. However, the results that I have investigated from member’s interviews on the creative process of S/N along with my analysis of the recorded images of S/N, indicate a different aspect of the author(s). First, S/N was created through, so to speak, the collective ideas of the members of Dumb type. Further, S/N has at least nine quotations from previous performances, installations, and printed writings, besides the work-in-progress technique. Explicating one of the “author functions” as given by Michel Foucault, each text has plural subjects of the author. However, it has been revealed from members’ interviews that Teiji Furuhashi had a decision-making role in selecting the members’ ideas within the performance. Since then, S/N has had plural subjects of creation; however, Furuhashi is one of the subjects of creation along with the “privileged author.” S/N has plural authors (diffusive authors) yet at the same time, it has a “privileged author,” Teiji Furuhashi (cohesive author)
Survey of Staphylococcus aureus carriage by free‐living red deer (Cervus elaphus): evidence of human and domestic animal lineages
Staphylococcus aureus is a pathogen that can affect multiple host species. Evidence of transmission between humans and animals and among different animal species has been reported in recent years. In this study, we investigated 284 free-living red deer (Cervus elaphus) in the Central Italian Alps to assess the prevalence and molecular characteristics of S. aureus in nasal and intestinal samples in relation to host features and environmental factors. A prevalence of 90%, 26.2% and 10.7% of S. aureus was detected in nasal rectal swabs and faeces, respectively. Calves had a higher probability of being S. aureus intestinal carriers than adults, especially in females when considering faecal samples. Clonal complex (CC) 425 was the most prevalent lineage (61.5%). This is a lineage known to be widespread in both domestic and free-living animals. It was followed by CC2671 (15.4%) and CC350 (6.4%). A high rate of the phage-borne virulence factor lukM/lukF-P83 was detected in CC425 and CC350. Further lineages, which are known to occur in both humans and animals, were detected sporadically in red deer faeces only, that is, CC7, CC9, CC121 and CC707, harbouring the genes of the penicillinase operon and a gene for macrolide resistance (CC9 and CC121). Methicillin resistance genes mecA and mecC were not found. Our results suggest that free-living red deer may be reservoir for S. aureus in Alpine habitats
