Setting the scene for non-conventional copyright

    No full text
Introduction: Setting the scene for non-conventional copyright. Our investigation aims therefore at offering a constructive view of the changing nature of contemporary creative efforts and verifying whether it is possible to imagine a more open and flexible copyright system which is capable of welcoming new forms of creativity

    Copyrightability of DNA Sequences

    No full text
The chapter expands on copyright as a possible form of intellectual property protection for engineered DNA sequences. He argues that copyright might turn out to be not only flexible enough to handle contemporary technologies producing living organisms, but also socially preferable to patent protection, especially in terms of enhanced chances for users to access and use essential public knowledge assets in the life sciences sector

    Copyright and Pornography

    No full text
The chapter analyses the intersection between pornography and copyright. After commenting on US, UK and French cases on the copyrightability of obscene works (especially, porn movies), the authors highlight the arguments both in support and against copyright protection of this controversial subject matter. They conclude that the overriding need to protect free speech makes the arguments supporting the copyrightability of pornography stronger

Digital media and intellectual property: Management of rights and consumer protection in a comparative analysis

    No full text
The book provides a comparative and comprehensive analysis of the current technical, commercial and economical development in digital media. It describes the impact of new business and distribution models, the current legal and regulatory framework, social practices and consumer expectations associated with the use, distribution, and control of digital media products. In particular, the author analyzes the anti-circumvention provisions for technological protection measures and digital rights management systems enacted in the United States and in Europe, and their impact on consumer protection policy. The book concludes with an overview of the effects, and the possible solutions, under U.S. and EU law, posed by using contractual arrangements to expand intellectual property rights. This book provides a comparative and comprehensive analysis of the current state of technical, commercial and economical development in digital media. Intelligenza Artificiale, Creatività e Brevetti: Sfide Attuali e Prospettive pro Futuro

    No full text
The development of patent law has traditionally viewed inventive activity as something essentially human. This paradigm is now being challenged by the possibility of using creative artificial intelligence systems capable of independently creating new inventions: The so-called creative robots have therefore triggered a series of considerations that are not easily resolved within the current framework of patent law. Indeed, there is no consensus that machines can be called inventors. In this paper, we will attempt to explore the complex relationship between creation protection, human inventiveness, and intelligent or interactive robots. In particular, we will seek to clarify whether the inventions generated by artificial intelligence require a complete reassessment of key concepts in patent matters

I Contenuti Digitali: Tecnologie Diritti e Libertà

Genetic Copyright: An Alternative Method for Protecting and Using Essential Public Knowledge Assets?

    No full text
The article focuses on copyright as a possible andadditional form of intellectual property protection forengineered DNA sequences. In particular, recent progress in synthetic biology and bioengineering have triggered a resurgence of the debate on genetic copyright. Considering the evolving conception of copyright subject-matter, the current narrow patent-eligible protection over living organisms and the advance of emerging technosciences such as synthetic biology, the article looks with renewed interest at the debate on copyright law as an additional potential form of protection for engineered biological creations. The contribution of this investigation is to reveal that copyright seems not only flexible enough to handle contemporary technologies producing living organisms, but also socially preferable to patent protection for accessing and using essential public knowledge assets in the life sciences

Rights and challenges in the technological domain: navigating the transformations of digital property

    No full text
The structure of this chapter is organized into four distinct sections that collectively delve into the intricate landscape of digital property rights. In the opening section, we will navigate the multifaceted realm of challenges and transformations, uncovering the complex issues that arise in the context of digital property rights. Moving forward, the second section will embark on an exploration of the evolution of intellectual property rights in the digital age, tracing the development and adaptation of these rights in the face of technological advancements. The third section of this chapter will pivot towards a consideration of the regulatory discourse that surrounds the digital sphere. Here, we will dissect the intricate interplay between digital technologies and regulatory frameworks, shedding light on the ongoing debates and policy implications. Finally, the fourth and concluding section will synthesize the insights garnered throughout the chapter, providing a comprehensive perspective on the current state of digital property rights and suggesting potential pathways for future development

Digital Media Pluralism. The need for global strategies

    No full text
The chapter considers the global impacts of digital communication technolo- gies and how they can influence media pluralism and media freedom as well as the ways in which legal systems aim to support and protect them. Electronic communication and technical developments have in fact contributed to enor- mous changes in daily life. They have also promoted important economic, social and cultural transformations. The new digital environment has become an essential space used for various purposes not strictly informational. In addi- tion, digital communication technologies are regarded as necessary instru- ments for having full enjoyment of a series of rights, including the right to access knowledge and information, the right to communicate, the right to culture and the right to participate in society. This new situation also implies that all people should have access to these technological innovations at affordable conditions, and that any restrictions should be strictly limited and proportionate. As online networks are considered a particularly well-designed space for pluralism and cultural diversity, their freedom and openness should be pro- tected and enhanced. In particular, the principle of an open and unrestricted Internet – as it was originally conceived – should be considered an essential precondition for any regulatory measure taken with regard to it
