Legal regulation of advertising activities: copyright protection
Присвячено аналізу нормативно-правового регулювання рекламної діяльності в сфері
охорони авторського права. На сучасному етапі розвитку рекламна індустрія активно впроваджує цифрові
інновації, що стосуються як створення рекламного звернення, так і його розміщення. Все більше рекламна
діяльність переходить у цифровий простір, що відкриває ряд можливостей, але й одночасно ускладнює
питання забезпечення добросовісної конкуренції. Здійснено аналіз умов надання рекламі та рекламному
слогану правової охорони як об’єкту авторського права. Нормативно-правове регулювання рекламної
діяльності в сфері охорони авторського права здійснюється на підставі вітчизняного законодавства, а
також Міжнародних договорів та угод в сфері охорони авторського права. Проаналізовано чинне
українське законодавство та міжнародну практику щодо правової охорони авторського права в рекламній
діяльності. Слід зазначити, що законодавча практика різних країн щодо надання правової охорони
авторського права в рекламній діяльності має принципові відмінності. Вітчизняне законодавство визнає
рекламу об’єктом авторського права за умови дотримання мінімум двох вимог: реклама або її окремі
елементи є оригінальним (авторським) результатом творчої діяльності; реклама повинна бути виражена
в об’єктивній формі, це може бути письмова форма, форма зображення, аудіо- або відеозапис. Визначено
умови використання в рекламній діяльності чужих творів та розглянуто наслідки недотримання цих умов,
зокрема мова про адміністративну та кримінальну відповідальність. Найбільш розповсюдженими
проблемами, пов’язаними з захистом авторського права в рекламній діяльності, є такі: використання
чужих творів (без належного дозволу автора на таке використання); передавання прав на рекламний
продукт замовнику; оформлення відносин між компанією, що створює рекламний продукт, і її власними
співробітниками. Вітчизняне законодавство визначає, що об’єктом охорони авторського права в рекламі є
сама суть повідомлення, а не його форма. Найскладнішим питанням щодо охорони авторського права в
рекламній діяльності є слоган. Останніми роками все частіше створюються слогани для SEO, які містять
ключове слово, за яким позиціонується сайт. Для можливості реєстрації як об’єкту авторського права
слоган не має бути загальновживаним і описовим, має бути вказівкою на комерційне походження, а не лише
спонукати до придбання товару (послуги). Аналіз вітчизняної судової практики свідчить про три способи
захисту рекламного слогану: як об’єкт авторського права, як торговельна марка, або ж відповідно до
законодавства про захист економічної конкуренції. При порушенні авторського права, автор має право
вимагати у судовому порядку відшкодування матеріальної шкоди, відшкодування шкоди заподіяній діловій
репутації та заборони подальшого незаконного використання свого твору.The article is devoted to the analysis of regulatory regulation of advertising activities in the
field of copyright protection. At the present stage of development, the advertising industry is actively introducing
digital innovations related to both the creation of an advertising appeal and its placement. More and more
advertising activities are moving into the digital space, which opens up several opportunities, but at the same time
complicates the issue of ensuring fair competition. The article analyzes the conditions for providing advertising
and advertising slogans of legal protection as an object of copyright. Legal regulation of advertising activities in
the field of copyright protection is carried out on the basis of domestic legislation, as well as international treaties
and agreements in the field of copyright protection. The article analyzes the current Ukrainian legislation and
international practice on the legal protection of copyright in advertising activities. It should be noted that the
legislative practice of different countries to provide legal protection of copyright in advertising activities has
fundamental differences. Domestic legislation recognizes advertising as an object of copyright provided that at
least two requirements are met: advertising or its individual elements are the original (copyright) result of creative
activity; advertising must be expressed in an objective form, it can be a written form, an image form, audio or
video. The article also defines the conditions for using other peopleʼs works in advertising activities and considers
the consequences of non-compliance with these conditions, in particular, the language on administrative and
criminal liability. The most common problems associated with the protection of copyright in advertising activities
are the following: the use of other peopleʼs works (without the authorʼs proper permission for such use); Transfer
of rights to the advertising product to the customer; registration of relations between the company that will create
an advertising product and its own employees. Domestic legislation determines that the object of copyright
protection in advertising is the very essence of the message, and not its form. The most difficult issue regarding
the protection of copyright in advertising is the slogan. In recent years, slogans for SEO have been increasingly
created, which contain the keyword by which the site is positioned. To be able to register as an object of copyright,
the slogan should not be generally used and descriptive, should be an indication of commercial origin, and not
just encourage the purchase of goods (services). Analysis of domestic judicial practice indicates three ways to
protect the advertising slogan: as an object of copyright, as a trademark, or in accordance with the legislation on
the protection of economic competition. In case of copyright infringement, the author has the right to demand in
court compensation for material damage, compensation for damage to his business reputation and prohibition of
further illegal use of his work

The Magrath Stinger Tadpoles faced off
against the Picture Butte Tadpoles. The
Stingers were full of steam and the scoring
spree started off with Chase Hofer & Devin
Millward getting one goal each, they both got
two goals each for the Stingers!
Taylor Evans put the "wrap around" move on
the other teams's goalie & came out the victor!
Cody Foggin followed with one goal with an
assist pass from Robbie Karren.
Tyson Hudson played a great game with two
goals both on fast paced breakaway. Carson
Foggin played a tough face off center position
and passed the puck to the team.
Matt McClenan kept the puck out of our end
and got the puck off to his teammates.
Doran Johnson got a 1st time goal and
brought the puck across the line and got his
goal! Tyler Hansen passed and kept the other
team on their toes.
Some awesome goalie work by Taylor Evans
and Nigel Atwood. One goal attempt by Picture
Butte put Nigel on the run out of the crease &
some pressure sent him scrambling back to the
net to make the save! Nigel made the 11th goal
and this ended the game 11-4. Way to go team!

Magrath Grade 7 Girls Win
Westwinds School Championship.
The Magrath Grade 7 girls completed an
undefeated season in the Westwinds School
Division league with a 31-24 victory over
Raymond in the championship game. Magrath
had gone undefeated in the league with a
record of 10 wins & 0 losses. In the
championship tournament they defeated .
Mountain View 53-19, as Debbie Balderson
notched 14 pts & Lauren Balderson added 10.
In their 2nd game they defeated Glenwood 7015
with Debbie Balderson getting 12 pts, Haley
Cook 11, & Melissa Schneyder adding 10. In
the final against Raymond, Haley Cook led
Magrath with 9 pts, Debbie Balderson & Jillene
Hudson added 6 each. Magrath players are:

Rose Holladay Gurney, passed away on
Monday, March 9, 1998 at the age of 81 yrs.
Rose leaves to mourn her children:
Walden (Marilyn), Briant(Roberta)
Brice(Linda), her only daughter Doreen and
Wayne; brother Allan(Della); sisters: Della
Blumell, Susan Jensen, Hattie(Mac) Russell and
Alice(Mac) Monroe.

with interment in the Magrath Cemetery.

away of our son Karl Latham. Lois & I were

As Basketball and Hockey seasons have (finally)
come to a close, we should reflect on the
success and good times of the past season. We
have had much to cheer about and we are
proud of the accomplishments of our many
teams.
Our Zeniths, Chiefs, Pandas, Mounties, Cubs,
Super Bees, Eagles, Bulldogs, Stingers and
Grades 4-9 teams have practiced long and
worked hard to do their best and to all our

While there are many adults who have

most are the Coaches (& spouses). For without
the dedication and long hours and long
suffering of our volunteer Coaches, many great

NEWS RELEASE
It was announced that University of Lethbridge
forward Danny Balderson is a 1st team AllCanadian
for the 1997-98 season. Balderson
who was earlier named as a #1 team CWUAA
all-star and Player of the Year in Canada West
gains his 2nd National honour, 5 yrs. ago
Balderson was named as the CIAU Rookie of
the Year. Danny was the only player in the top
ten in every statistical category. Danny finished
6th nationally in scoring & was 4th in free-throw
percentage. ******
The Del Bonita 4-H Beef Club held our Club
Speak-Offs on March 10, 1998. All our
members spoke & did a wonderful job at
speaking. At the senior level Kim Turnbull won
1st and Julaine Newton won 2nd. At the junior
level Amanda Newton won 1st and Kasie
Newton won 2nd. A special thanks goes to all
the judges.
Congratulations to Kim Turnbull who won the
Divisional Speak-Offs and now is going to the
Regional Speak-Offs. Good luck Kim!!
