O estado de coisas inconstitucional como técnica para a solução de litígios estruturais em sede de controle difuso incidental no Brasil
O presente trabalho trata do estado de coisas inconstitucional, uma técnica jurídica
criada e desenvolvida pela Corte Constitucional da Colômbia para dar conta de solucionar
litígios estruturais. O objetivo da pesquisa foi o de verificar se o estado de coisas
inconstitucional (ECI) pode ou não ser uma técnica jurídica capaz de solucionar os litígios
estruturais, além de um meio que possa estar à disposição de qualquer juiz ou tribunal no
exercício do controle de constitucionalidade difuso no Brasil. A importância da pesquisa está
em poder contribuir para um debate mais profundo acerca dos reais efeitos da utilização do
ECI para as partes envolvidas no litígio, bem como contribuir para um debate sobre a
ampliação do ECI para além da competência do STF. Trata-se de pesquisa que se classifica ao
mesmo tempo como descritiva e exploratória, e cuja técnica de coleta de dados utilizada foi a
bibliográfica, com a utilização de livros e artigos científicos sobre o tema, além de ser
também uma pesquisa documental, já que foram utilizados decisões e acórdãos de juízes e
tribunais sobre o tema. Como resultados mais importantes da pesquisa, foi possível concluir
que o estado de coisas inconstitucional não constitui técnica capaz de solucionar os litígios
estruturais, mas que pode contribuir com a melhoria no grau de satisfação dos direitos
fundamentais, através do seu efeito simbólico e desbloqueador. Por outro lado, pôde-se
confirmar a possibilidade de migração da técnica do ordenamento jurídico colombiano para o
brasileiro, e a sua possibilidade de aplicação em sede de controle difuso, portanto, por
qualquer juiz ou tribunal, mediante a utilização de instrumentos processuais que já se
encontram estabelecidos no ordenamento jurídico brasileiro.This paper deals with the unconstitutional state of affairs, a legal technique created
and developed by the Constitutional Court of Colombia to deal with resolving structural
disputes. The aim of the research was to verify whether the ECI (for its meaning in
Portuguese: Estado de Coisas Inconstitucional) may or may not be a legal technique
capable of resolving structural disputes, in addition to being a means that can be available
to any judge or court in the exercise of diffuse constitutionality control in Brazil. The
importance of research is to be able to contribute to a deeper debate about the real effects
of the use of ECI for the parties involved in the litigation, as well as to contribute to a
debate about the extension of ECI beyond the competence of the STF for its meaning in
Portuguese: Supremo Tribunal Federal - Federal Supreme Court). It is research that is
classified at the same time as descriptive and exploratory, and whose data collection
technique used was bibliographic, with the use of books and scientific articles on the
subject, in addition to being also a documentary research, since decisions and judgments of
judges and courts on the subject were used. As the most important results of the research, it
was possible to conclude that the unconstitutional state of affairs is not a technique capable
of resolving structural disputes, but that it can contribute to the improvement in the degree
of satisfaction of fundamental rights, through its symbolic and unlocking effect. On the
other hand, it was possible to confirm the possibility of migrating the technique of the
Colombian legal system to the Brazilian one, and its possibility of application under diffuse
control, therefore, by any judge or court, through the use of procedural instruments that
have already are established in the Brazilian legal system.Este trabajo aborda el estado de cosas inconstitucional, una técnica jurídica creada y desarrollada por la Corte Constitucional de Colombia para abordar la resolución de
disputas estructurales. El objetivo de la investigación fue verificar si el ECI (por si sigla en
español -Estado de Cosas Inconstitucional) puede ser o no una técnica jurídica capaz de
resolver disputas estructurales, además de ser un medio que puede estar a disposición de
cualquier juez o tribunal en el ejercicio del control de constitucionalidad difuso en Brasil.
La importancia de la investigación es poder contribuir a un debate más profundo sobre los
efectos reales del uso del ECI para las partes involucradas en el litigio, así como contribuir
a un debate sobre la extensión del ECI más allá de la competencia del STF (por si sigla en
portugués para Supremo Tribunal Federal). Es una investigación que se clasifica a la vez
como descriptiva y exploratoria, y cuya técnica de recolección de datos utilizada fue
bibliográfica, con el uso de libros y artículos científicos sobre el tema, además de ser
también una investigación documental, ya que se utilizaron decisiones y sentencias de
jueces y tribunales sobre el tema. Como resultado más importante de la investigación, se
pudo concluir que el estado de cosas inconstitucional no es una técnica capaz de resolver
disputas estructurales, sino que puede contribuir a mejorar el grado de satisfacción de los
derechos fundamentales, a través de su efecto simbólico y desbloqueo. Por otro lado, se
pudo constatar la posibilidad de migrar la técnica del ordenamiento jurídico colombiano al
brasileño, y su posibilidad de aplicación bajo control difuso, por tanto, por cualquier juez o
tribunal, mediante el uso de instrumentos procesales que ya han están establecidos en el
sistema jurídico brasileño
Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Dispelling the Myths Behind First-author Citation Counts
We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. We have done our best to complete the author checklist relating to the use of animals in the hut study. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
