    Les amoureux sur les bancs publics : Le traitement juridique du polyamour en droit québécois

    L’auteur offre un tour d’horizon des manières dont le droit québécois désavantage les relations polyamoureuses. Dans la première partie, l’auteur définit le polyamour, le monoamour et certaines notions connexes. Dans les sections subséquentes, il avance une catégorisation du traitement juridique du polyamour. Selon son analyse, quatre angles sont exploités pour orienter les relations conjugales vers le monoamour et hors du polyamour : (1) limiter à deux le nombre de parents par enfant (biparenté vs pluriparenté), (2) faciliter la prestation de soins de conjoint·e à conjoint·e, (3) protéger les conjoint·es contre des vulnérabilités économiques, et (4) prohiber certains comportements polyamoureux (criminalisation de la polygamie). Bien que l’analyse juridique se concentre sur le Québec, cette catégorisation pourra certainement être adaptée pour examiner l’état du droit dans le reste du Canada. Par cet article, l’auteur pose les bases d’une réflexion sur le traitement juridique du polyamour. Une telle réflexion devient de plus en plus pressante alors qu’un nombre grandissant d’enfants vivent dans des ménages polyamoureux, que certains enfants naissent de ces unions et que plusieurs partenaires formalisent un des couples au travers du mariage, vulnérabilisant alors les autres relations. Peut-être souhaitera-t-on conserver certaines mesures (comme la criminalisation de la polygamie) tout en en délaissant d’autres (comme la limite de deux parents par enfant). Cet article permet de mieux repérer comment le droit catalyse ou inhibe des types de relations conjugales. This article provides an overview of the ways in which Quebec law disadvantages polyamorous relationships. First, the author defines polyamory, monoamory, and related concepts. Next, he considers the judicial treatment of polyamorous people. According to his analysis, four approaches are used to orient people toward monogamous relationships and away from polyamorous relationships: (1) limiting to two the number of parents per child, (2) facilitating spousal care, (3) protecting spouses against economic vulnerability, and (4) prohibiting certain polyamorous arrangements (criminalization of polygamy). Even though this judicial analysis is focused on Quebec, this categorization may certainly be adapted to examine the state of the law in the rest of Canada. In this article, the author lays out a framework for reflection on the legal treatment of polyamourous people. Such a framework has become more and more pressing as a growing number of children live in polyamorous households, as children are born to polyamorous unions, and as more partners formalize one of the couples through marriage, increasing the vulnerability of the other relationships. Perhaps we would like to maintain certain measures (like the criminalization of polygamy) while abandonning others (like the limit of two parents per child). This article allows us to better identify how the law catalyzes or inhibits various kinds of conjugal relations

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Si vous avez répondu « oui », vous en avez besoin. Nous traquons ici le sexisme dans la langue du droit. Effacer les femmes, pathologiser les mères, banaliser les violences: tels sont quelquesuns des effets discriminatoires de ce sexisme langagier que nous entreprenons de détailler sous toutes ses coutures. L’analyse du sexisme langagier doit devenir un champ d’étude en bonne et due forme. À cette fin, nous offrons une nomenclature des sexismes jurilinguistiques (lexical, grammatical, terminologique…), ainsi que deux nouvelles notions: la féminisation ostentatoire, un féminin marquée à l’oral, et le plafond de verre linguistique, cette obstination à nommer au masculin les femmes occupant de hautes fonctions. Notre étude offre des outils aux juges, avocat·es, notaires, légistes et autres practicien·nes du droit pour démasquer le sexisme caché dans leurs communications et se familiariser avec les nouveaux développements en matière de rédaction inclusive.Abstract: Would you say of a court whose jurisdiction was reduced that it was “emasculated”? Erasing women, pathologizing mothers, normalizing violence: these are but some of the discriminatory effects of the linguistic sexism that we undertake to detail in its every shape and form. The study of linguistic sexism must become a proper area of research. To this end, we offer a nomenclature of jurilinguistic sexisms (lexical, grammatical, terminological), as well as two new notions: ostentatious feminines and the linguistic glass ceiling. The former qualifies feminine forms that are significantly different from the masculine. The latter refers to some people’s stubborn designation of women in power in the masculine form in French. Our study offers tools for judges, lawyers, notaries, legists, and other legal practitioners to unmask the sexism hidden in their communications and familiarize themselves with new developments in inclusive writing

    Variations on the Author

    “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.     The Law Society of Ontario’s Assessment of Capacity in Relation to Mental Illness: A Critical Analysis

    Over the past 20 years, a number of studies across the globe have found that mental health issues—including substance abuse, depression, anxiety, and other forms of psychopathology—are especially acute in the legal profession. The Law Society of Ontario (“Law Society”), the regulator of the legal professions in the province, has a role to play in addressing these issues, particularly due to its statutory jurisdiction over the capacity of lawyers and paralegals (“licensees”). In this paper, I review in depth the Law Society’s current approach to licensee capacity concerns in its applications before the Law Society Tribunal. My critical examination of the current coercive processes is informed by their impacts on the autonomy interests of licensees. Ultimately, I argue that in light of these impacts, the Law Society’s authority with respect to licensee capacity must be strictly and narrowly interpreted, to the greatest benefit of the individuals at issue.LL.M

    Dispelling the Myths Behind First-author Citation Counts

    We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods
