    L’enseignement qui est habituellement retenu des travaux empiriques réalisés à la suite de La Porta, Lopez-de-Silanes, Shleifer et Vishny (1997), est qu’il convient de promouvoir un haut niveau de protection juridique des créanciers. A l’inverse de cette recommandation, certains pays européens (Royaume-Uni, Allemagne) ont pourtant récemment réformé leurs dispositifs touchant au droit des défaillances dans un sens qui les rapprochent de pays qui traditionnellement privilégient la préservation des emprunteurs (Etats-Unis, France). Ce papier propose une analyse du bénéfice social d’une telle orientation du droit de la défaillance, dans un modèle stylisé où la capacité de remboursement de l’emprunteur est une information privée. On étudie tout d’abord l’effet de l’orientation des règles juridiques (système pro-créanciers versus pro-débiteurs) sur le comportement des parties au contrat en fonction du type de concurrence bancaire. Nous discutons ensuite les instruments à la disposition des autorités judiciaires afin de garantir que l’évolution d’un système pro-créanciers vers un système pro-débiteurs dégage un bénéfice social. Nos résultats suggèrent qu’il existerait, en fonction de l’objectif assigné au droit, une cohérence entre l’orientation des dispositifs encadrant la défaillance et l’intensité de la concurrence bancaire.

    Strategic default and bankruptcy law

    We compare the influence of bankruptcy law on the risk of default and the rate of liquidation by banks. We show that it depends on whether it is pro-creditors or pro-debtors oriented, and on the intensity of competition between banks. Then , we analyse the various tools at the disposal of public authority in order to accomdate the transition from a pro-creditors regime to a pro-debtors one. In a sense, our results suggest that there may exist a kind of consistency between the aims assigned to law, the orientation of bankruptcy law and the level of competition in the banking system.default risk, law & finance, bankruptcy law

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Abstract PURPOSE: To evaluate the role of topical mitomycin C in corneal wound healing (CWH) after photorefractive keratectomy (PRK) in highly myopic eyes. DESIGN: Prospective, double-masked, randomized clinical trial. PARTICIPANTS: Seventy-two eyes of 36 patients affected by high (>7 diopters) myopia. METHODS: In each patient, one eye was randomly assigned to PRK with intraoperative topical 0.02% mitomycin C application, and the fellow eye was treated with a placebo. Postoperatively, mitomycin C-treated eyes received artificial tears (3 times daily, tapered in 3 months), whereas the fellow eye was treated with fluorometholone sodium 2% and artificial tears (3 times daily, tapered in 3 months). MAIN OUTCOME MEASURES: Uncorrected visual acuity (UCVA) and best-corrected visual acuity (BCVA), contrast sensitivity, manifest refraction, and biomicroscopy. Contrast sensitivity was determined using the Pelli-Robson chart. Corneal confocal microscopy documented CWH. RESULTS: Mean follow-up was 18 months (range, 12-36). No side effects or toxic effects were documented. At 12-month follow-up examination, UCVAs (logarithm of the minimum angle of resolution) were 0.4+/-0.48 and 0.5+/-0.53 (P = .03) in mitomycin C-treated eyes and corticosteroid-treated eyes, respectively. At 1 year, corneal haze developed in 20% of corticosteroid-treated eyes, versus 0% of mitomycin C-treated eyes. At 12, 24, and 36 months, corneal confocal microscopy showed activated keratocytes and extracellular matrix significantly more evident in untreated eyes (Ps = 0.004, 0.024, and 0.046, respectively). CONCLUSION: Topical intraoperative application of 0.02% mitomycin C can reduce haze formation in highly myopic eyes undergoing PRK. Comment in Ophthalmology. 2006 Feb;113(2):357; author reply 357-8

    Jean Langlais (1907 - )는 현존하는 프랑스의 대표적인 Organ작곡가이며 오랜 전통을 자랑하는 St. Clotilde 성당의 Organist로서, 80세에 가까운 최근까지도 독실한 카톨릭 신앙을 바탕으로 종교적인 소재와 제목을 갖는 많은 Organ작품을 써내고 있다. 본 논문에서는 먼저 Langlais가 속한 20세기 프랑스 Organ 음악의 배경 및 그의 생애를 간단히 서술하고, 다음으로 Langlais가 Organist로 봉사하고 있는 오랜 전통을 자랑하는 St. Clotilde 성당의 Organ에 대한 소개와 그의 Organ작품 및 음악의 특징을 다루었고, 마지막으로 그의 중기작품으로 오늘날 많이 연주되고 있는 Fe^te를 자세히 분석하여 그 형식과 음악적 특징을 살펴 보았다. 그의 많은 작품에서 찾아 볼 수 있는 공통적인 특징으로는 밝고 화려한 음색, 시적이고 호소력있는 선율, 풍부한 화성, 불규칙한 리듬과 박자의 잦은 변화, 기교적인 페달의 사용, 대조적인 악절의 사용, 그리고 무엇보다도 심오한 종교적인 정신을 들수 있겠다. 1946년도에 쓰여진 Fe^te는 작곡년도에 어울리지 않게 매우 복고적인 작품이다. 전반적으로 즉흥적 스타일로 작곡되었으나 어디까지나 조성을 그 기반으로 하고, Sonata형식과 변주곡 형식의 중간을 따르는 듯 보이는 ABA´의 세부분 형식으로 되어 있고, 성부구조는 선율과 반주형이 주류를 이룬다. 한편 Fe^te에서 볼 수 있는 4도화음(Quartal Chord), 복화음(Poly Chord), 복조(Bitonality)의 사용, 전통적인 7음음계의 구성음에 #(Sharp)이나 b(flat)을 붙여 변형된 7음음계를 사용하는것 등은 Langlais의 신선한 현대적인 감각을 느끼게 한다. Langlais는 Baroque로부터 19세기에 이르는 프랑스 Organ 음악의 오랜 전통을 바탕으로 하고 그 위에 20세기의 새로운 수법을 가미하여 개성이 뚜렷한 많은 Organ작품을 써 냄으로, 세계 여러나라의 Organ연주회에서 그의 작품이 자주 연주되고 사랑 받는 훌륭한 작곡가가 되었다고 결론 지을 수 있다.;Jean Langlais (1907- ), the present and eminent French organist and composer of Sainte-Clotilde, is well-known its musical tradition over a period of 125 years. He still composes many organ works that have religious themes and motif based on his faithful Catholic faith. In this thesis, first the writer described briefly the background of the 20th century organ music to which Langlais belongs and the life of Langlais. Second the writer dealt with the introduction of the organ of Sainte-Clotilde being famous for its historic and a living tradition, "the Sainte-Clotilde Tradition", in which Langlais serves as a organist and his organ works and characteristics of his music. Last, The writer analyzed Fe^te being widly performed in detail and examined the form and the musical idiom. Many of his works have these characteristics : brightly colorful registration ; poetic and directly appealing melodies ; rich harmonies ; irregular rhythms and meter changes ; virtuoso pedal work; through-composed pieces with sharply contrasting sections; above all his profound religious spirit. Fe^te, composed in 1946, is very restorational work unsuitable its composition year. Generally, it was composed of improvisatory style, but it was based on tonality and formed of three part forms, ABA´, which seem to follow the middle of Sonata and variation forms and the texture consists, of mostly melodies and accompaniment forms. The other hand, quartal chord, poly chord, use of bitonality, and the use of changed hapta chord added sharp (#)or Flat (b) to tone of the traditional hapta chord make us feel his fresh and contemporary sense.     Dispelling the Myths Behind First-author Citation Counts

    We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods

    (An) Analysis on Jean Langlais' Organ Music : Emphasis on analysis Hommage a frescobaldi

    The purpose of this study is to understand Jean Langlais'(1907∼1991) organ music through his work, 「Hommage a´ Frescobaldi」. He worked as the organist of St. Clotilde Catholic church following Ce´sar Franck(1822∼1890) and Charles Arnould Tournemire(l870∼1939). With a great store of creativity, he composed many organ works that have religious themes and motif based on his strong catholic faith. Working in America, he had deeply influenced on American composers of their French style in the 20th century and contributes to form its basis. Especially, he is a good example of representative composer in neoclassicism of 20th century. This study will deal with the background of the neoclassicism and organ music in France briefly in the first part, the life and music of Langlais in the second, and 「Hommage a´ Frescobaldi」, in the third part. 「Hommage a´ Frescobaldi」, composed in 1635 offered to Frescobaldi. He used motives and melodies of 「Fiori Musicali」 and Gregorian chant. This collection consists of 8 small works and each tune has its title. It isn't tonality, but has its tonal center. And there are simple structure of brief motive and melody with repetition, transformation, extension. and reduction. Each works marked registrations, poly chord and bitonality, etc. Many of his works have these characteristics : brightly colorful registration; poetic and directly appealing melodies; irregular rhythms and meter changes; virtuoso pedal work; through-composed pieces with sharply contrasting sections; above all his profound religious spirit. In conclusion, he used Gregorian chant and form in neoclassicism and modernistic Langlais' techniques. Langlais is, as known through this work, a musician who fully presented his creative world. He is a representative composer of neoclassicism and French organ music.;본 논문은 20세기 프랑스의 작곡가이자 오르가니스트, 즉흥연주가, 교육자인 랑그레(Jean Langlais l907-1991)의 오르간 작품「프레스코발디를 기리며(Hommage a´Frescobaldi, 1951)」를 통하여 그의 오르간 음악을 이해하는데 궁극적인 목적을 두고 있다. 랑그레는 끌로띨드 대성당(St.Clotilde)에서 프랑크(Ce´sar Franck 1822-1890)와 뚜네미르(Chules Arnould To urnemire 1870-1939)의 뒤를 이어서 오르가니스트로 활동하였고, 그의오르간 작품은 풍부한 창의성을 가지고 있으며, 특히 종교적인 주제와 가톨릭적인 신념을 바탕으로 한 선율을 가진 작품을 많이 작곡하였다. 또한 그는 미국에서의 활발한 활동을 통하여 20세기 미국에서 나타난 프랑스 스타일에 영향을 주는데 큰 공헌을 하였다. 그리고 그는 20세기 프랑스 오르간 음악의 대표적인 신고전주의 작곡가로서 그의 음악에는 이러한 시대적 배경이 잘 나타나고 있다. 그의 대표적 작품중 하나인「프레스코발디를 기리며」는 프레스코발디에게 헌정하는 작품으로서 프레스코발디가 1635년에 작곡한 건반악기 모음집인 「Fiori Musicali」에서 사용한 동기와 선을 그리고 또 다른 그레고리안 선율을 사용하였다. 또한 총 8곡의 모음곡 형식으로 되어있는 작품으로서 각 곡마다 제목이 있다. 조성에 있어서는 장단조 체계는 아니지만 중심이 되는 조성이 존재하며 그의 음악적 특징인 복조(bitonality)도 사용하였다. 그리고 짧은 동기와 선율을 가지고 반복, 변형, 확대, 축소 등을 통하여 전개되며 간결하고 단순한 구조를 가지고 있는 작품으로서 각 곡마다 레지스트레이션을 표기하고 있다.
