La philosophie du droit de Gustav Radbruch
La philosophie du droit du juriste allemand Gustav Radbruch
constitue le sujet de cet article. Lbbjectifpremier de celui-ci est de
mettre en lumière une oeuvre philosophique fascinante, malheureusement
très peu connue dans le monde juridique francophone.
Notre travail se divise en deux parties principales, lesquelles
sont précédées d'une brève biographie de Gustav Radbruch.
La première partie est consacrée à l'examen de la philosophie
antinomique du droit développée par Radbruch avant la Seconde
Guerre mondiale. C'est à travers son oeuvre principale "Rechtsphilosophie"
que nous nous proposons d'analyser la portée ainsi que
les limites de cette philosophie.
Nous nous intéressons, en seconde partie, à l'évolution de la
philosophie de Radbruch après les événements survenus en Allemagne
pendant la seconde guerre mondiale.
Enfin, nous nous interrogeons sur la pertinence d'introduire
des notions de droit naturel à l'intérieur de son système philosophique
relativiste.Abstract: The works of one of the most eminent German legal philosophers of the twentieth century, Gustav Radbruch, is rhe subject of this article. The objective of this paper is to cast light on a fascinating philosophy which is unfortunately less well known in the French legal community. The paper is divided in two parts. They are preceded by a brief biography of Gustav Radbruch. The first part examines the antinomie legal philosophy elaborated by Radbruch before the Second World War. The author analyzes the signifiicance and limits of this philosophy through the study of Radbruch's main work "Rechtsphilosophie": In the second part, the author examines the evolution of Radbruch's legal philosophy following the events that occurred in Germany during the Second World War. Finally, the author considers the relevance of introducing natural law within Radbruch's relativist philosophical system

Gustav Radbruch
As recently as the end of the last World War the name and work of Gustav Radbruch were virtually unknown in the Anglo-American legal world. In 1938 Roscoe Pound, in his encyclopedic survey, Fifty Years of Jurisprudence, had given a concise account of Radbruch\u27s legal philosophy in the context of his section on neo-idealism. In 1944 Anton Hermann Chroust wrote a penetrating analysis of Radbruch\u27s philosophy of law, and about the same time the first edition of the present writer\u27s Legal Theory, published on the other side of the Atlantic, included Gustav Radbruch in the survey of major legal philosophers. It also acknowledged the author\u27s deep indebtedness to Radbruch\u27s principal work. Since Radbruch died in 1949 at the age of seventy-one, there has been a dramatic and welcome change. Not only has he remained the dominating figure in post-war Continental and especially German legal philosophy; in both Britain and the United States his work and views have been discussed by leading jurists such as Professors Campbell and Hart in Britain, and Professors Fuller and Patterson in this country. Radbruch\u27s Rechtsphilosophie was at last made accessible (in 1950) to English readers through the translation of his principal work in the Twentieth Century Series of Legal Philosophers
Morphine and alternative opioids in cancer pain: the EAPC recommendations
An expert working group of the European Association for Palliative Care (EAPC) has revised and updated its guidelines on the use of morphine in the management of cancer pain. The revised recommendations presented here give guidance on the use of morphine and the alternative strong opioid analgesics which have been introduced in many parts of the world in recent years. Practical strategies for dealing with difficult situations are described presenting a consensus view where supporting evidence is lacking. The strength of the evidence on which each recommendation is based is indicated
