The author takes up again the topic of the Criminal law of the enemy starting from postulates of Günther Jakobs and Niklas Luhmann, dealing with several concepts of the social systems theory, to arrive at the penal funcionalism and that way to do a critic to the posture of Jakobs with regard to the Criminal law of the enemy

Por que ler Günther Jakobs? Além da imagem no espelho

This article offers some reasons that explain why Günther Jakobs should be read. Like what Odo Marquard calls “plurism of peculiarity” offers an answer to the question, but also, the fact that the past is a constant guest in the reflections on the present and in this, Jakobs shows the dark side of the criminal law that we should not see. The institutions must sacrifice the freedom of some in order to defend society, especially those who do not intergrate or assimilate. The “Hegelian issue” in Günther Jakobs’ Theory of Criminal Intent (dolus)

    No full text
The essay concerns the theory of criminal functionalism and in particular the Hegelian roots of the theory of intention developed by Günther Jakobs and recently analyzed in Kritik des Vorsatzbegriffs (Mohr Siebeck, 2020). In particular, the author highlights the aporias and critical issues of a purely functionalist foundation of intention

This “Criminal Law of the Enemy” (or Criminal Law for the Enemy), recently suggested by Professor Günter Jakobs, has generated a defeaning reaction in the international criminal law. But that reaction hasn't had the expected effect; it means, the alarm screams of the juridical comunity have sunk in a sort of unfear characterizations towards the character of the author more than in a real option of changing towards an unpredictable and expanding Criminal Law. That's why, this article pretends to be, in some way, a severe opposition to that theory, for being uncongenial with the Democratic State, and, at the same time, the expression that “Criminal Law of the Enemy” does exist; althout it is not personified in the author, but in the legislation distinguished for an excesive punishment and the reduction of individual guaranties, accepted y proposed from different parts of society

Despite remarkable developments in diffraction unlimited super-resolution microscopy, in vivo nanoscopy of tissues and model organisms is still not satisfactorily established and rarely realized. RESOLFT nanoscopy is particularly suited for live cell imaging because it requires relatively low light levels to overcome the diffraction barrier. Previously, we introduced the reversibly switchable fluorescent protein rsEGFP2, which facilitated fast RESOLFT nanoscopy (Grotjohann et al., 2012). In that study, as in most other nanoscopy studies, only cultivated single cells were analyzed. Here, we report on the use of rsEGFP2 for live-cell RESOLFT nanoscopy of sub-cellular structures of intact Drosophila melanogaster larvae and of resected tissues. We generated flies expressing fusion proteins of alpha-tubulin and rsEGFP2 highlighting the microtubule cytoskeleton in all cells. By focusing through the intact larval cuticle, we achieved lateral resolution of <60 nm. RESOLFT nanoscopy enabled time-lapse recordings comprising 40 images and facilitated recordings 40 µm deep within fly tissues
