Auf dem Weg zu der Antwort wird klar, wie schwer es wäre, ein solches Recht zu erfüllen und wie besonders das Verhältnis zwischen Recht und Sprache ist. Formeln und Hinweise zum Verfassen verständlicher Texte fi nden ihre Grenzen in der Komplexität der zu regelnden Materie. Wo Bestimmtheit zwingend erscheint, um Akzeptanz zu erreichen, bietet Sprache Vagheit. Gerichtliche Entscheidungen sind für Fachleute schwer und für Laien kaum vorherzusehen. Noch komplexer werden diese Fragestellungen und Herausforderungen, wenn der Aspekt der Mehrsprachigkeit ins Spiel kommt. Dann muss übersetzt werden. Dabei sind Fehler wahrscheinlich und Unklarheiten nicht zu vermeiden. Die Fassungen weichen zwingend voneinander ab, sind aber, jedenfalls im Europarecht, gleichermaßen verbindlich. Wie kann in der Rechtsanwendung mit diesen Bedeutungsunterschieden umgegangen werden? Soll es eine Fassung geben, die im Zweifel vorrangig ist; soll die Mehrheit der Fassungen entscheidend sein? Solche Lösungen würden bedeuten, dass sich der Bürger nicht auf seine Sprachfassung verlassen kann. Wie mit diesem Widerspruch umgegangen werden kann, zeigt der zweite Teil der Arbeit

    Pragmatic Case Studies as a Source of Unity in Applied Psychology

    To unify or not to unify applied psychology: that is the question. In this article we review pendulum swings in the historical efforts to answer this question—from a comprehensive, positivist, “top-down,” deductive yes between the 1930s and the early 60s, to a postmodern no since then. A rationale and proposal for a limited, “bottom-up,” inductive yes in applied psychology is then presented, employing a case-based paradigm that integrates both positivist and postmodern themes and components. This paradigm is labeled “pragmatic psychology” and, its specific use of case studies, the “Pragmatic Case Study Method” (“PCS Method”). We call for the creation of peer-reviewed journal-databases of pragmatic case studies as a foundational source of unifying applied knowledge in our discipline. As one example, the potential of the PCS Method for unifying different angles of theoretical regard is illustrated in an area of applied psychology, psychotherapy, via the case of Mrs. B. The article then turns to the broader historical and epistemological arguments for the unifying nature of the PCS Method in both applied and basic psychology.Peer reviewe

    Ekel wird im breiten Sinne als eine Abwehrreaktion, eine Ablehnung definiert. Das Ekelgefühl ist jedem Menschen angeboren und Disziplinen, wie die Psychologie und die Anthropologie, einigen sich darüber, dass Ekel ein menschliches Gefühl ist. Obwohl Ekel eine bedeutende Komponente des Gefühlslebens darstellt, ist die Forschung in diesem Bereich äußerst gering. Die vorliegende Arbeit beschäftigt sich mit den Gründen sowie den Folgen des Ekels auf Grundlage der Erzählung "Mit Messer und Gabel" von Doris Dörrie. In komprimierter Form thematisiert der Text die vier Sinne – Geräusch, Geruch, Tastsinn und Sehsinn –, die mit Ekel verbunden sind, und stellt deren Auswirkung dar. Im Hintergrund dieser Überlegungen beschäftigt sich die vorliegende Arbeit mit folgenden Fragen: Wie wird Ekel von Doris Dörrie dargestellt? Wie versucht die Protagonistin der Erzählung das Ekelempfinden zu bewältigen? Was sind weitere Gefühlszustande, die der Ekel bei der Protagonistin evoziert? Methodisch lehnt sich die Arbeit an die Phänomenologie an. In seinem Werk "Ekel. Hochmut, Haß. Zur Phänomenologie feindlicher Gefühle" beschäftigt sich Aurel Kolnai ausschließlich mit Ekel und vergleicht diesen mit anderen feindlichen Gefühlen. Für eine ausführliche Analyse der Erzählung sollen Kolnais Überlegungen und Differenzierungen zu Ekel und anderen antagonistischen Gefühle herangezogen werden.Disgust is classified as one of the basic emotions, along with joy, happiness, jealousy and dread. There are many definitions of disgust. However, it is basically considered to be a strong response, towards something that is felt to be unpleasant. Although it is considered to be one of the basic emotions, not many literary works or movies choose to put this dark emotion at the center of their plot. In that regard, is the story Mit Messer und Gabel one of the very few literary works that basically deals with disgust on many different levels. This paper specifically concentrates on the causes and the consequences of disgust in the story "Mit Messer und Gabel". Furthermore, it aims to answer the following questions: How is disgust being depicted by the Author Doris Dörrie? How does the Protagonist try to fight this emotion and what other emotions are being evoked due to disgust? The method applied in this paper is based upon the thoughts of the phenomenologist Aurel Kolnai. In his work "Ekel, Hochmut, Haß. Zur Phänomenologie feindlicher Gefühle", deals Kolnai exclusively with disgust as a basic emotion and compares it with other hostile feelings

    Artificial insemination is an invaluable tool that has been adopted by the cattle industry, primarily dairy, and continues to be a crucial reproductive technique. Likewise, cryopreservation is ubiquitously used in the U.S. as the preferred method to store bovine sperm due to convenience despite damage to sperm during processing and thawing. For this reason, one of our objectives was to determine if a liquid extender, FSRD4+, could extend the lifespan of sperm by days. Since longevity with minimal sperm damage was an ultimate goal, we also tested the effect on longevity by adding oviduct glycans to medium and extender. Before fertilization and while bound to the oviduct, sperm become quiescent and have prolonged viability and maintained motility. Additionally, sperm undergo capacitation to reach final maturation. Capacitation will allow the sperm to hyperactivate and penetrate the cumulus cells and the zona pellucida, and fertilize the oocyte. The sperm-oviduct binding and subsequent sperm reservoir formation is facilitated by glycan-lectin binding. In cattle, the Lewis A trisaccharide (LeA) in the oviduct binds sperm. We tested sulfated LeA, because it binds sperm with higher affinity, for its effects on sperm viability and motility compared to controls. Four variables were applied: temperature (5°C, 15°C, 22°C, 37°C), glycans (suLeA, suLeX, no glycan), medium (FSRD4+ and dmTALPC), and time (1, 24, 48, 72, 96, and 120 hr). Semen was collected and shipped overnight for experiments. Sperm were washed, incubated in their respective temperature, glycan, and media treatments, and analyzed for viability and motility. Viability was determined using fluorescent probes SYBR14 and propidium iodide (PI). Motility was determined as total motility where progressive and non-progressive motility were summed. Significance was determined by a p-value of ≤ 0.05. The results indicated viability had improved significantly in FSRD4+ extender had significantly higher viability than dmTALPC, both suLeA and suLeX performed similarly but had significantly higher viability than no-glycan treatment, and 15˚C and 22˚C had significantly higher viability than 5˚C and 37˚C. Similarly, sperm motility was significantly higher in FSRD4+ extender compared to dmTALPC. Sperm motility was higher with suLeX compared to suLeA and no-glycan, and suLeA compared to no-glycan. Over the 120 hr, 15°C storage yielded significantly more viable, motile sperm than 5˚C, 22°C, and 37˚C, despite it having significantly lower motility than 22°C and 37˚C at the 1 hr time point. To summarize, sperm in FSRD4+ extender, with suLeA, and at 15°C or 22°C had significantly higher viability, and sperm in FSRD4+ extender, with suLeX or suLeA, and at 15˚C had significantly higher motility compared to other treatments.
