Prime osservazioni sul rapporto tra il reato di “Diffusione illecita di immagini o video sessualmente espliciti” e le libertà di corrispondenza e di manifestazione del pensiero

Nello specifico, l’Autore si chiede se il reato di cui all’art. 612-ter incida sulle libertà di cui all’art. 15 e all’art. 21
Cost. Invero, l’unico obiettivo del reo è quello di ledere l’identità morale e l’onorabilità della vittima. Per questo motivo, non deve indurre in errore la circostanza che la condotta descritta dall’art. 612-ter verrà (esclusivamente) posta in essere utilizzando mezzi di comunicazione, deputati alla trasmissione del pensiero. Infatti, l’Autore ritiene che il fondamento costituzionale dell’art. 612-ter c.p. è da rinvenirsi negli artt. 2, 3 e 13 (intesa quale libertà di autodeterminarsi) Cost., mentre la libertà di corrispondenza e la libertà di manifestazione del pensiero non vengono compresse dal reato in esame.The paper concerns the relationship between the crime of “Illicit distribution of sexually explicit images or videos” (Article 612-ter of the Italian Criminal Code) and the constitutional freedoms of correspondence and expression of thought.
Specifically, the Author reflects on whether the offence under art. 612-ter affects the freedoms pursuant to Article 15 and Article 21 of the Constitution. Indeed, the offender’s sole objective is to damage the victim’s moral identity and reputation. For this reason, we should not be misled by the fact that the conduct targeted in Article 612-ter may (exclusively) be implemented using means of communication designed for the transmission of thought. In fact, the Author believes that the constitutional foundation for art. 612-ter of the Italian Criminal Code is to be found in Articles 2, 3 and 13 of the Constitution (regarding the freedom of self-determination), while the freedom of correspondence and freedom of expression of thought are not restricted by the crime in question

Get PDFAdolescents and youth are big consumers of the internet. Today, what we call online social media, such as social network sites (SNS), blogs, etc. are an important part of young people's life (Pujazon-zazik, Park 2010). Youth are increasingly utilizing these communicative tools to support or to enhance their "offline" relations (Subrahmanyam, Greenfield, 2008; Livingstone 2010).
The author's research focuses on a field that is very much neglected by the Italian sociological studies, aiming to understand the current state of the youth culture in relationship to the internet and sexuality.
The work seeks to understand how young italians today use the internet to gain and access information (visual images, discussions, discourses) about sexual and intimate life and activities; to understand 'how' and 'why' they use (or choose not to use) this particular medium, and what kind of social impact can be observed in this relatively new phenomenon.
The research seek (1) to understand what multimedia platform young Italian use to have access to information and discourses connected to sexuality; (2) to understand why they use (or don't use) this media; (3) to define the extent of Internet on the youth's experience on sexuality and their social construction; (4) to understand the definition of previously points to eventually rough out differences between boys and girls understanding how gender difference could be constructed in the Internet.
Everything avoiding to the oversimplifying labels of the Internet as either an entirely dangerous or entirely safe space .
With this research, the author wants to draw an attention to the problematic relationships between the "real" and "virtual", between the everyday life experience that contain also what someone define "virtual" life experience, an experience mediated by the social and cognitive space where the absence of the body plays a paradoxical roll in their (self-learning) education of sexuality and construction of identity.
The research is based on a qualitative approach and, more specifically, on participatory approach with focus groups, interviews and on-line focus groups with adolescents from 16 years old to 18 years old.
The main results of the research show an interesting panorama where the Internet goes to be integrated into everyday life with the classic agents of socialization (School, family, friends) in different ways depending on the dialogue that in the other places is permitted to adolescents. For the interviewed the Internet becomes important because it allows to cope with embarrassment, fear of the "firsts times" (first sexual intercourse, first kiss, etc.), curiosity, etc. Internet, overall with SNS, becomes an important part of the construction of identity of adolescents that with online resources try to "play" and define which Erving Goffman (1963) called social identity and personal identity. Everything goes to a specific direction: what the girls and the boys interviewed define "normality": a standardized idea of the gender roles and of the identity, something that "jump" in the "online" and "offline" spaces as a unique region without borders

No full textQuesta tesi di dottorato riporta i risultati ottenuti dall'autore durante le attività triennali del XXXVI ciclo del corso di dottorato in Ingegneria Elettrica e dell'Informazione del Politecnico di Bari. L'obiettivo principale di questo lavoro è stato quello di sviluppare metodologie e controlli per la gestione di risorse energetiche distribuite con lo scopo di promuovere la diffusione di microgrid isolate. Inoltre, l'obiettivo è stato quello di migliorare la capacità di accoglienza dei sistemi di distribuzione isolati, garantendone il funzionamento sicuro e stabile.
Il controllo e funzionamento di una microgrid in isola sono stati affrontati nel loro complesso, partendo dalla gestione ottimale delle risorse fino ad arrivare al controllo del funzionamento dinamico dei componenti della rete. In questi studi, l'attenzione si è incentrata principalmente su una piccola isola italiana di riferimento. Sulla base della sua struttura, sono stati sviluppati un algoritmo di pianificazione operativa (che opera sulla scala gerarchica di controllo più elevata e una scala temporale dell’ordine delle ore) e un algoritmo in tempo reale per la valutazione e l'allocazione della riserva operativa (che opera su una scala gerarchica di controllo intermedia e una scala temporale da 1 minuto a 15 minuti). Inoltre, sempre in relazione alla bassa inerzia delle microreti e delle reti di distribuzione in isola, sono state studiate e realizzate soluzioni innovative per la fornitura di servizi ancillari di regolazione veloce della frequenza (che operano su la scala gerarchica di controllo più bassa e su una scala temporale di pochi secondi). Tutte le metodologie discusse in questa tesi hanno mostrato un miglioramento della sicurezza e della stabilità dei sistemi di distribuzione isolati e la riduzione dei costi operativi e delle emissioni di gas serra.This doctoral thesis reports the results carried out by the author during the three-year activities of the XXXVI cycle of the Ph.D. course in Electrical and Information Engineering at Politecnico di Bari. The main goal of this work was to develop methodologies and controls for managing distributed energy resources with the aim to promote the deployment of isolated microgrids. Moreover, the goal was to enhance the hosting capacity of isolated distribution systems, ensuring their secure and stable operation. The control and operation of an islanded microgrid have been addressed in their entirety, starting with the optimal management of resources and ending with the control of the dynamic operation of grid components. In these studies, the main focus has been on a small Italian reference island. Based on its structure, an operational planning algorithm (operating on the highest hierarchical control level and a time scale on the order of hours) and a real-time algorithm for operating reserve assessment and allocation (operating on an intermediate hierarchical control level and a time scale from 1 minute to 15 minutes) were developed. Furthermore, concerning the low system inertia of microgrids and isolated distribution networks, innovative solutions for the provision of fast frequency support ancillary services, operating on the lowest hierarchical control level and a time scale of a few seconds, were studied and implemented. All of the methodologies discussed in this thesis have enhanced the security and stability of isolated distribution systems and reduced operational costs and greenhouse gas emissions

Get PDFEnWhile the first half of the nineteenth century saw the inauguration of a penchant for local and circumscribed itineraries, Cosimo De Giorgi, in a long and detailed letter to a friend from Pisa (later given to the press), sets out his brief experience of a railroad journey from Bari to Taranto. It is a report that skillfully combines technical and naturalistic information about the territory with sketchy descriptions of the places, but it is also embellished with notes on the author's state of mind and with his erudite observations. The essay aims to frame this lesser-known text by the eclectic Salento author within the framework of nineteenth-century odeporics by noting its characters and specificities.ItMentre nella prima metà dell'Ottocento si inaugura l'inclinazione per il percorso di itinerari locali e circoscritti, Cosimo De Giorgi, in una lunga e dettagliata lettera ad un amico pisano poi data alle stampe, espone la sua breve esperienza di un viaggio in ferrovia da Bari a Taranto. Si tratta di una relazione che coniuga sapientemente informazioni di carattere tecnico e naturalistico sul territorio a descrizioni bozzettistiche dei luoghi, ma che è anche impreziosita da appunti sullo stato d'animo dell'autore e dalle sue erudite osservazioni. Il saggio si propone di inquadrare questo testo meno noto dell'eclettico autore salentino nell'alveo dell'odeporica ottocentesca rilevandone caratteri e specificità

No full textThe article analyses the issue of Internet access and digital divide, also considering Covid-19 health emergency. The Author acknowledges that Internet is now a fundamental prerequisite for exercising civil and political rights and for developing individual's personality. Therefore, retracing doctrinal orientations developed on Internet access, he believes that it should not be configured as a right but a mere functional instrument for exercising fundamental rights. Hence the need to shift the centre of gravity of the issue from the right to the instrument to the effectiveness of the right exercisable through the instrument. Therefore, without the need to include Internet access in the list of (fundamental) rights, it is argued that it must be subsumed in the context of the public service, and in particular in the universal service. This in fact would entail the undoubted advantage - with the Constitution unchanged - of not excluding any segment of the population from the Internet service (it would be better, from broadband connection). All this is also investigated from the visual angle of Covid-19 health emergency, which has sharpened digital divide and that made the intervention of the legislator necessary to better guarantee Internet access, since through the remote connection (and only through it) it was possible to exercise certain fundamental rights during the lockdown

No full textAttraverso inediti documenti contabili l'autore ricostruisce la committenza di un tavolo in commesso marmoreo, oggi conservato nel Musée national d'Histoire naturale di Parigi e di ricondurlo con precisione a Cosimo Del Cartolaio, gioielliere e competitore di marmi attivo a Roma tra 1613 e 1615, e al committente Virginio Orsini, II duca di Bracciano. L'autore inoltre ricostruisce la storia del manufatto e il suo arrivo come dono al cardinale Giulio Raimondo Mazzarino, Primo Ministro di Francia. Inoltre per comprendere l'apporto del duca Orsini alle collezioni famigliari si analizzano le circostanze dell'acquisto della Calunnia di Apelle di Federico Zuccari.Through unpublished accounting documents, the author reconstructs the commissioning of a table in marble commesso, now preserved in the Musée national d'Histoire naturelle in Paris, and traces it back precisely to Cosimo Del Cartolaio, a jeweller and marble craftsman active in Rome between 1613 and 1615, and to the commissioner Virginio Orsini, II Duke of Bracciano. The author also reconstructs the history of the artefact and its arrival as a gift to Cardinal Giulio Raimondo Mazzarino, Prime Minister of France. Furthermore, to understand Duke Orsini's contribution to the family collections, the author analyses the circumstances of the purchase of Federico Zuccari's Calumny by Apelles
