Pengangkatan tanpa pencatatan terhadap anak hasil perkawinan sirri perspektif maqashid syariah
Get PDFPengangkatan anak merupakan sebuah perbuatan hukum dengan mengalihkan seorang anak dari lingkungan kekuasaan orang tua, dan membesarkan anak tersebut ke dalam lingkungan keluarga orang tua angkat. Fakta di Indonesia masih ditemukan pengangkatan anak hasil perkawinan sirri tanpa melalui penetapan pengadilan yang artinya pengangkatan tersebut tidak tercatat pada administrasi negara. Sehingga, ada dua permasalahan dalam kasus tersebut, yaitu anak yang diangkat merupakan hasil perkawinan sirri, dan pengangkatan anaknya tanpa dicatat. Penelitian ini bertujuan untuk mengetahui dan menganalisis (1) Bagaimana pengaturan pengangkatan anak di Indonesia (2) Bagaimana kedudukan hukum pengangkatan tanpa pencatatan terhadap anak hasil perkawinan sirri perspektif maqashid syari’ah. Penelitian ini menggunakan penelitian normatif (normative) yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder. Penelitian hukum menganalisis hubungan timbal balik antara fakta hukum dengan sosial. Penelitian hukum normatif. Sumber data sekunder yaitu bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Metode pengumpulan data adalah dilakukan dengan Studi Pustaka (library reseach). Metode analisis data yang diperoleh menggunakan metode pendekatan konseptual. Hasil penelitian menunjukan bahwa Pengaturan Pengangkatan Anak di Indonesia diatur dalam UndangUndang Nomor 1 Tahun 1974 tentang Perkawinan, Undang-Undang Nomor 35 tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 23 tahun 2002 tentang Perlindungan Anak, Undang-Undang Nomor 4 Tahun 1979 tentang Kesejahteraan Anak, Undang-Undang Nomor 24 Tahun 2013 tentang Perubahan Atas Undang-undang Nomor 23 Tahun 2006 tentang Administrasi Kependudukan, KUHPerdata, Kompilasi Hukum Islam. Berbagai regulasi tentang pengangkatan anak sebagai upaya preventif untuk memberikan perlindungan hukum seseorang dari kerusakan dan kerugian. Pengangkatan anak tanpa pencatatan anak hasil perkawinan sirri lebih banyak mendatangkan kemudaratan dibanding kemaslahatan. Hal tersebut tidak sejalan dengan peraturan dan kaidah fikih maupun maqashid syariah. Analisis Terhadap Pengangkatan Anak Tanpa Pencatatan Perspektif Maqashid Syariah
Get PDFThe purpose of this study is to analyze unregistered adoption from a maqashid sharia perspective. This is done because society still practices unregistered adoption based on court orders. Unregistered adoption can lead to legal issues and child protection concerns. This article employs normative legal research using secondary data from literature review. Data analysis was conducted through a conceptual approach utilizing the maqashid sharia theory. The results show that Islamic law does not prohibit adopting a child as long as it does not change the child\u27s status to that of a biological child of the adoptive parents. Adoption must be accompanied by registration. Unregistered adoption contradicts maqashid sharia because it does not fulfill al-kulliyat al-khamsah. Registration is not only an administrative requirement but also essential for legal protection according to maqashid sharia.
Tujuan penelitian ini untuk menganalisis pengangkatan anak tanpa pencatatan perspektif maqashid syariah. Hal ini dilakukan karena di masyarakat masih ditemukan praktik pengangkatan anak tanpa pencatatan berdasarkan penetapan pengadilan. Pengangkatan anak tanpa pencatatan dapat menimbulkan masalah hukum dan perlindungan anak. Jenis penelitian dalam artikel ini termasuk penelitian hukum normatif dengan menggunakan data sekunder yang didapat melalui studi pustaka. Analisis data dilakukan menggunakan pendekatan konseptual dengan menggunakan teori maqashid syariah. Hasil penelitian menunjukkan hukum Islam tidak melarang seseorang melakukan pengangkatan anak selama tidak mengubah status anak angkat menjadi anak kandung dari orang tua angkatnya. Pengangkatan anak harus disertai pencatatan. Pengangkatan anak tanpa pencatatan bertentangan dengan maqashid syariah karena tidak memenuhi al-kulliyat al-khamsah. Pencatatan bukan hanya kewajiban administratif, tetapi juga syarat perlindungan hukum sesuai maqashid syariah
Going Beyond Counting First Authors in Author Co-citation Analysis

counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

Get PDF“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
Get PDFWe provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
