Status Hukum Anak Adopsi (StudiPenetapanNomor 182/Pdt.P/2014/PN.Krg)

bahkan anak dianggap sebagai harta kekayaan yang paling berharga
dibandingkan kekayaan harta benda lainnya. Anak sebagai amanah
Allah harus senantiasa dijaga dan dilindungi karena dalam diri anak
melekat harkat,martabat, dan hak-hak sebagai manusia yang harus
dijunjung tinggi. Seorang anak memiliki peranan yang sangat penting
dalam kehidupan rumah tangga, karena tujuan melangsungkan
perkawinan selain untuk membangun mahligai rumah tangga yang
bahagia dan sejahtera juga untuk mempersatukan keluarga dan
meneruskan keturunan, sehingga tidak heran jika banyak pasangan
suami istri yang baru melangsungkan perkawinan begitu
mendambakan kehadiran seorang anak dalam kehidupan rumah
tangganya. Adopsi anak dan anak angkat termasuk bagian substansi
dari hukum perlindungan anak yang telah menjadi bagian dari hukum
yang hidup dan berkembang dalam masyarakat. Adopsi anak harus
dilakukan dengan proses hukum melalui penetapan
pengadilan.Berdasarkan latar belakang tersebut, maka permasalahan
yang akan dibahas dalam skripsi ini adalah sebagai berikut: Pertama,
apa bentuk hubungan hukum antara anak adopsi dengan orang tua
yang mengadopsi dan orang tua kandung anak tersebut, Kedua,
apakah anak adopsi berhak mewarisi harta dari orang tua yang
mengangkatnya dan harta dari orang tua kandungnya, dan Ketiga, apa
dasar pertimbangan hukum hakim dalam menetapkan penetapan
Nomor 182/Pdt.P/2014/PN.Krg sudah sesuai dengan hukum
islam.Metode penelitian yang digunakan dalam melakukan penelitian
yang terdiri dari tipe penelitian dan pendekatan masalah.Tipe
penelitian yang digunakan dalam skripsi ini yaitu yuridis normatif
sedangkan pendekatan masalah yang digunakan adalah pendekatan
Undang-Undang (statute approach) dan pendekatan konseptual
(conceptual approach).Bahan hukum yang digunakan dalam skripsi
ini terdiri dari bahan hukum primer dan bahan hukum sekunder.
Tinjauan pustaka skripsi ini membahas mengenai, Pertama
yaitu terdiri dari anak, pengertian anak, dan macam-macam anak
dimana pengertian-pengertian tersebut dikutip dari beberapa buku
bacaan dan Undang-Undang yang ada di Indonesia.Kedua yaitu terdiri
dari adopsi anak, pengertian adopsi anak dan syarat adopsi anak
dimana pengertian tersebut diambil dari beberapa buku bacaan dan
Undang-Undang yang ada di Indonesia.
Pembahasan dalam skripsi ini mencakup yang pertama, bentuk
hubungan hukum antara anak adopsi dengan orang tua yang
mengadopsi dan orang tua kandung anak tersebut.Kedua, anak adopsi
berhak mewarisi harta dari orang tua yang mengadopsinya dan harta
dari orang tua kandungnya.Ketiga, dasar pertimbangan hukum hakim
dalam menetapkan penetapan Nomor 182/Pdt.P/PN.Krg sudah sesuai
dengan hukum islam. Berdasarkan rumusan masalah dan pembahasan, dapat ditarik
kesimpulan bahwa (1) Hubungan hukum yang terjadi antara anak
angkat dengan orang tua kandung tidak terputus seperti yang terjadi
bahwa hubungan antara anak angkat dengan orang tua angkat tidak
akan putus hubungan karena Para Pemohon yang tempat tinggalnya
bertetangga dengan orang tua kandung dan masih ada hubungan
kekerabatan antara si orang tua kandung dengan orang tua angkat yaitu
paman dari si anak angkat tersebut. Hubungan hukum terjadi karena
adanya perbuatan hukum yang dilakukan Para Pemohon yaitu
mengadopsi anak yang menimbulkan akibat hukum yang
dikehendaki.(2). Anak adopsi tidak berhak mewarisi harta dari orang
tua yang mengadopsinya namun mendapatkan harta waris dari orang
tua kandungnya. karena di dalam hukum islam tidak ada istilah adopsi
anak dan anak adopsi tidak mendapatkan sepeserpun dari orang tua
angkat. Namun di dalam Kompilasi Hukum Islam pasal 209 ayat (2)
menyatakan bahwa “ terhadap anak angkat yang tidak menerima
wasiat diberi wasiat wajibah sebanyak-banyaknya 1/3 dari harta
warisan orang tua angkatnya.”(3) Dasar Pertimbangan hukum hakim
dalam menetapkan Penetapan Nomor 182/Pdt.P/2014/PN.Krg yaitu
telah sesuai dengan hukum islam. Hal ini dapat dibuktikan dalam isi
Penetapan Pengadilan Negeri Republik Indonesia Nomor
182/Pdt.P/2014/PN.Krg Karena seperti yang terjadi para pemohon
melakukan pengangkatan anak dengan sama-sama beragama islam
sesuai dengan yang diatur dalam Pasal 39 Undang-Undang RI Nomor
23 Tahun 2002 Tentang Perlindungan Anak yang isinya yaitu calon
orang tua angkat harus seagama dengan agama yang dianut oleh calon
anak angkat. sesuai Pasal 49 huruf a angka 20 dan penetapan tersebut
sesuai dengan islam. Karena adopsi anak antara orang-orang yang
beragama islam menjadi kewenangan Pengadilan Negeri dan akan
memberikan penetapan adopsi anak berdasarkan hukum islam. Saran
yang diberikan adalah (1) Kepada masyarakat yang akan melakukan
pengangkatan anak hendaknya mematuhi prosedur hukum yang
berlaku terkait dengan masalah pengangkatan anak. (2) Kepada orang
tua yang mengadopsi hendaknya tidak menutup-nutupi tentang asalusul
anak yang di adopsi dan orang tua angkat hendaknya menjamin
terpenuhinya kebutuhan masa depan anak yang di adopsi
Going Beyond Counting First Authors in Author Co-citation Analysis
Get PDFThe present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

Get PDF“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
Get PDFWe provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
