Legal issues concerning land use patterns when foreigners manage agribusiness in Ukraine
No full textConsidered certain advantages of the agreement of emphytes on the lease agreement. It is concluded that the state restricts the economic freedom of the lessor and the lessee regarding the forms and sizes of the rent, the types of contract and its essential conditions, the mandatory state registration of rental rights, etc. That is why agribusiness constantly searches for new, alternative forms of use of agricultural lands appointment, including the right of emphyteusis. The agreement on emphyteusis is an interesting alternative to the lease of agricultural land and has proven to be more effective in terms of land use rights, financial relations of the parties, administration. It should be noted, however, that not only the lease or the emphyteusis can be used to obtain land plots. Attention is drawn to the agreement on joint activity - as yet another way to form a land bank.Розглянуто певні переваги договору емфітевзису над договором оренди. Зроблено висновок, що держава обмежує економічну свободу орендодавця та орендаря щодо форм і розмірів орендної плати, видів договору та його істотних умов, обов'язковості державної реєстрації прав оренди тощо, саме тому агробізнес постійно здійснює пошук нових, альтернативних форм користування землями сільськогосподарського призначення, у тому числі право емфітевзису. Договір емфітевзису є цікавою альтернативою договору оренди землі сільськогосподарського призначення та зарекомендував себе ефективніше за оренду у питаннях строків дії прав користування землею, фінансових відносин сторін, адміністрування. Однак, що не лише орендою чи емфітевзисом можна скористатися для отримання земельних ділянок. Акцентовано увагу на договорі про спільну діяльність – як на ще один спосіб сформувати земельний банк.Рассмотрены некоторые преимущества договора эмфитевзиса над договором аренды. Сделан вывод, что государство ограничивает экономическую свободу арендодателя и арендатора относительно форм и размеров арендной платы, видов договора и его существенных условий, обязательности государственной регистрации прав аренды и т.п., поэтому агробизнес постоянно осуществляет поиск новых, альтернативных форм пользования землями сельскохозяйственного назначения, в том числе право эмфитевзиса. Договор эмфитевзиса является интересной альтернативой договора аренды земли сельскохозяйственного назначения и зарекомендовал себя эффективнее аренды в вопросах сроков действия права пользования землей, финансовых отношений сторон, администрирования. Однако, не только арендой или эмфитевзисом можно воспользоваться для получения земельных участков. Efficiency of oil companies in Russia in the context of energy and sustainable development
No full textThe transformation of the energy market and the development of its technologies radically change the industry and uncover new segments for competition. Scientific and technological progress is gradually changing the market structure and replacing petroleum products with other energy sources, creating new consumption sectors. However, the oil and gas industry still plays a major role in the energy and fuel balance of the world (almost 60% of global energy consumption is concentrated in the oil and gas sector). Due to the specifics of the petroleum sector, the companies tend to be large and have a significant direct and indirect influence on the oil industry as a whole. In this article, the authors of the study compared Russian and international companies in the oil and gas sector and identified the distinctive features of each group. To reveal the main factors influencing financial performance, we construct models of the dependence of net profit on various macroeconomic, microeconomic, institutional, and additional factors. The basic panel data model is tested, taking into account fixed and random individual effects. Results show that the profit of each major oil and gas company is affected by revenue, production costs, and tax deductions. The key interest rate set by the Central Bank of Russia is also important for the activities of oil and gas companies. A distinctive factor for petroleum corporations is the negative impact of financial leverage on the profits of domestic companies and the negative impact of investment in the environmental area for foreign companies. According to our forecasts, the total profit of the eight largest oil producers in Russia will decrease by 60% in 2020. Such forecasts are not very encouraging, but due to the current market situation, they are not surprising. © 2020 The Author

Consistent implementation of the law of the ecosystem approach to the use of natural objects with building land, taking into account the existence of a dialectical relationship elements of the environment, will provide ecologically and economically viable use of the beneficial properties of both the natural features and resources contained therein.Екологізація містобудівної галузі поки не виступає пріоритетним напрямком розвитку України, однак модернізація економіки і формування соціально-орієнтованого типу її розвитку без визначення цього курсу неможливі. Послідовна реалізація в законодавстві екосистемного підходу до використання природних об’єктів при забудові земель, що враховує існування діалектичного взаємозв’язку елементів навколишнього природного середовища, дозволить забезпечити екологічно і економічно виправдане використання корисних властивостей як самих природних об’єктів, так і ресурсів, які містяться в них.Экологизация градостроительной отрасли пока не является приоритетным направлением развития Украины, однако модернизация экономики и формирование социально-ориентированного типа ее развития без определения этого курса невозможны. Последовательная реализация в законодательстве экосистемного подхода к использованию природных объектов при застройке земель, учитывающего существование диалектической взаимосвязи элементов окружающей среды, позволит обеспечить экологически и экономически оправданное использование полезных свойств, как самих природных объектов, так и содержащихся в них ресурсов
Problematic issues of protection of "sealed" territories
No full textIn modern urban planning up to 70-90% of area of the city are free from buildings and covered with asphalt and other road surfaces. The "sealing" of territories by its nature is a violation of soils in urban areas, that negatively affects to the change of soil structure. For a long time there was not enough attention paid to soil under the surface in the scientific literature. They were not regarded as a resource. But it turned out that this type of soil actively influences on the ecosystem. It also has certain environmental, social and economic functions. Therefore, a separate group discussed in detail the soil, sealed by asphalt road and stone coverings – "sealed" the soil.При сучасному містобудуванні до 70-90% вільних від будівель території міста покрито асфальтобетоном та іншими дорожніми покриттями. «Запечатування» території за своєю природою є порушенням ґрунтів у містах, тобто негативно впливає на зміну структури ґрунтів. Досить довго в науковій літературі не приділялось достатньо уваги ґрунтам, що знаходяться під покриттям, вони не розцінювалися як ресурс. Але виявилося, що такий тип ґрунту активно впливає на екосистему, він здійснює певні екологічні, соціальні та економічні функції. Тому детально розглянута окрема група ґрунтів, запечатаних під дорожніми асфальтобетонними і кам’яними покриттями, – «запечатані» ґрунти.При современном градостроительстве до 70-90% свободных от строений территории города покрыто асфальтобетоном и другими дорожными покрытиями. «Запечатывание» территории по своей природе является нарушением почв в городах, то есть негативно влияет на изменение структуры почв. Довольно долго в научной литературе не уделялось достаточного внимания почвам, находящихся под покрытием, они не рассматривались как ресурс. Но оказалось, что такой тип почвы активно влияет на экосистему, он осуществляет определенные экологические, социальные и экономические функции. Поэтому подробно рассмотрена отдельная группа почв, запечатанных под дорожными асфальтобетонными и каменными покрытиями – «запечатанные» почвы

З цією метою доцільно проаналізовано досвід країн-членів Європейського Союзу, країн з розвинутою економікою, а також країн, позиції яких на ринку органічної продукції дуже схожі до вітчизняних, та, на основі розглянутого, запропоновано відповідні заходи й інструменти впливу, застосування яких сприятиме розвитку органічного сектора в Україні.Украина находится на начальном этапе развития органического сектора и требует учета международного опыта для формирования собственного эффективного механизма развития производства органической сельскохозяйственной продукции. Expanding the Applicability of the Competitive Modes Conjecture
No full textThe Competitive Modes Conjecture is a relatively new approach in the field of Dynamical Systems, aiming to understand chaos in strange attractors using Resonance Theory. Up till now, the Conjecture has only been used to study multipolynomial systems because of their simplicity. As such, the study of non-multipolynomial systems is sparse, filled with ambiguity, and lacks mathematical structure. This paper strives to rectify this dilemma, providing the mathematical background needed to rigorously apply the Competitive Modes Conjecture to a certain set of non-multipolynomial systems.
