No full textThe article is devoted to the regulation of the procedure of disputes by the arbitral tribunals of the Republic of Tajikistan. The author comments on the provisions of the law of the Republic of Tajikistan No.344 dated January 5, 2008 "On Arbitral tribunals". The main institutions of the civil society function in the Republic of Tajikistan, that is a democratic state, they allow economic actors to protect their rights and freedoms without the assistance of the State Justice agencies. Arbitral tribunals are an important institution in the sphere of non-government justice that allows people and legal entities to protect their rights and legitimate interests effectively in the sphere of economic relations.
In this article, the authors present a detailed article-by-article commentary on provisions of the above mentioned law that regulates the process of dispute resolution by the arbitral tribunal. Legal status of the arbitral tribunals, issues of their competence, procedure of the arbitral tribunal formation, procedure for the providing of the evidence, system of principles of the arbitration, etc. are explored. Provisions discussed in this article are of great importance for the understanding of the theory and practice of modern arbitration

Currently, forms of settlement of legal disputes that are alternative to state justice are popular, including commercial arbitration, which is becoming more widespread in the modern world, which is primarily associated with the development of economic turnover and business activity, as well as an increase in the volume of domestic and international economic connections.
The relevance of the issues under research consists in the fact that the author examines the procedure for arbitration trial in a strictly defined area related to compensation for damage, as a means of protecting the rights and interests of subjects of economic activity. The research results can be implemented in legislative work on improving legislation in the field of arbitration of disputes and regulation of issues of compensation for damage
Commercial arbitration as non-state economy justice
No full textIn the present thesis the author explores a set of legal relations arising in the process of arbitration trial. Object of research represents the objective analysis of procedure of consideration of disputes in arbitration tribunals, and also research of the legislation regulating arbitration legal proceedings, revealing in it of blanks and lacks. The international legislation and legislation of various states, such as Italy and other EU countries, the Russian Federation, the USA and other states, as well as the rules of leading arbitration institutions, are researched.
Propose of research is a complete and objective analysis of the procedural features of arbitration proceedings, from the conclusion of arbitration agreement to the execution of arbitration award. Issues and problems of legal regulation of procedural legal relations arising in connection with arbitration proceedings are analyzed. Definition of the basic problems in arbitration and development of recommendations about their solving are making.
Author explores both international and national commercial arbitration, but more attention is paid to national arbitration. Because, the legal regulation and practice of international commercial arbitration are now strongly unified in most states. As regards national arbitration, its legislative regulation and practice differs in various countries

No full textThe article presents an analysis of the poem of F.I. Tyutchev with the attraction of evangelical texts, works of the Russian religious philosophers, and such poets as A.S. Pushkin, VA. Zhukovsky, A.A. Fet, A.A. Maykov and F.I. Tyutchev himself. The stress is laid on the ideological position of the lyrical subject and features of figurative thinking that allow specifying a question of a place of the poet in the literary movement of the 2nd half of the XIXth century. It is proved that the consciousness of Tyutchev who created the poetic addressing includes the religious component participating in creation of images. In this case, the assumption is argued according to which the romantic canon of a creative phenomenon with its idealistic concept kept by Tyutchev as fidelity of tradition is in addition strengthened by the characteristic preferences that show the author’s proximity to “Pure Art”. The author arrives at such conclusions: 1) the poem “To A.V. Pl va” declares commitment to the ideas of the late-romantic school; 2) images of the miniature are created by the triad “outlook - creativity - a human ideal”; 3) the semantic dominant of the message is conviction in the value of belief for an orthodox person, and for an artist - in art, inspired by spiritual beauty; 4) the religious component of attitude of the lyrical subject interacts with a wide literary background and makes opposition to «unromantic» options of a world outlook and everyday philosophy of life

No full textРаздел "Международные экономические отношения"Существующая практика реализации продукции и взаимоотношений субъектов на внешних рынках показывает значимость отдельных форм интегрированных связей. Как для производителя, так и для посредника важна снижающая совокупные издержки технология продвижения товара к потребителю.
Авторами предложена методика расчета эффективности каждого звена цепочки или структурных подразделений независимо от организационного оформления интегрированных связей.
Определение эффективности экспорта с учетом наличия интегрированных связей основано на распределении прибыли от экспорта пропорционально произведенной каждым звеном цепочки добавленной стоимости, что соответствует затратам живого и прошлого труда на каждом этапе производства и реализации продукции. Распределение может проводиться как на стадии планирования, когда не известны контрактные цены, так и при фактической реализации конечной продукции. На стадии планирования принимается условие, что конечная продукция реализуется по среднерыночным ценам, на стадии фактической реализации — по контрактным ценам.
Предложенная методика оценки и расчета эффективности отдельных звеньев интегрированной структуры может быть использована для прогнозирования цены производителя и посредника, а также при распределении результатов деятельности интегрированной структуры. = The existing practice of realization of production and mutual relations of subjects on foreign markets shows the importance of separate forms of the integrated communications. Both for the manufacturer and for the intermediary the technology of promotion of the goods reducing cumulative costs to the consumer is important.
The author offers a method to calculate the efficiency of each part of a chain or structural divisions, irrespective of organizational registration of the integrated communications.
The definition on the export efficiency taking into account integrated communications is based on the distribution of export profit in proportion to the added value produced at every stage, which corresponds to the expense of actual and past labour at this stage.
Distribution can be effected both at the stage of planning when contract prices are not known, and at the actual realization of product. At the planning stage the condition is accepted, that the end product will be realized at average market prices, fixed and published by the international price agencies, at the stage of actual realization — for contract prices.
The suggested technique of the estimation and calculation of the efficiency of separate parts of the integrated structure can be used for forecasting the price of the manufacturer and the intermediary, and also at distribution of the results of operation of the integrated structure

Новикова классическими методами Виллиса и Оливье.The article is devoted to the 100th anniversary of the birth of Doctor of Technical Sciences, Professor M.L. Novikov, founder of circular-helical gearing system. The author, who personally knew M.L. Novikov, recalls his meetings with them, analyze the achievements and challenges in implementing of Novikov gears. Considered part in the development of M.L. Novikov gearing by leading Soviet scientists who continued to study after his death: A.I. Petrusevich, V.A. Gavrilenko, V.N. Kudryavtsev, R.V. Fedyakin
and V.A. Chesnokov, E.G. Roslivker, V.I. Korotkin and others. Also briefly discussed the possibility of forming M.L. Novikov gearing by classical methods Willis and Olivier. This proposal by G.G. Baranov – to form tooth profiles used in the Olivier method two incongruent curves with the inner point touch; proposal by Y.S. Davydov – used for the same purpose incongruent producing pairs. The author also shows that the cylindrical gear pair with a point mesh may be created of a single basic rack by Olivier (Camus) method
