No full textWorking Paper N° 22The author distinguishes metaphysical from practical communitarianism, and within the latter he sorts out three different varieties, viz value-, ethical, and techno-legal outlooks. Metaphysical communitarianism is alleged to involve a concealed ideological element, which leads its adherents to stereotypes when trying to capture the essence of the modem self. He goes on to examine possible foundations for the claim that minorities, or other ethnic and cultural groups have collective rights, either moral or legal in nature. Kymlicka' s attempt to vindicate collective rights on liberal Dworkinian foundations is shown to be inimical to the communitarian construal of such rights. Spector tries to uncover a diversity of flaws in the practical communitarian justifications of moral and legal collective rights, and claims that rights are essentially linked to the exercise of rationality, particularly of second-order evaluative capacities. In the end, practical communitarians' case for collective rights needs - he claims -, if it is to maintain the connection between rights and rationality, embracing meta-normative and normative relativism, whose application to political action is argued to yield consequences at odds with widespread ethical intuitions.Este Documento forma parte de la serie Working Papers (ISSN 0327-9588), publicada por la Universidad Torcuato Di Tella entre 1993 y 200

No full textEn un trabajo anterior he sostenido que el mejor argumento a favor del control judicial no es instrumental, sino procedimental, sobre la base de las ideas de derechos y poderes morales. En este trabajo voy a volver sólo sucintamente a mi argumento anterior, pues mi objetivo central es mostrar una nueva posibilidad institucional de establecer el control de constitucionalidad que, sorprendentemente, ha pasado inadvertida en los debates recientes. En efecto, voy a argumentar que un sistema híbrido o bimodal que mantenga el régimen de revisión judicial (concentrado o difuso, abstracto o concreto) existente contemporáneamente en una mayoría de países, pero que al mismo tiempo incluya un mecanismo democrático de control constitucional es preferible a un sistema judicial puro en el que control de constitucionalidad está exclusivamente en manos de un órgano no democrático
E-Spector: Online Energy Inspection for Android Applications
No full textEnergy consumption is one of the most important aspects of mobile apps. During energy testing, it is important for developers to understand not only the energy consumption rate of an app, but also why energy is consumed. However, existing energy testing tools are more concerned about the accuracy of energy estimation, while typically not providing explanations on why and how exactly energy has been consumed. This paper presents E-Spector, an online energy inspection method for Android apps, which can not only visualize the energy consumption of an app in an instant online manner, but also can tell what happened behind each energy hotspot on the energy curve. E-Spector relies on static analysis and app instrumentation to collect the activities from an app execution in real-time. Then it presents the activities on an instant energy curve, such that the user can easily tell what happened behind each energy spike. Experimental result shows that the energy estimation error of E-Spector is less than 10% and its overhead on energy consumption is about 4%.
