    The Italian Constitutional Court and the prophetic story. Some comments on decision no. 238/2014 Abstract: The article analyses decision no. 238/2014 and its impact not only on the hierarchy of legal sources, but also on the fundamental constitutional values founding the Italian legal system. After a summary of the content of decision – whereby foreign States’ immunity with reference to iure imperii acts cannot exclude the jurisdiction of Italian judges – the author focuses on the procedural techniques followed by the Constitutional Court to scrutinize an international customary rule and concludes with some final remarks in the light of the case-law of other constitutional and (non-constitutional) courts

    The text discusses the growing importance of the communication of constitutional and supreme courts with public opinion, and how new technologies are transforming this relationship. It highlights the need for an empirical analysis of court communication, due to the scarcity of norms regulating these activities. The author examines who, what, how and to whom courts communicate, and considers the influence of the normative and factual context in which they operate.     The 2014 Tunisian Constitution and the Global Constitutionalism. The article deals with the 2014 constitution of Tunisia, that has been deeply influenced by global standards. In the first part, the article deals with the category of “global constitutionalism”, defining it as the spread of the “constitutional state” worldwide, after the II WW. In the second part, it analyzes the Tunisian constitution, looking for the features that can be considered part of the “global constitutionalism” and for those that seem to express some specificities related to the local identity. It concludes maintaining that the constitutional identity of a country should be considered as a mix of both sides, global and local

    Sustainability and Constitutions: Constitutional Law and the Dilemma of the Future

    This article deals with the emerging concept of “sustainability”, that, according to the empirical research presented here, is mentioned in the text of 67 constitutions, very often in relation to the environment or with the rights of future generations. As the vast majority of those references consist in very general substantive provisions, needing legislative or judicial implementation, the article deals with the challenges brought by “aspirational constitutions” and with the role of the courts in their enforcement. Finally, I maintains that, in order to achieve the effectiveness, constitutions should include procedural provisions aimed at integrating sustainability instances (throughout specialized bodies) into the legislative process
