Le commissioni di ricorso nel sistema di giustizia dell'Unione europea
Le commissioni di ricorso nel diritto dell’Unione europea sono organi amministrativi, incaricati di risolvere controversie nei settori di competenza degli Uffici, Agenzie ed Autorità presso cui sono strutturate. Esercitano una sicura attività giustiziale, rafforzata dal carattere del loro intervento, che è pregiudiziale rispetto all’ordinaria tutela giurisdizionale. L’interesse per il tema è determinato anche dall’orientamento della giurisprudenza, esaminato nel volume. È invero prevalsa l’interpretazione della c.d. “continuità funzionale”, secondo cui le commissioni di ricorso svolgerebbero la stessa attività degli organi di prima istanza, accentuando gli aspetti amministrativi, a discapito di quelli propri del contenzioso. Il saggio, viceversa, tende a dimostrare che la fase innanzi alle commissioni di ricorso e quella innanzi al Giudice dell’Unione costituiscono un unico sistema integrato di tutela, in cui le commissioni di ricorso operano come un “tribunale”, ai sensi dell’art. 6 CEDU, ed anzi forniscono le garanzie del giusto processo, dato che consentono un sindacato completo sulle valutazioni tecniche complesse, operate dagli organi amministrativi. Rafforza tale interpretazione la recente riforma dell’art. 58 bis dello Statuto della Corte di giustizia, che ha ristretto a casi eccezionali il ricorso in ultima istanza alla Corte per le controversie già oggetto di un duplice controllo di legittimità sia innanzi a talune commissioni di ricorso, sia innanzi al Tribunale dell’Unione europea.The Boards of Appeal in European Union law are administrative bodies, responsible for resolving disputes in areas of competence of the Offices, Agencies and Authorities in which they are based. They carry out secure judicial activity, reinforced by the nature of their intervention, which is prejudicial to ordinary judicial protection. The interest in the topic is also determined by the orientation of the jurisprudence, examined in the volume. On the one hand, the thesis of the interpretation so-called “Functional continuity” has prevailed in the jurisprudence, according to which the Boards of Appeal would carry out the same activity as the bodies of first instance, accentuating the administrative aspects, to the detriment of those of the dispute. The paper, on the other hand, tends to demonstrate that the phase before the Boards of Appeal and that before the Judge of the Union constitute a single integrated system of protection, in which the Boards of Appeal operate as a "Court", according to art. 6 ECHR, and indeed they provide the guarantees of due process, since they allow a complete review of the complex technical assessments, made by the administrative bodies. The recent reform of art. 58a of the Statute of the Court of Justice, which limits the last resort appeal to the Court for disputes already subject to double legitimacy checks both before some Boards of Appeal and before the Court of the European Union to exceptional cases, reinforces this approach

Sodium induced morphological changes of carbon coated TiO2 anatase nanoparticles High performance materials for na ion batteries
The most promising candidate as an everyday alternative to lithium ion batteries LIBs are sodium ion batteries NIBs . This is not only due to Na abundance, but also because the main principles and cell structure are very similar to LIBs. Due to these benefits, NIBs are expected to be used in applications related to large scale energy storage systems and other applications not requiring top performance in terms of volumetric capacity. One important issue that has hindered the large scale application of NIBs is the anode material. Graphite and silicon, which have been widely applied as anodes in NIBs, do not show great performance. Hard carbons look very promising in terms of their abundance and low cost, but they tend to suffer from instability, in particular over the long term. In this work we explore a carbon coated TiO2 nanoparticle system that looks very promising in terms of stability, abundance, low cost, and most importantly that safety of the cell, since it does not suffer from potential sodium plating during cycling. Maintaining a nano size and consistent morphology of the active material is a crucial parameter for maintaining a well functioning cell upon cycling. In this work we applied Anomalous Small Angle X Ray Scattering ASAXS for the first time at the Ti K edge of TiO2 anatase nanoparticles on different cycled composite electrodes in order to have a complete morphological overview of the modifications induced by sodiation and desodiation. This work also demonstrates for the first time that the nanosize of the TiO2 is maintained upon cycling, which is in agreement with the electrochemical stabilit
Multilateral teaching in physical education improves resilience and self-efficacy in adolescents and could help reduce bullying behaviors
Youth with higher levels of resilience and self-efficacy are less likely to engage in aggressive behaviors or be victims of bullying. Previous anti-bullying approaches have often achieved no reduction in bullying behavior. Thus, the aim of this study was to examine the effect of 12 weeks of extracurricular multilateral teaching on the risk for students (aged 14–16 years) to be involved in bullying. Sixty male students were allocated to an experimental group (n = 30) that performed psychoeducational activities combined with physical exercise training and team games (90 min, 2d · week–1) or a control group (n = 30). Before and after the intervention, we used the Child and Youth Resilience Measure (CYRM-28) to assess individual capacities and resources, relationship with primary caregiver, contextual factors, and total resilience; and the Self-Efficacy Questionnaire for Children (SEQ-C) to measure academic, social, emotional, and total self-efficacy. Four participants from the experimental group withdrew. Significant improvements of crucial relevance were found for the resilience and self-efficacy scales (p < 0.05) in the experimental group. We found that multilateral teaching may improve resilience and self-efficacy in adolescents and make them less likely to engage in aggressive behavior or be bullied. Multilateral teaching should be considered an effective alternative to the anti-bullying approach, highlighting the crucial role of physical education teachers in the promotion of proactive educational strategies to reduce bullying behaviors
Effects of combined exercise training on work-related burnout symptoms and psychological stress in the helping professionals
This study aimed to evaluate the effects of eight-week Combined Exercise Training on burnout symptoms and perceived stress among workers in the helping professions. Forty-two men (46.3 ± 8.1 years) suffering from burnout were randomly allocated into an intervention (n = 21) or waitlist control (n = 21) group. The intervention group performed a combined circuit resistance training and agility training (60 min, 3d·wk-1) at a local fitness centre. At baseline and after the intervention, the Maslach Burnout Inventory and Perceived Stress Scale were administered. Results showed that the intervention group significantly reduced emotional exhaustion, depersonalization and perceived stress, and increased personal accomplishment (p < .001). The magnitude of the effects was large, revealing changes of crucial practical relevance. Adherence and satisfaction with the intervention were high. No significant changes were found in the control group. The findings support the evidence that Combined Exercise Training may reduce occupational burnout and psychological stress in the helping professions
The Tragedy of the Digital Commons
In the paper it is argued that bridging the digital divide may cause a new ethical and social dilemma. Using Hardin's Tragedy of the Commons, we show that an improper opening and enlargement of the digital environment (Infosphere) is likely to produce a Tragedy of the Digital Commons (TDC). In the course of the analysis, we explain why Adar and Huberman's previous use of Hardin's Tragedy to interpret certain recent phenomena in the Infosphere (especially peer-to-peer communication) may not be entirely satisfactory. We then seek to provide an improved version of the TDC that avoids the possible shortcomings of their model. Next, we analyse some problems encountered by the application of classical ethics in the resolution of the TDC. In the conclusion, we outline the kind of work that will be required to develop an ethical approach that may bridge the digital divide but avoid the TDC
