    The procedure for granting consent for ratification of the Council Decision 2020/2053 of 14th December 2020 on the System of Own Resources of the European Union in the light of the Constitution of Republic of Poland

    The author, after analysing the contents of the Council Decision 2020/2053 in the light of national, European and international law, states that the decision does not levy any new taxes on the member states and does not grant the Union any new powers. In her opinion, the decision includes only a temporary authorisation for the European Commission to take out loans. Therefore, the author believes the decision needs to be ratified pursuant to Article 89 para. 1 of the Constitution, i.e. it requires a prior consent granted in a statute. She rejects the opinion that the decision should be ratified pursuant to Article 90 of the Constitution

    The article is devoted to the process of creating European structures after 1990, and in particular the actions taken by the representatives of the Polish state. An effective process of bringing Poland closer to the European structures began with the actions that were aimed at establishing Poland’s membership in the Council of Europe; those actions, however, were also aimed at obtaining member status in other specialized organizations, such as: the Organization for Economic Co-operation and Development (OECD), the International Energy Agency (IEA), and the Nuclear Energy Agency (NEA). These accessions were followed with a crowning achievement of obtain ing a full member status in the NATO. Nevertheless, it was accession to the EU that required particular engagement from all environments, including both political and academic. The author, who was directly involved in those events, pays particular attention to the works and output of the Convention on the Future of Europe (the European Convention)

    Identification of Customary International Law in the Works of the United Nations International Law Commission

    The review of the ways in which customary norms were established and of the role that the custom played in the system of sources of the international law was undertaken by the International Law Committee in 2012, when the subject of "Formation and evidence of customary international law" was included in its agenda and started being discussed . The topic was approved, first by the Sixth Committee and then, by the whole General Assembly of the United Nations which opened the way to further codification . In 2013 the Commission appointed Sir Michael Wood as the Special Rapporteur. The Rapporteur then submitted his first report supplemented by the memorandum of the International Law Commission Secretariat and the title of the report was "Elements in the previous work of the International Law Commission that could be particularly relevant to the topic" . During further discussions the ILC changed the title of the codified issue, replacing the initial topic ("Formation and evidence of customary international law") with the following one, which better reflected the nature of the regulation: "Identification of customary international law". By doing so the Commission wanted to clarify doubts as to the meaning of the word "evidence", in particular when translated into official languages of the United Nations

    Artykuł poświęcony został procesowi budowy struktur europejskich po 1990 r., a w szczególności działaniom podejmowanym przez przedstawicieli państwa polskiego. Efektywny proces zbliżania Polski do struktur europejskich rozpoczął się od działań mających na celu włączenie Polski do Rady Europy, jednak podjęte działania obejmowały także członkostwo w różnych organizacjach wyspecjalizowanych takich jak: Organizacji Współpracy Gospodarczej i Rozwoju (OECD), Międzynarodowej Agencji Energetycznej (MAE), Nuclear Energy Agency (NEA). Swoistym zwieńczeniem dokonanych akcesji było uzyskanie pełnego członkostwa Polski w NATO. Jednak szczególnego zaangażowania realizowanego przez wszystkie środowiska, zarówno polityczne jaki naukowe wymagała procedura uzyskania członkostwa Polski w UE.     Beaucoup de nouvaux problèmes exigeant les solutions non seulement dans la pratique mais dans la théorie du droit international ont paru avec le développement des organisations internationales. Dans ce groupe participe sans doute la quesition de la représentation des états dans les organisations internationales. C’est une caractéristique des relations diplomatiques des états avec les organisations internationales et l’analyse du droit international y correspondant qui font l’objet de cet ouvrage. La caractéristique de la diplomatie des états dans les organisations in te rnationales a été effectués à base de traditionnelles relations diplomatiques entre les états dans la façon de saisir des analogies et démontrer les différences éventuelles entre ces 2 formes de la diplomatie. À la base de l’analyse des traités internationaux, du droit d’usage, des résolutions ponvenaMes des organisations et — dans une sphère indispensable — de la législature intérieure des états singuliers, on a fait la critique des sources du droit diplomatique des organisations internationales. Ensuite on a discuté les sujets du diroit diplomatique dans les rapports des états avec les organisations internationales indiquant en même temps les différences entre eux. La représentation des états dans les organisations peut prendre sait la forme constante (les missions permanentes, les missions permanentes des observateurs) soit la forme à temps (les délégations, les délégations des observateurs). Dans les chapitres suivants on a caractérisé les missions constantes des états et les délégations des états dans les organes de l'organisation et dans les conférences internationales. Puis l ’autrdce considère les problèmes liés avec l ’établissement et la structu re intérieure de la mission ou délégation. La décision sur la formation, composition et révocation de la mission et de la délégation en principe est à l’état expéditeur, le rôle de l’organisation in té rieu re ©st, en ce c-as insignifiant. Le chapitre suivant tra ite de droits et de services des représentants des états. Les autorisations détaillées et les services mentionnés ont, de même que les privilèges des représentants des états, -faciliter la réalisation des charges de la mission et de la délégation et perme ttre du fonctionnement convenable de l’o rganisation. La diplomatie multilatéral des états dans les organisations s ’est un phénomène nouvaiu dans la vie internationale. Le droit diplomatique dans les rapports des états avec les organisations internationales c’est aussi une nouvelle et caractéristique partie du droit diplomatique au sens large. Toutefois il reste dans une re lation étroite avec le droit des organisations internationales

    Cele i kierunki działalności każdej organizacji międzynarodowej są określone we wstępie lub w pierwszych artykułach jej statutu. Państwa wyjaśniają w nich powody utworzenia danej organizacji, obwieszczają w nich swój program i prezentują jej cele w bardzo ogólny sposób, posługując się przy tym językiem opisowym, bliższym raczej polityce niż prawu. Nie należy jednak uważać wstępu za czysto dekoracyjny element statutu, albowiem obok deklaracji politycznych zawiera on także ważne wskazówki interpretacyjne \ a to sprawia, że ustalenie intencji stron umowy wymaga odwołania się do jej wstępu. Sformułowane tam w sposób ogólny cele (np. preambuła do Karty NZ) są dla członków organizacji wskazówką postępowania, jednakże nie mają prawotwórczego charakteru, a zatem nie wywołują skutków prawnych w postaci przyznania praw lub nałożenia na państwa konkretnych zobowiązań. Akceptacja prawa każdej organizacji do zamieszczenia we wstępie informacji o celu jej utworzenia oraz o kształcie i charakterze jej polityki, zmusza jednak do poszukiwania konkretnych celów organizacji (lub celów jej polityki w określonej dziedzinie) nie we wstępie, ale w tej części umowy, która ma charakter prawotwórczy, czyli w przepisach nakładających na państwa obowiązek określonego zachowania lub postępowania (Fragment tekstu)

    The foundation of international organizations has created the need to employ in their offices qualified persons who, with the time passing, were called international civil servants. The legal status of international civil servants, their place in the organization and the role played towards member countries, is the subject of the present work. The origin of international civil servants goes back to the 19th c. administrative unions but it was only the League of Nations which accepted this situation. Its full development took place, however, in the latter part of the 20th c., in the period of the so-called organizational revolution. International law and sometimes also the domestic law of the states define the rules of employing civil servants in the organizations. They formulate both the conditions which the candidate for the civil servant must fulfil and the types of his connections with the organization (Chpt. II). International civil servants enjoy the rights and appropriate duties (Chpts. Ill and IV). Their content and scope is the result of, first of all, the internal regulations of the organization, sometimes enriched by the rules of the law of the host state. The rights and duties of civil servants are accompanied by the privileges and immunities — facilities necessary to perform their duties in the organization (Chpt. V). The activities of civil servants may lead to conflicts with organization authorities. To protect their interests civil servants may make use of either administrative procedure stipulated in the inner law of the organization or submit the existing controversy to the competent judicial agency, i. e. administrative tribunal (Chpt. VI). The work closes with considerations on the independence of international civil servants towards the countries they are citizens of (Chpt. VII). And although the rule of independence of civil servants is confirmed by the statutes of particular organizations, still the activities of some countries are threat for this independence
