Flipping the Deck: Transforming Ace Industrial Supply's Public Perception

    No full text
Our research indicated that Ace's sales model must be updated to remain relevant and compliant with current business practices. Ace's current sales model involves significant amounts of overhead, and Ace's policies do not promote their employees engaging in moral and ethical sales practices. To solve this issue, we have developed a system of KPIs and goals, along with an incentivization structure, which allows salespeople to maintain their current salaries if they are engaging in the ethical and sustainable sales practices. The Ace website must also be redesigned to be more use-friendly and allow other avenues of sales. Without these changes, Ace will have no way to repair their public image and continue to grow into the future. As a long-term plan, we have recommended that Ace build on this growth by creating a consolidated call list of leads, loyalty benefits for returning customers, text/email order verification and AI support in finding quality leads. For this project, I provided analysis of Ace's financial data and internal survey results, including organizing and formatting the data into a form that is understandable by the team. I completed a PESTEL analysis of Ace as well as the external threats and part of the internal weaknesses for the company. I spent significant time data mining and analyzing internal information using Ace's internal data analysis tool, and assisted my teammates in proofreading and improving the quality of writing of their sections, as well as brainstorming long term solutions for improving Ace and helping to create the overall layout of our paper. I spent between 6 and 10 hours a week on this course, similar to the remainder of my team, for weeks 1-5 of this course and spent 15-20 hours a week on it since

    No full text
[ABSTRACT ONLY; NO FULL TEXT] This report was produced, through group effort, as a consulting project for Tatum Games, a gaming analytics company within the software as a service industry. Tatum Games' participation in this consultation project stemmed from a willingness to receive analysis and insight into the strategy and implementation of their upcoming marketing campaign. The client provided a business plan, marketing plan, and sales and marketing growth initiative as well as some projections. The client also participated in several in-person interviews to inform the internal analysis. The secondary research was conducted using a myriad of resources such as IBISWorld, US Census Bureau, Business Source Premier, Statista and others. Market research was conducted using an original client survey along with interviews. Surveys were distributed through several channels including relevant game developer platforms. Both primary and secondary research sources were used to support our conjectures. For this project, I provided industry analysis for the bargaining power of buyers from Porters Five Forces. I also provided analysis for the political and legal factors affecting the industry in our PESTEL analysis. My contributions to primary marker research included hours of research and analysis of the industry, survey question formation and taking the lead in formatting our survey as well as an equal portion of its dissemination. I also handled the survey results analysis and summary. Additionally, I took on proofreading the external analysis and formatting of the original draft. I provided recommendations after identifying critical issues, and conducted research to support the necessity and implementation strategy of those recommendations. I assisted in proofreading the final draft. I also worked on creating visuals and formatting the final presentation for the project. Through our research and analysis, we identified critical issues, developed recommendations along with implementation strategies and presented our written report and all findings in a comprehensive presentation to our client

Fall of Last Safeguard in Global Dejudicialization: The Problem of Protecting Public Policy in Private Business Disputes

    No full text
52 pagesThe importance of courts is shrinking. This is largely due to global dejudicialization: the process of outsourcing disputes to private dispute resolution. In the last several decades, along with the triumph of neoliberalism, privatization of the resolution of disputes has become the gospel of modern judiciaries. Courts have been pushed to the tail end of the private adjudication process and are used only as the last resort. The courts’ warm embrace of this structure along with practitioners’ push has led to a staggering expansion of private dispute resolution. The world therefore has witnessed an unprecedented growth of arbitration—the primary mode of private dispute resolution

Tatum Games' Strategic Shift: From Analytics to Full-Service Solutions

[ABSTRACT ONLY; NO FULL TEXT] Our team, Vanguard Consulting, was tasked with performing an operational feasibility analysis of Tatum Games' soon-to-be-released marketing platform to determine attraction potential for growth. To complete this analysis, we conducted multiple interviews with the CEO; reviewed proprietary marketing plans; studied a detailed product description of the company's patented technology; performed primary research in the form of interviews and surveys; performed secondary research through academic databases like IBISWorld and Statista; and channeled everything we learned through strategic frameworks like SWOT, Porter's Five Forces, the 4Ps and Cs of Marketing, and PESTEL, to provide our final recommendations. Tatum Games' service is uniquely positioned in the niche, purpose-built gaming solutions industry, with a patent that enables its analytics platform to surface deep, rich insights on behalf of its target market-game developers. These insights will soon be leveraged to supercharge Tatum Games' upcoming marketing platform, a service that will pair independent game developers and small game studios with a mixture of social media agencies, digital publishers, and influencers. My written portions of the project included the internal analysis; the substitutes and supplier power sections of Porter's Five Forces; the 4Ps of marketing; our client recommendations; and our survey. To complete the internal analysis, I studied Tatum Games' product description document-an eight page overview of the company's motivation, proposed value proposition, business model, development timelines, patents, and technical specifications for its core product (MIKROS); examined the company's patent through the United States Patent and Trademark Office (USPTO); explored the company's web presence through its website and socials; conducted in person interviews with the CEO; and thoroughly vetted its marketing plan. For the substitutes portion of my Porter's Five Forces analysis, I utilized multiple academic databases (e.g. Statista, IBISWorld, Mintel) to understand game developers' potential use of mainstream advertising and analytics platforms (e.g. Google Ads, Facebook Ads, etc.); marketing agency business models; mobile game engine tools and their built-in analytics capabilities; and the funding and operational requirements to build in house analytics and marketing tools to address the independent game developer niche. For the supplier power portion of my Porter's Five Forces analysis, I leveraged the same academic databases to understand the degree to which Tatum Games' integral supplier industries held power over the pricing and contract terms of the gaming solutions industry. The Herfindahl-Hirschman Index (HHI), threat of forward integration, and switching costs, were all key considerations in arriving at my conclusions. For the marketing mix portion of my analysis, I utilized the 4Ps framework (i.e. Product, Price, Place, Promotion) to determine Tatum Games' approach in refining and iterating upon their product offerings, determining competitive pricing, identifying distribution channels, and crafting promotional strategies that effectively engage their target audience. Ultimately, through a comprehensive analysis of Tatum Games, their services, and the broader industry context, our team identified key challenges, developed targeted recommendations, and presented our findings to the client in a formal written report

[ABSTRACT ONLY; NO FULL TEXT] This was a report created as a consulting project for the California State University, Northridge public radio station, 88.5FM The SoCal Sound. The radio station was operated out of the Soraya, the university's on-campus premier performing arts venue, with a simulcast at Saddleback College in Mission Viejo. The goal was to provide consultation to The SoCal Sound and create recommendations for growth and financial feasibility. I worked to develop strategic recommendations through in-depth internal and external analysis with information provided to us by our client, such as financial statements, media kits, donor data, and organizational charts. The objective was to identify station's market position, operational efficiency, and revenue streams vi by using secondary data sources to analyze the radio station's opportunities and weaknesses. The analysis considered revenue streams, cost structures, funding opportunities, and potential financial risks associated with growth. My primary contribution involved creating an analysis of the client organization's internal functions, with a specific focus on operations, inventory management, human resources, and social media presence. I reviewed materials provided by the client to establish a foundational understanding of current practices in these areas, which was substantiated by secondary research. I identified key operational patterns and gaps, which informed my development of the internal SWOT analysis and shaped our strategic interpretation of the organization's internal environment. I contributed to the design of research tools and refined these tools with the help of our faculty advisors, ensuring alignment with our project goals. I collaborated with our client to distribute these tools to the client's stakeholders and later helped analyze the responses. For the external analysis, I helped write the introduction and contributed on the client's competitors in order to contextualize their position within its industry. Throughout the course of the project, I maintained transcripts and notes of meetings we had with our client and faculty advisors for our group to have access to records for past meetings. I supported the integration of faculty feedback, and assisted in editing and refining the final written report. I also helped identify the client's critical strategic issues and contributed to the development of actionable recommendations. I presented these findings to the client at the end of the semester and provided them with a written report

Contracting in the Age of Smart Contracts

    No full text
Smart contracts lie at the heart of blockchain technology. There are two principal problems, however, with existing smart contracts: first, the enforceability of smart contracts remains ambiguous. Second, smart contracts are limited in scope and capability barring more complex contracts from being executed via blockchain technology. Drawing from the existing literature on contracts and smart contracting, this Article suggests new approaches to address these two problems. First, it proposes a framework based on reliance-based contracting to analyze smart contracts. Second, the Article analyzes the seismic shifts in contractual disputes, and offers new insights into its features including decentralized decision-making, network-based dispute resolution, and extrajudicial enforcement of decisions. The Article concludes that users’ reliance should be the basis for analysis of smart contracts and its associated dispute resolution mechanism

Gaining Growth and Attraction along with Operational Feasibility - Qwench Juice

[ABSTRACT ONLY; NO FULL TEXT] The following report is produced as a consulting project for Qwench Juice Bar, a franchise in the Snack and Nonalcoholic Beverage Bars sector of the Food and Beverage industry. The juice bar targets health-conscious clientele as it offers a variety of freshly made and nutrient dense juices, smoothies, and Acai Bowls. Qwench Juice Bar also offers grain bowls, toasts, salads, and snacks. The business is looking to increase brand awareness, consumer interaction, and overall sales. Qwench Juice Bar is seeking recommendations on innovative marketing techniques, customer retention, and an ameliorated operational structure. Qwench Juice Bar has multiple locations and is well-established in cities with a high concentrated population. These cities have a strong presence of individuals that are health-conscious. The client provided data such as the financial statements for the past four years, franchise contract, social media impressions, online advertisement expenses, and partnership agreements. Public data from competing businesses such as campaigns, product features, and industry reports were also analyzed in order to present accurate claims and draw valid conclusions. Secondary data sources used in the analysis included Mintel and IBISWorld. Primary research was conducted by in-person surveys with customers. This was accomplished by asking customers questions regarding their experience, preferences, and feedback. Our research indicates that in order to maximize operational feasibility, Qwench Juice Bar needs a collaborative approach. While the sales are increasing year to year, the business is continually exhausting its financial resources. Qwench Juice Bar faces a significant competition in the market especially with competitors like Porto's Bakery and Starbucks present in the neighboring plaza that are able to offer similar products at lower prices. Especially with the rise of online ordering such as UberEats and Postmates, customers are less likely to stay loyal to a certain juice bar or cafe. This drastic change in consumer behavior leaves Qwench no other choice but to gain and retain customers through rigorous marketing tactics and efforts to ameliorate consumer experience. For this project, I completed an analysis of consumer behavior, market segmentation, bargaining power of suppliers and buyers through Porter's Five Forces, strengths, weaknesses, opportunities, and threats for the SWOT analysis, competitors and their offerings, analysis of financial statements, and analysis of social media insights. Additionally, I contributed to creating a practical survey with measurable results pertaining to customer behavior, experience, and satisfaction. I was present at the juice bar to survey customers and gain a deeper understanding of customer needs. I also contributed to creating the introduction and a concise conclusion. I was also available for other team members to generate ideas, find research, and analyze the findings. After identifying the critical issues the business was experiencing, I developed thorough, realistic, and action oriented recommendations and presented the written report and findings to the client. These recommendations included supply chain adjustments, as well as, product offering adjustments in order to increase the profit margin. Additionally, my recommendations included client centric approaches to elevate customer experience and ensure retention. I have spent at a minimum of 18 hours per week on research, analysis, and writing since the beginning of this course. Brand awareness, customer experience, and operational feasibility are composed of elements such as psychological and marketing tactics. Facing multiple challenges including but not limited to supply chain disruptions, inflation, tariffs on most products, inability to retain customers, inadequate social media presence, and a small profit margin, we formed recommendations to assist Qwench Juice Bar. With the growing population of health-conscious individuals and their willingness to spend extra on products that are organic and unprocessed, as well as with the right marketing and operational tactics, Qwench Juice Bar will be able to improve sales
