No full textDissertação (mestrado) - Universidade Federal de Santa Catarina, Centro de Ciencias JuridicasO trabalho pretende analisar o processo de aplicação dos princípios gerais do direito, especialmente no caso da prática jurisdicional da corte de justiça européia. Realiza-se uma análise teórica relativa aos princípios do direito, seguida de uma valoração empírica de sentenças consideradas paradigmáticas diante das teses até então desenvolvidas. A análise teórica procura descrever os princípios gerais como paradoxos constitutivos do sistema do direito. A partir de categorias trazidas da teoria da sociedade elaborada por Niklas Luhmanne Raffaele de Giorgi, aborda-se os conceitos de paradoxo, de auto-observação e de unidade, fechamento e abertura do sistema jurídico. Uma análise do funcionamento do ordenamento jurídico da comunidade européia permite que tais dados sejam observados, através de uma exame de algumas sentenças da corte européia de justiça
