Discontinuous system of allowances: the response of prosocial health-care professionals
This paper examines the unintended strategic effects of non-linear incentives in public policies. A system of health care subsidies structured into discrete intervals may lead to strategic behaviour. We provide new evidence on this issue, focusing on a case where strategic actions are taken by healthcare providers (HCPs). We show that HCPs adjust the score of claimants in long-term care needs assessments, allowing claimants to access higher levels of care benefits. This adjustment does not bring any pecuniary gain for HCPs. In a quasi-natural experimental setting –the implementation of Spanish long-term care (LTC)– we show that the distribution of the claimants' needs includes kinks around the thresholds set for the LTC system. These kinks reveal that healthcare providers adopt prosocial behaviour, helping claimants jump to a higher level of benefits without discriminating by health status, residence, or gender. By developing a new non-parametric estimator, we prove that these adjustments increase the public LTC spending, which is equivalent to moving thresholds to the left. The additional cost per adjusted claimant per annum is approximately 1000 euro on average. Finally, we also explore empirically whether the number of thresholds could affect such behaviour, by exploiting a reform that eliminated some thresholds. We find that the lower number of thresholds is associated with an increase of adjustment around the thresholds that remain
Effects of long-term care benefits on healthcare utilization in Catalonia
This paper estimates effects of long-term care (LTC) benefits on utilization of primary and sec-ondary healthcare in Catalonia (Spain). Identification comes from plausibly exogenous variation in the leniency of LTC needs assessment. We estimate that receiving LTC benefits worth 365 euros per month, on average, reduces the probability of avoidable hospital admissions by 66%, and has no significant effect on planned hospitalisations nor on hospitalisation for any reason. Receiving LTC benefits is estimated to reduce unscheduled primary care visits by 44% and has no signifi-cant effect on scheduled visits. These findings have important policy implications suggesting that allocating resources to LTC may not only increase the welfare of LTC beneficiaries but also reduce avoidable and unscheduled utilisation of healthcare

Aquest projecte es basa en la creació d'un pla de comunicació per a Tendals Gabriel, una petita empresa del Bages especialitzada en sistemes de protecció solar. A partir de l'anàlisi de la pròpia empresa i el seu entorn, s'ha dut a terme una proposta estratègica que dóna resposta als problemes de comunicació detectats i que culmina amb el plantejament d'un pla d'accions.Este proyecto se basa en la creación de un plan de comunicación para Tendals Gabriel, una pequeña empresa del Bages especializada en sistemas de protección solar. A partir del análisis de la propia empresa y su entorno, se ha elaborado una propuesta estratégica que da respuesta a los problemas de comunicación detectados y que culmina con el planteamiento de un plan de acciones.This project is based on the creation of a communication plan for Tendals Gabriel, a small company from Bagesspecialized in solar protection systems. Moving from a textual and documentary analysis, as well as a material-philological perspective, the lectura proposes a later date for the composition (late 13th-early 14th century); moreover, a possible identification of the author with the cardinal Guillem de Peire Godin (1260-1336) is cautiously suggested

Innovation and insolvency : the treatment of IP licenses in restructuring procedures

While debtor-friendly regimes are often praised for providing a ‘fresh start’ for insolvent entrepreneurs (thereby lowering the costs of financial failure and encouraging high-risk, high-reward ventures), much of the research has concentrated on debtor protections and the general body of creditors’ recovery, neglecting the importance of individual non-insolvent third parties, such as licensees, for innovation. In this regard, national insolvency frameworks rarely address intellectual property (‘IP’) licenses and typically default to general executory contract rules per inertia, with only a few jurisdictions adopting specific legislation on their treatment. The present work seeks to address this gap, arguing that, in today’s knowledge-based economy, maintaining ongoing access to knowledge (licensed IP rights) can be as crucial as securing the initial capital for innovation. Many actors depend on the continued availability of licensed rights as a fundamental component of their business models; yet, their interests are frequently neglected in favour of financial restructuring and fresh-start policies. Moreover, the global proliferation of IP licensing, combined with complex interdependencies, exacerbates the regulatory gap, potentially stifling innovation and prompting questions as to whether special insolvency legislation is necessary. Employing a comparative law and economics perspective grounded in new institutional economics, this study examines how different national restructuring regimes influence economic outcomes, shape parties’ strategic behaviours, and might impact innovation ecosystems. It identifies the strategic hold-ups and moral hazards’ issues arising ex-ante and ex-post, emphasising the limitations inherent in private ordering unless substantial and often impractical investment safeguards are made. The research concludes that regulatory inertia poses significant risks to innovation and acknowledges the lack of an optimal national legislative model. In parallel, the findings suggest that those jurisdictions with special provisions governing termination are better equipped to mitigate the most critical risks. El impacto de la calificación en el tratamiento de las licencias sobre propiedad intelectual e industrial en los procedimientos de insolvencia europeos
Published in print: November 2024Este artículo examina el tratamiento de las licencias de derechos de propiedad intelectual e industrial (PII) en los procedimientos de insolvencia europeos desde una perspectiva conflictual, destacando las diferencias y desafíos que emergen de los distintos ordenamientos jurídicos nacionales. A partir del carácter exclusivo o no de la licencia, se analiza la operatividad del Reglamento Europeo de Insolvencia y se pone de manifiesto cómo su configuración provoca una triple fragmentación en el tratamiento de estos contratos dependiendo de los derechos de PII sobre los que se funde. El estudio concluye reflexionando sobre los retos que plantea el proyecto de armonización sustantiva en materia de insolvencia.This study examines the treatment of intellectual property licenses in European cross– border insolvencies from a conflicts of law perspective, highlighting the differences and challenges arising from the heterogeneous legal frameworks. Based on the exclusivity nature of the license, the study analyses the operationality of the European Insolvency Regulation and reveals how its configuration leads to a tripartite fragmentation in the treatment of these contracts, depending on the types of IP rights involved. The study concludes by reflecting on the challenges posed by the European substantive harmonisation project in insolvency matters
