It starts with an analysis of the complex relations, in order to describe the distribution of management powers in those systems which adopt community of property and in those which use separation of property. In the 70th scholars observed a partial convergence of these two models: actually, systems of community of property have increased margins to free disposal of assets, while those of separation tend to a final distribution.     ANDREA FUSARO, The expansion of private autonomy in succession law in the recent legislative interventions of Franch and Italian, in Contr. Impr. Europa, 2009, fasc.1, pp.427-464 *** The essay compares the Italian and French frameworks of inheritance law in the light of the latest amendments, showing how the lawmakers have reacted in similar way, even if not coincident. A clear convergence comes out, without any doubts, in relation with, on one side, the scaling down of reducing action; and on the other side, to the favour of the exspansion of freedom of will in the succession area. In 2006 in France an important reform has been promulgated, which has maintained the legitimate portion, but widening the renouncement ways. In Italy it has recently flourished the debate about the legitimate portion, exploring advantages and disadvantages of fixed quotes, up to advance the proposal of abolishing it and adopting the English model. It is possible to object, in connection with this idea, that the Italian judge is used to practise less discretionary powers than the English one. Therefore the essay assumes that it would preferable to follow the example of the French reform. Europa, 2009, fasc.1, pp.427-464 *** Il saggio mette a confronto gli impianti del diritto successorio francese ed italiano alla luce delle recenti riforme, evidenziando come i legislatori abbiano reagito in maniera simile, ancorché non coincidente Emerge senz'altro una chiara convergenza in relazione, da un lato, al ridimensionamento della portata recuperatoria dell'azione di riduzione; dall'altro, in dipendenza del favore verso l'espansione dell'autonomia privata nel comparto successorio, insito nelle previsioni dei patti di famiglia. In Francia nel 2006 è stata adottata un'importante riforma, che ha mantenuto la legittima, ma ne ha ampliato i margini di rinunciabilità; anche in Italia è recentemente fiorito il dibattito circa la riserva, nel cui ambito sono stati soppesati vantaggi ed inconvenienti della legittima per quota fissa, fino ad avanzare l'ipotesi di abolirla adottando il modello inglese. A questa proposta si può, però, obiettare che il giudice italiano è meno abituato (rispetto a quello inglese) ad esercitare tanta discrezionalità. Vienna 16 – 20 September 2008), Jan Sramek Verlag KG (Vienna), 2009, pp. 751 - 760 *** The essay analyzes the different forms of protection offered to the deceased's surviving spouse and children in European legal systems. No system actually recognizes unlimited testamentary freedom: civil law tradition protects spouses and children by garanting them the legitimate portion; on the contrary, English law allow the judge the power to allot what he conseders appropriate. The juxtaposition of the two models is clear: the civil law legal systems adopt the legitimate portion (with differences regarding both the rules and the range of beneficiaries), English law recognizes the judicial discretion. In Italy, actually, the legitimate portion is criticised on the basis of different ground and some scholars went far as to argue that the present regime could be unconstitutional. There is, therefore, important recent changes developed between 2001 and 2006. France has, in fact, adopted reforms which introduced many changes: the legitimate portion has been retained, with some limitation. Finally, the legitimate portion should be replaced with a cash value, in order not to hinder or restrict the alienability of immovable disposed by will or gift. Emerge, innanzitutto, come nessun ordinamento riconosca un'illimitata libertà di testare: i sistemi di civil law attribuiscono a determinate categorie di eredi una quota legittima; nel Regno Unito, invece, l'attribuzione di diritti sull'eredità è lasciata alla valutazione del giudice. E' chiara, dunque, la contrapposizione di due modelli: quello di civil law si affida alla quota fissa, ancorché con modalità parzialmente differenti da un ordinamento all'altro; quello inglese conferisce una maggiore discrezionalità al giudice. In Italia la quota legittima è, oggi, al centro di un vivace dibattito, ed alcuni ne hanno sostenuto l'incostituzionalità. Risultano, quindi, importanti le recenti modifiche approntate dalla Francia tra il 2001 ed il 2006 con alcune riforme che hanno mantenuto la legittima, pur limitandone la portata.     Avatar's ethnicity and gender modulate behavioral and physiological reactions to vicarious touch in immersive virtual reality

    The subjective experience of being touched can be drastically affected not only by bottom-up variables (e.g. stimulus intensity) but also by top-down variables (e.g. toucher’s social characteristics1). Nevertheless, the neuroscientific investigation regarding the role of these higher-order factors is limited by ethical and practical constraints. Using Immersive Virtual Reality (IVR) we explored the subjective and physiological reactivity of healthy participants who wore a virtual body and observed an avatar caressing different part of it showing that it was possible to induce vicarious feelings of touch2. Here we expand previous knowledge by investigating the possible influence of gender and ethnicity of the touching avatar in modulating the experience of vicarious touch. We used IVR to substitute the participants’ real body with a virtual one. We collected behavioral (ratings about touch appropriateness, pleasantness, disgust, erogeneity) and physiological (skin conductance responses, heart rate) responses while Caucasian heterosexual men observed touches delivered on different parts of their virtual body by male or female Caucasian and African avatars. Bayesian parameter estimation showed that touches delivered by the female avatar were rated as more appropriate, pleasant and erogenous, and less disgusting compared to the male ones. These effects were further modulated by the touching avatar’s ethnicity: touches delivered on intimate areas were judged as more appropriate and more erogenous when performed by the female ingroup compared to the female outgroup avatar, and they were rated as less disgusting when delivered by the ingroup male compared to the outgroup male avatar. At the physiological level, the outgroup male touches elicited higher reactivity compared to the ingroup male touches, in particular when delivered on the intimate and social areas. No effect on the heart rate signals was found. Taken together, our results confirm that heterosexual men tend to avoid same-gender touch2; this effect seems to be enhanced by the toucher’s outgroup membership, suggesting a multi-layered stigmatization process. Future neuroimaging studies could shed light on the role of cognitive, affective and somatosensory components in shaping the outgroup and same-gender touch avoidance. Moreover, under the intergroup contact hypothesis, future studies could investigate whether positive virtual tactile interactions with outgroup avatars could reduce negative attitudes toward them, so that virtual touch may act as an important precursor to real intergroup touch.     "Attempt to identify the distinctive characters of the historical fabrics of the Islamic city in their current configuration, as a result of the permanence of methods and forms, and as a result of different stratifications and historical phases." This is the incipit by which Florindo Fusaro breaks into the literature on the Islamic city as a careful investigator of urban phenome-nology and of the anthropo-cultural dimension of architecture. Referring to the Chatremerre de Quincy semantic opposition between “type” and “model”, Fusaro high-lights how the city cannot be reduced to "an abstract model or scheme". Largely inspired by Quaroni's organicist vision but also by Muratori's territorial one, this work struggles between the impulse to classify the forms of the built environment to unmask the common roots of Islam and the need to narrate places in order to identify spe-cific local values. Fusaro focuses his reflection on the paradigm of the opposition and balance of oppo-sites in Islamic culture and architecture. The entire narrative path thus moves, alternately investigating the Islamic dualism of being a sedentary community and, at the same time, a nomadic one. On the opposition between the strong condition of closure, darkness and density of urban living, and the maximum openness, luminosity and extension of living in the horizontal and undefined landscape of the desert. On the conquest of a growing or-der, in the passage from the chaotic and wild world of the open space of the landscape to the controlled and domesticated world arranged within the urban walls, or again, from the organic world of the urban dimension to the intimate and geometric world of its sa-cred and domestic spaces. On the symmetry of opposites that he discovers in the tension between Muslim and non-Muslim districts of a city, between the vital and commercial dimension of urban places and the intimate and spiritual dimension of its buildings, be-tween the democratic use of public places and the sectorial use of private ones, very dif-ferent formal impulses but identically inescapable. On the contrast between the organic structure of Islamic settlements and the radiocentric dimension of the territory of Dar al-Islam. In this intricate maze of contrasts, Fusaro tries to explain the complex link between the city and the Islamic faith. Here, the Koran and the Sunna, seen not as absolute rules and measures but as precepts subject to human interpretation, show a way of being a community that is declined in the specificity of places but is, at the same time, common to the whole of Islam, making the inviolability of the principles of faith overriding with re-spect to the unmodifiability of forms
