    Diritto penale, vittimizzazione e “protagonismo” della vittima

    The notion of a « victim » of crime is unknown in both the Italian Criminal Law and Criminal Procedure Law, with the exception of the transposed provisions of the Community acts into our national legislation and those regarding the creation of “solidarity funds” (for example, the funds to assist the victims of terrorism, of mafia, or road accidents). However, a definition is present in Article 2 of the EU Directive 2012/29/UE of the European Parliament and of the Council of 25th October 2012 establishing minimum standards on the rights, support and protection of victims of crime, and replacing the Council Framework Decision 2001/220/JHA. In place of the term “victim”, our legal system uses the traditional figure of a “person damaged as the result of crime” (Article 185 of the Penal law), who joins the proceedings as a private party to claim damages (Article 74 of the Criminal Procedure Law), the figure of the “injured party” and the associations representing the interests offended by the crime (Article 91 of the Criminal Procedure Law). The irruption of the victim into the criminal trial beyond the confines of our legal traditions produces an explosive effect. Indeed, these confines are already very large with regard to the experience of some foreign countries where often extra procedural methods of victim-offender mediation are provided

Il Professor Maiwald ha rappresentato, durante il lungo periodo della sua instancabile attività di ricerca, un ponte fondamentale tra la scienza penalistica tedesca e quella italiana a partire dall’ultimo scorcio del XX, in un momento di grande slancio degli studi comparatistici. I contributi vogliono essere un omaggio reso da coloro che, tra i penalisti italiani, hanno potuto usufruire del privilegio di dialogare e collaborare con lui sia nella Facoltà giuridica dell’Università di Göttingen, sia nelle proprie sedi, per ringraziarlo di essere stato un essenziale punto di riferimento nel fruttuoso scambio fra le due culture.It's a collection of essays by Italian scholars who've been friends and worked with Professor Manfred Maiwald, emeritus professor of criminal law at the prestigious University of Göttingen, for a long time. It's dedicated to him on his 90th birthday, which was on 11 March 2025. During his long period of tireless research, Professor Maiwald has been a fundamental bridge between German and Italian criminal law since the end of the 20th century, at a time of great momentum in comparative studies. The contributions are intended as a tribute from those Italian criminal law experts who have had the privilege of dialoguing and collaborating with him both at the Faculty of Law of the University of Göttingen and in their own institutions, to thank him for having been an essential point of reference in the fruitful exchange between the two cultures

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed.     “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.
