The role of lawyers in the interaction: the influence of alternative dispute resolution (ADR) practice on legal education and thought

This translation was carried out within the framework of research funded by the Spanish Ministry of Science and Innovation through the National R&D&I Plan 2008-2011." -- This article is inspired by a key provision of the new European directive on mediation: the obligation of Member States to promote the training of mediators. This training, which implies a review of legal education, may prove necessary for the future of legal thinking. Drawing on Deleuze and Derrida, as well as Rawls and Habermas, Professor Fleerackers argues against rationalized views of law as communication and proposes an interactive, case-oriented, and interdisciplinary (ICI) approach to overcome the decline of liberal legal thought. The author shares Derrida's perspective, whom he considers a fellow traveler, and addresses the affective/effective aspects of law in order to update legal discourse for a world of difference that demands a dynamic concept of security and legal certainty. In essence, legal theory is legal practice. And legal practice, in all its forms, is case-oriented, seeking to achieve effective coexistence within a multicultural, multi-moral, and multi-individual society still burdened by rationalization. In light of the failure of natural law and legal positivism, as well as communitarianism and liberalism, many have abandoned the bastions of morality or rationality that underlie the legal field. Although not all cases are difficult, these are certainly of crucial interest to any philosopher or legal theorist. If it is true that morality or rationality can still maintain legal efficacy and effectiveness in most easy cases, then these are less important, given the enormous difficulties societies encounter when legal norms can only be upheld by force or violence. Epitomized as the conscious acceptance by a minority of a decision made by a majority, or as the legal conscience of a condemned party in relation to a judge's decision applying the law, legal effectiveness has consequently shed its traditional guise, and the structures that once underpinned it have been dramatically blurred. Therefore, the survival of legal pragmatism as an effective instrument for maintaining a society's communal aspirations depends primarily on the lawyer's attitude. Well-trained lawyers make social interaction possible in order to uncover differences, as well as truths born from interaction, that are in fact shared by all parties to a conflict. As such, legal education is unequivocally at the heart of legal theory and practice. The need for a shift in legal thinking, still rooted in 19th-century thought, to adapt it to contemporary globalization depends above all on how legal education is reformed in the coming years. In conclusion, Professor Fleerackers argues for a legal education that teaches lawyers to master interactive processes and transform these into frameworks for social cohesion, thereby preserving the persuasive power of legal discourse from within, through an interactive, case-oriented, and interdisciplinary (ICI) approach to law.Fil: Fleerackers, Frank. El autor comparte la perspectiva de Derrida, a quien toma como compañero de ruta, y aborda los aspectos afectivos/efectivos del derecho con el fin de actualizar el discurso jurídico para un mundo de diferencia que exige un concepto dinámico de seguridad y certeza jurídica. En esencia, la teoría jurídica es práctica jurídica. Y la jurídica, en todas sus formas, es una práctica orientada al caso, que procura lograr la cohabitación efectiva dentro de una sociedad multicultural, multi-moral y multi-individual lastrada aún por la racionalización. En vista del fracaso del iusnaturalismo y del positivismo jurídico, así como del comunitarismo y del liberalismo, muchos han abandonado los bastiones de la moralidad o de la racionalidad que subyacen al campo jurídico. Aunque no todos los casos son difíciles, éstos seguramente revisten un interés crucial para cualquier filósofo o teórico del derecho. Si es cierto que la moralidad o la racionalidad pueden mantener aún la eficacia y efectividad jurídica en la mayoría de los casos fáciles, entonces éstos son menos importantes, dadas las enormes dificultades que encuentran las sociedades cuando las normas jurídicas no pueden ser mantenidas sino por la fuerza o la violencia. Epitomizada como la aceptación consciente por una minoría de una decisión tomada por una mayoría, o como la conciencia jurídica de una parte condenada en relación con la decisión de un juez que aplica el derecho, la efectividad jurídica ha mudado en consecuencia su piel tradicional, y las estructuras que antes le subyacían se han difuminado dramáticamente. Por tanto, la supervivencia del pragmatismo jurídico como un instrumento efectivo para mantener las aspiraciones comunitarias de una sociedad depende principalmente de la actitud del abogado. Los abogados bien entrenados hacen posible la interacción social para descubrir diferencias, así como verdades nacidas de la interacción, que sean de hecho compartidas por todas las partes de un conflicto. Como tal, la educación jurídica se encuentra inequívocamente en el centro de la teoría y la práctica jurídicas. La necesidad de un cambio en el pensamiento jurídico, anclado todavía en el pensamiento decimonónico, a fin de adaptarlo a la globalización contemporánea, depende sobre todo de la manera en que la educación jurídica sea reformada en los años venideros. Para concluir, el Prof. Fleerackers argumenta a favor de una educación jurídica que enseñe a los abogados a dominar los procesos interactivos y convierta éstos en marcos de cohesión social, y conserva así la capacidad de convicción del discurso jurídico, desde dentro, mediante una actitud jurídica interactiva, orientada al caso e interdisciplinar (ICI)
"My doctor self and my human self": A qualitative study of physicians' presentation of self on social media

However, this separation is difficult and even undesirable, as the blurring of personal and professional online presence can influence patient trust. Thus, to develop policies and educational resources that are more responsive to the blurring of personal and professional boundaries on social media, this study aims to provide an understanding of how physicians present themselves holistically online. Methods. 28 physicians based in the United States that use social media were interviewed. Participants were asked to describe how and why they use social media, specifically Twitter (rebranded as “X” in July 2023), which is especially popular among physicians. Interviews were complimented by data from participants’ Twitter profiles. Data were analyzed using reflexive thematic analysis guided by Goffman’s theory of presentation of self. This theory uses the metaphor of a stage to characterize how individuals attempt to control the aspects of the identities—or faces—they display during social interactions. Results. We identified seven faces presented by the participants. Participants crafted and maintained these faces through discursive choices in their tweets and profiles, which were motivated by their perceived audience. We identified overlaps and tensions that arise at the intersections of faces, which posed professional and personal challenges for participants. Conclusions. Physicians strategically emphasize their more professional or personal faces according to their objectives and motivations in different communicative situations, and tailor their language and content to better reach their target audiences. While tensions arise in between these faces, physicians still prefer to project a rounded, integral image of themselves on social media. This suggests a need to reconsider social media policies and related educational initiatives to better align with the realities of these digital environments.info:eu-repo/semantics/publishedVersionFil: Maggio, Lauren. Spatially-localized time dependent solutions including turbulence and their interactions in 2D Kolmogorov flow
In 2D Kolmogorov flow in small aspect ratio domains, spatially-localized solutions such as kink, traveling or time-dependent kink-antikink pars coexist. However, the conservation of the flow rate in the y direction strongly restrict combination of localized solutions and their positioning. We find that by adding a homogeneous flow U y their positioning is controlled and each of localized solutions including a spatially-localized chaos is isolated. Numerical results suggest that these isolated solutions can be elements constructing a whole flow
Characteristics of overlap region in high-Reynolds number turbulent channel flow
Direct numerical simulation of the fully developed turbulent channel flows have been carried out at the Reynolds number based on the friction velocity and the channel half width, 2000, 4000 and 8000. A hybrid 10th order accurate finite difference scheme in the stream and spanwise directions, and a second-order scheme in the wall-normal direction is adapted as the spatial discretization method. We observed the plateau profiles in the indicator function corresponded to the von Karman constant. Furthermore, second peak of streamwise pre-multiplied spectra were appeared in the same wall normal height, 300 < y+ < 600, in case of Re = 4000. Nevertheless, the effects of the lager than the channel half height scale on the streamwise turbulent intensity are fixed contributions without dependence on Reynolds number. These results suggested that the new streamwise vortexes are formed between buffer layer and outer layer with increasing of Reynolds number
La 'circunstancia' de 'Herederos y Pretendientes
In June 2010, the Ortega y Gasset Foundation hosted a Conference about the “Spanish Philosophical Transition” in order to debate the book of Francisco Vázquez, La filosofía española. Herederos y Pretendientes. Una lectura sociológica (1963-1990), recently published. This paper is the author’s response to criticism raised in the Conference and to published reviews received by this book. First, the author summarized the argument of Herederos y pretendientes. Secondly he responds and takes into account the most important objections against the book’s hypothesis and methodology. Finally the author evaluates the favorable judgments received by the book and suggests the limits of the historian’s task.Fundación Ortega y Gasset-Marañó
Author self-citation in orthodontics is associated with author origin and gender.
BACKGROUND
The aims of this bibliometric study were to determine author self-citation trends in high-impact orthodontic literature and to investigate possible association between self-citation and publication characteristics.
METHODS
Six orthodontic journals with the highest impact factor as ranked by 2017 Journal Citation Reports were screened for a full publication year (2018) for original research articles, reviews, and case reports. Eligible articles were scrutinized for article and author characteristics and citation metrics. Univariable and multivariable negative binomial regression was used to examine associations between self-citation incidence and publication characteristics.
RESULTS
Medians for author self-citation rate of the most self-citing authors and self-citations were 3.03% (range 0-50) and 1 (range 0-19), respectively. In the univariable analysis, there was no association between self-citation counts and study type (P = 0.41), article topic (P = 0.61), number of authors (P = 0.62), and rank of authors (P = 0.56). Author origin (P = 0.001), gender (P = 0.001) and journal (P = 0.05) were associated with self-citation counts and in the multivariable analysis only origin and gender remained strong self-citation predictors. Asian authors and females self-cited significantly less often than all other regions and male authors.
CONCLUSIONS
Authors in orthodontics do not self-cite at a frequency that suggests potential citation manipulation. Author origin and gender were the only variables associated with citations counts. More bibliometric research is necessary to draw solid conclusions about author self-citation trends in orthodontic literature
Overview of the Author Profiling Task at PAN 2013
[EN] This overview presents the framework and results for the Author Profiling
task at PAN 2013. We describe in detail the corpus and its characteristics,
and the evaluation framework we used to measure the participants performance to
solve the problem of identifying age and gender from anonymous texts. Finally,
the approaches of the 21 participants and their results are described.The author profiling task @PAN-2013 was an activity of the WIQ-EI IRSES project (Grant No. 269180) within the FP 7 Marie Curie People Framework of the European Commission.
