    The letters that Gény wrote to Saleilles between 1892 and 1912 are a precious treasure, an inexhaustible mine of ideas, suggestions, confirmations. They betray the sensivity, the fragilities, the torments of the man, before the substance and the technical style of the lawyer. Gény and Saleilles are first of all human beings, overwhelmed by facts and things, inclined to the emotions; they are lawyers immersed in the reality of their age, with their views planted in the material of the economic and social facts. Thanks to his perspective, based on the rediscovered centrality of society and economy, Gény outlined a social and dynamic conception of law; suggested a system of the sources of law much more rich, complex and articulate than the monistic one supported by the legalistic culture introduced by the Napoleonic Code; believed in an antiformalistic conception of law, built around the creative power of the interpreter; redefined the topics and the contents of the private law, which were not anymore – or at least not only – the ones of the Napoleonic Code, but the ones typical of an industrial society

    Nel 1807 la Francia di Napoleone raccoglieva nel primo Codice di commercio della storia i motivi salienti della cultura giuridica del tempo, e più specificamente quegli aspetti che, emersi nel decennio rivoluzionario, erano usciti indenni dalla “restaurazione” d’inizio secolo: eguaglianza giuridica formale, unicità del soggetto di diritto, prospettiva individualistica, egemonia del diritto di proprietà. Nel corso del XIX secolo la cultura giuridica avrebbe cercato di rielaborare gli schemi ordinanti della codificazione napoleonica, ricalcandone però nel complesso le linee ideologiche e l’impianto concettuale. Diritto ed economia viaggiavano a doppia velocità: sullo sfondo di un’Europa avviata all’industrializzazione, la cultura giuridica faticava, arroccata intorno ai canoni dell’individualismo proprietario, a superare un diritto che era stato progettato agli inizi del secolo per un’economia agraria e mercantile, cucito addosso ai “tipi” individuali del proprietario fondiario e del commerciante. Dalla fine del secolo il ritorno dei fatti economici e sociali al centro dell’attenzione del giurista avrebbe rinnovato anche le prospettive della scienza gius-commercialistica, favorendo l’avvio di una riflessione sul momento della produzione industriale e sul ruolo delle strutture economico-giuridiche caratterizzate dalla multifunzionalità degli atti, dalla complessità della macchina organizzativa, dalla latitudine dell’attività commerciale. Con il nuovo Codice di commercio tedesco (HGB) del 1900 si delineava un nuovo fulcro dell’esercizio commerciale, che non era né il commerciante né i singoli atti di commercio, bensì il complesso dei beni, dei valori e delle persone funzionalmente organizzati per l’esercizio dell’attività commerciale. Iniziava, per il diritto commerciale europeo, una nuova fase, alimentata dalla riflessione scientifica della dottrina austro-tedesca, che s’irradiava in Italia, Spagna e Francia con accenti e ritmi diversi, conformemente alle peculiarità di ciascuna cultura giuridica nazionale. L’ideologia corporativa dei regimi totalitari, testimoniata ad esempio dalla Carta del Lavoro fascista (1927) e dal Fuero del Trabajo franchista (1938), avrebbe contribuito allo sviluppo di un sistema imperniato sull’impresa, intrecciandosi con le suggestioni tecniche di giuristi come Mossa, Garrigues e Riperts

    In 1916, during the First World War, Vittorio Scialoja advanced the idea of a project of a Code of Obligations for France and Italy. The idea was warmly accepted by Larnaude, the dean of the Law Faculty of Paris. Scialoja and Larnaude wanted to relaunch a law of obligations on the individualistic foundations of Roman law, but important solidarity temperaments emerge in the project.     Il saggio tematizza il progetto italo-francese delle obbligazioni del 1927 nel contesto della costruzione della concezione corporativa, sotto lo specifico profilo del contratto di lavoro. Il progetto segue di un anno la legge sindacale del 1926 fondata sull'annuncio del corporativismo. Il primo paragrafo delinea vicinanze e distanze tra Italia e Francia nella legislazione lavoristica in tema di contratto di lavoro individuale e collettivo. Nei successivi paragrafi vengono affrontati i nodi concettuali intorno al contratto di lavoro tra locazione e impresa. La concezione comunitaria dell'impresa si collega direttamente al corporativismo nella logica del produttivismo. Nel contesto italiano la dimensione giuslavoristica è sempre più attratta nel corporativismo attraverso il filtro costituito dal concetto di impresa. Emerge dunque un chiaro distacco rispetto all'impianto del progetto del 1927 fondato su una contrattualità introduttiva rispetto alla legislazione sociale

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

    “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.     Dispelling the Myths Behind First-author Citation Counts

    We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods
