SEGURANÇA JURÍDICA NA JURISDIÇÃO CONTENCIOSA DA CORTE INTERAMERICANA DE DIREITOS HUMANOS ATRAVÉS DA SINALIZAÇÃO-ALERTA DE INTERPRETAÇÕES EM OPINIÕES CONSULTIVAS
Get PDFObjetivo: Este artigo visa discutir o uso das Opiniões Consultivas pela Corte Interamericana de Direitos Humanos como forma de antecipar o lançamento de novos parâmetros interpretativos que conferem maior proteção à pessoa humana. Especificamente, pondera-se que a Corte, por meio da jurisdição consultiva, realiza uma sinalização-alerta de entendimentos mais avançados em termos protetivos, de maneira que as decisões em casos contenciosos que seguem às Opiniões apenas confirmam tal compreensão.Metodologia: Salienta-se a opção pelo método hipotético dedutivo de abordagem, na tentativa de verificar a viabilidade das Opiniões Consultivas como antecipadoras de parâmetros interamericanos; do modelo analítico-explicativo e crítico de análise, perpassando por um exame teórico sobre as decisões no Direito Internacional, culminando na observação específica da Opiniões da Corte Interamericana e da critica em relação às sinalizações-alerta de novos entendimentos; e das técnicas documental e bibliográfica de procedimento, com enfoque especial às decisões e opiniões recentes da Corte Interamericana e de doutrinas de direito internacional.Resultados: Conclui-se por meio deste estudo que a Corte Interamericana, quando almeja lançar novos entendimentos utilizando-se da sua jurisdição contenciosa, realiza uma sinalização-alerta dos mesmos em Opiniões Consultivas. Ademais, afirma-se que essa conduta garante a segurança jurídica que seus críticos tendem a ressaltar, não se mostrando factível referir a um suposto ativismo judicial realizado pelos seus magistrados, senão o oposto.Contribuições: Este texto contribui para o entendimento de que a Corte Interamericana, em especial seus magistrados, não parecem operar tal como se convencionou a chamar de ativismo judicial. De modo distinto, este texto aponta que os juízes interamericanos têm o dever de não apenas declarar, interpretar e aplicar o Direito convencional, mas também operar para o seu progressivo desenvolvimento, o que inclui um espaço criativo na busca pela concretização dos fins do sistema interamericano, e cuja realização (e “signaling”) ocorre(m) por meio de Opiniões Consultivas. Estas tendem a pavimentar as vias de compreensão da Corte, antecipando entendimentos que virão a ser postos em decisões de casos contenciosos.Palavras-chave: Corte Interamericana de Direitos Humanos; Opiniões Consultivas; Segurança Jurídica; Sinalização-Alerta. ABSTRACT Objective: This article aims to discuss the use of Advisory Opinions by the Inter-American Court of Human Rights as a way to anticipate the release of new interpretative parameters that provide greater protection to the human person. Specifically, it is considered that the Court, through advisory jurisdiction, carries out an alert signaling of more advanced understandings in protective terms, so that the decisions in contentious cases that follow the Opinions only confirm such understanding.Methodology: We emphasize the option for the hypothetical deductive method of approach, in an attempt to verify the viability of the Advisory Opinions as anticipating inter-American parameters; from the analytical-explanatory and critical model of analysis, passing through a theoretical examination of decisions in International Law, culminating in the specific observation of the Opinions of the Inter-American Court and the criticism in relation to the warning signs of new understandings; and procedural documentary and bibliographical techniques, with a special focus on recent decisions and opinions of the Inter-American Court and doctrines of international law.Results: We conclude from this study that the Inter-American Court, when it aims to launch new understandings using its contentious jurisdiction, carries out an alert-signal of the same in Advisory Opinions. Moreover, it is stated that this conduct guarantees the legal certainty that its critics tend to emphasize, not proving to be feasible to refer to a supposed judicial activism carried out by its magistrates, but the opposite.Contributions: This text contributes to the understanding that the Inter-American Court, especially its judges, do not seem to operate as it is conventionally called judicial activism. In a different way, this text points out that Inter-American judges have the duty not only to declare, interpret and apply conventional law, but also to operate for its progressive development, which includes a creative space in the pursuit of achieving the goals of the inter-american system. , and whose realization (and “signaling”) takes place through Advisory Opinions. RESUMEN Objetivo: Este artículo tiene como objetivo discutir el uso de las Opiniones Consultivas por parte de la Corte Interamericana de Derechos Humanos como forma de anticipar la liberación de nuevos parámetros interpretativos que brinden mayor protección a la persona humana. Específicamente, se considera que la Corte, a través de la jurisdicción consultiva, realiza una señal de alerta de entendimientos más avanzados en términos tutelares, por lo que las decisiones en los casos contenciosos que siguen a los Votos sólo confirman dicho entendimiento.Metodología: Destacamos la opción por el método hipotético deductivo de abordaje, en un intento de verificar la viabilidad de las Opiniones Consultivas como anticipadoras de parámetros interamericanos; desde el modelo de análisis analítico-explicativo y crítico, pasando por un examen teórico de las decisiones en Derecho Internacional, culminando en la observación específica de los Votos de la Corte Interamericana y la crítica en relación a las señales de alerta de nuevos entendimientos; y técnicas procesales documentales y bibliográficas, con especial énfasis en decisiones y opiniones recientes de la Corte Interamericana y doctrinas de derecho internacional.Resultados: Se concluye de este estudio que la Corte Interamericana, cuando pretende lanzar nuevos entendimientos utilizando su jurisdicción contenciosa, realiza una señal de alerta de los mismos en las Opiniones Consultivas. Además, se afirma que esta conducta garantiza la seguridad jurídica que suelen subrayar sus críticos, no resultando factible referirse a un supuesto activismo judicial realizado por sus magistrados, sino todo lo contrario.Aportes: Este texto contribuye a entender que la Corte Interamericana, en especial sus jueces, no parecen operar como convencionalmente se denomina activismo judicial. De manera diferente, este texto señala que los jueces interamericanos tienen el deber no sólo de declarar, interpretar y aplicar el derecho convencional, sino también de operar para su desarrollo progresivo, lo que incluye un espacio creativo en la búsqueda del logro de los fines del derecho. el sistema interamericano, y cuya realización (y “señalización”) se realiza a través de Opiniones Consultivas. Going Beyond Counting First Authors in Author Co-citation Analysis

counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Get PDF“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
Get PDFWe provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
