    The contribution shows how anthropological knowledge and methodology can be employed in the legal context. Although anthropology is no stranger to the legal world, light will be shed on the dynamics of its use and the ethical and positional dilemmas involved. Through an ethnographic excerpt of broader action research conducted to understand the weight of stereotypes and imaginaries in recognizing international protection, the author will reflect on the difficulties encountered in translating anthropological knowledge and methodology into the legal sphere. In particular, the author will discuss the implications of using cultural tests to interpret and validate migration stories and motivations

    If a Lion Eats Him..

    This article, starting from the analysis of the expression "if a lion kills/eats him" (i.e., a slave received on pledge), which appears in a limited number of surety contracts in the archive of the famous Balaĝunamḫe of Larsa (1829-1792 BC), gives a brief overview of the threat that lions posed not only to livestock but also to human beings in secondmillennium Mesopotamia. Letters and administrative documents inform us of attacks on animals and, more rarely, even people. By contrast, collections of laws and legal principles seem to deal exclusively with problems arising from lions attacking domestic animals, without any mention of attacks on humans. In the light of this brief investigation, the author concludes that the expression "if a lion kills/eats him" must be considered a unicum, since it is not found in any other real-life or school contract. She assumes that the scribe decided to add this formula to the liability clause of Balaĝunamḫe's surety contracts in order to cover as many scenarios as possible, including the chance of being eaten by a lion, clearly representing an event of force majeure

    The Equalisation of Benefits (Compensatio Lucri Cum Damno) in the Italian Law. A Possible Inspiration for Other European Member States?

    The Compensatio Lucri Cum Damno concerns cases in which the behaviour of the wrongdoer caused both damages and advantages to the victim. The question is: when and under which conditions such advantages can be set-off against the liable person’s obligation of paying damages? On the contrary, should such mitigation of liability be denied? In 2018 the Italian Highest Courts established principles with regard to these questions, but only with reference to the specific cases submitted to their attention. This article shows how the Italian Courts were inspired by the common principles of European private law and the comparative method with regard to: i) the impossibility of stating a general rule (thus, the necessity of proceeding for categories and classes of cases), and ii) the necessity of looking at the purpose of the benefit, rather than at the causal link between tort and advantages. The author believes that the criteria identified by the Italian case-law for the deductibility of benefits from damages might be of inspiration for other European Member States. Furthermore, it is here highlighted that the Italian Highest Courts made decisions on Compensatio Lucri Cum Damno using an argument explicitly based on the Soft Law and this could strength the effect of the moral suasion within the Draft Common Frame of Reference and the Principle of European Tort Law

    Sustainable Environmental Development from the Regional Perspective—The Interesting Case of Poland

    The EU regional development policy aims to reduce through its cohesion policy the socio-economic development disparities between its most developed regions and peripheral regions. Research shows that despite this strategy, the economic development of EU countries in the spatial system is not homogeneous. In addition, contemporary strategies take into account economic development with respect to environmental protection. The goal of this paper was to assess sustainable regional development in Poland, taking into account environmental and innovative activity indicators, as well as mobility and accessibility in remote areas. To recognize the effects of supporting sustainable development, the evaluation was carried out considering the indicators from the Statistics Poland platform, concerning 2011 and 2021, and related them to economic development, the environment, mobility and accessibility of 16 regions. Comparing results obtained with the K-means clustering method with those obtained with the partitioning around medoids method, it was possible to verify, with greater reliability, the migration of regions into different clusters. Results showed that development of all the regions was significant yet highly disproportionate, thus highlighting the consolidated presence of dynamically growing regions versus peripheries, which means further regional polarization. An educational cross-sectorial approach can play a crucial role in promoting green pro-innovative development

    Effect of leukoreduction by pre-storage filtration on coagulation activity of canine plasma collected for transfusion

    Leukoreduction of blood products is a technique used to prevent leukocyte-induced transfusion reactions and is extensively used in human, but rarely in veterinary patients. The concentration of some coagulation proteins can be affected by the processing steps used for the preparation of leuko-reduced plasma units. In this study, we assessed the effect of leukoreduction on coagulation activity of canine plasma collected for transfusion. Ten plasma units, five obtained from non-leuko-reduced (non-LR) whole blood (WB) units and five from leuko-reduced (LR) WB units were evaluated. Prothrombin time (PT), activated partial thromboplastin time (aPTT), coagulation factor activities of factors (F) V, VIII, X, XI, and von Willebrand (vWF), fibrinogen and D-dimers content were assessed at collection (baseline value, D0) and after 7 days of frozen storage at 18 C (D7). Compared to non-LR plasma units, LR units showed a statistically significant prolonged aPTT and reduced FXI activity. Filtration had no significant effect on the other factors and parameters evaluated. Filtration-dependent changes appear to have no impact on the therapeutic quality of plasma obtained from leuko-reduced whole blood, other than for FXI activity. Further studies on a larger sample size comparing the same unit before and after leukoreduction are needed to confirm these findings

    The card agglutination test for dog erythrocyte antigen 1 (DEA 1) blood typing in donor dogs: Determining an appropriate cutoff to detect positivity using a receiver operating characteristic curve

    Background The appropriate cutoff to define a positive point-of-care card agglutination (CA) test for dog erythrocyte antigen 1 (DEA 1) blood typing depends on whether the test can be used in the donor or recipient. Objectives By screening for CA test positivity, we aimed to evaluate the best cutoff value for DEA 1 blood typing in canine blood donors using a receiver operator characteristic (ROC) curve. Methods Ethylenediaminetetraacetic acid (EDTA) blood samples from 100 canine blood donors were blood-typed in parallel for DEA 1 using both immunochromatographic (IC) and CA tests. The effect of temperature, storage time, and anticoagulant solutions for both methods was evaluated. Unweighted and weighted Cohen's Kappa (K) statistic was calculated to evaluate the agreement between the two testing methods. The overall performance of the CA test was evaluated by generating a ROC curve using the IC test as the reference method. Results Concordant results were obtained for 86% of the samples. Unweighted and weighted K statistics demonstrated good and moderate agreement, respectively. For the CA test, the ROC curve showed an area under the curve (AUC) of 0.910, with the highest sensitivity cutoff values at >= 1+ agglutination. CA- and IC-typed EDTA blood samples stored at room temperature for up to 1 week and refrigerated for up to 1 month were concordant as were the citrate phosphate dextrose adenine 1 (CPDA-1) anticoagulated blood samples stored for up to 1 week at 4 +/- 2 degrees C. Conclusions The overall reliability of the CA method seemed to be lower than that of the IC method. When CA is used as a screening test for canine blood donors, the correct cut off is >= 1+ agglutination is recommended to maximize sensitivity

    Critically Appraised Topic on Low-Level Laser Therapy (LLLT) in Dogs: An Advisable Treatment for Skin Diseases?

    Low-level laser therapy (LLLT) is a therapeutic option that stimulates cellular function through intracellular photobiological and photochemical reactions, promoting better tissue repair and an anti-inflammatory, antibacterial, and analgesic effect. Previous studies in human and veterinary medicine have shown the clinical efficacy of LLLT in many fields. In this study, the literature was reviewed using the critically appraised topic (CAT) method to determine the canine skin diseases for which LLLT is an advisable treatment. A meticulous literature search revealed 19 significant clinical trials, which were critically analyzed. The evaluation of the best accessible evidence in July 2022 suggests that fluorescence biomodulation (FBM), a type of LLLT, can, in combination with systemic antibiotic therapy, be a promising and effective adjunctive treatment for canine interdigital pyoderma and canine deep pyoderma. Furthermore, the evidence suggests that the use of LLLT is not recommended as a therapy for pedal pruritus secondary to canine atopic dermatitis. For other canine skin diseases included in the CAT, although LLLT appears to be a promising treatment, there is not yet good scientific evidence to recommend its use

    International audienceThe essay analyzes a text by Marcel Spada, Portrait of Pagani, traces the history of a family of Italian origin, since the arrival in France of the grandparents in Hyères (Var) to the beginning of the third generation in the 1950s. This novel, written in 1955, was destroyed by his author, who regained his composure after drawing on his memory. Without this destruction, occurred when it was not yet fashionable to highlight his «ritalianité», Marcel Spada would probably have been one of the first «children of Italians» of France to reopen the «suitcase of the migrant» of his ancestors and neighbors. The article focuses on the relationship that each generation has with Italy and the political and cultural environment that supports the settlement in Hyères (in France and in general), especially in the turmoil of the Second World War. The A.’s aim is to show how Marcel Spada, following his literary vein, contributed to the reconstruction of the past and the memory of Italians in France, an experience that private and family dramas often buried in oblivion and that historical events have helped to erase.El ensayo analiza un texto de Marcel Spada, Retrato de Pagani, que sigue la historia de una familia de origen italiano, desde la llegada a Francia de los abuelos en Hyères (Var) hasta el comienzo de la tercera generación en 1950. La novela, escrita en 1955, fue destruida por su autor, que luego la arreglara siguiendo los trazos de su memoria. Sin esta destrucción inicial, en una época en la que todavía no estaba de moda hacer exhaltar la «ritalianité», Marcel Espada probablemente habría sido uno de los primeros «hijos de italianos» de Francia a volver a abrir la «maleta del migrante» de sus ancenstros y de sus sus vecinos, entre ellos la de una familia de origen italiano, que conoció en persona. Todo ello, sin el propósito de compartir con sus lectores la percepción de la experiencia de la migración. El ensayo concentra su atención sobre la relación entre diversas generaciones, Italia y la atmósfera política y cultural durante el asentamiento de la empresa de Hyères (y de Francia en general), especialmente durante los acontecimientos de la Segunda Guerra Mundial. El A. muestra cómo Marcel Espada, dejándese llevar por su vena literaria, contribuyó a la reconstrucción del pasado y de la memoria de los italianos en Francia, una experiencia que los dramas privados y familiares a menudo han enterrado en el olvido y que los acontecimientos históricos han contribuido a eliminar.Cet article porte sur un roman de Marcel Spada, Portrait des Pagani, retraçant l’histoire d’une famille d’origine italienne, depuis l’arrivée en France des grands-parents à Hyères (Var) jusqu’à l’adolescence de la troisième génération, dans les années 1950. Le roman, rédigé une première fois en 1955, avait été détruit par son auteur, qui l’a recomposé plus tard de mémoire. Sans cette destruction, survenue lors qu’il n’était pas encore de bon ton de mettre en avant sa «ritalianité», Marcel Spada aurait sans doute été l’un des premiers «enfants d’Italiens» de France à rouvrir la «valise du migrant» de ses ancêtres et de ses voisins, notamment celle d’une famille d’origine italienne qu’il a personnellement connue, et, sans que ce soit pour autant son but premier, à faire partager à ses lecteurs sa perception de l’expérience migratoire.
