Legislación antidiscriminatoria y acceso laboral sobre personas en situación de discapacidad : Una comparación legal entre Italia y Japón
El importante ensayo del doctor Pierluigi Digennaro, que ahora publicamos en Análisis Laboral, presenta un estudio comparativo sobre las disposiciones normativas relacionadas con la discriminación de trabajadores con impedimentos y el acceso laboral de personas en situación de discapacidad en Italia y Japón/i. Ambos ordenamientos jurídicos combinan sistemas de cuotas con disposiciones antidiscriminatorias. Japón, por su parte, ha adoptado recientemente un enfoque basado en derechos humanos que incluye la prohibición de discriminación en el lugar de trabajo con el fin de cumplir con el Convenio de las Naciones Unidas sobre los derechos de las personas con discapacidad. A pesar de estas similitudes, existen ciertas diferencias en lo concerniente a disposiciones o procedimientos, pero también en el marco legal y en la forma en la que los diferentes estándares internacionales son acomodados al respectivo ordenamiento nacional. Right to work and placement of the disabled in the labour market: the Italian legal framework
This paper gives an overview of Italian legal instruments that aim to ensure the integration and participation of disabled persons in the labour market and ultimately in society as a whole. The analysis moves from an examination of Constitutional standards to a consideration of the most detailed regulations. The author also discusses the influence and implementation of international legal regulations in Italian law and the possible different approaches to the definition of disability between these two levels. The paper also summarizes the most relevant court decisions on the subject and describes the present labour market situation with regard to the employment of disabled persons as well as the effectiveness of the law instruments, analysed by means of statistical data. Finally, the author analyses the role of Universities in the placement of young graduates with disabilities and gives examples of best practises and specific programs.El ensayo ofrece una visión general de los instrumentos legales que tienen como objetivo asegurar la integración y participación de las personas con discapacidad en el mercado laboral y, en última instancia, en la sociedad. El análisis se mueve de un examen de las normativas constitucionales hasta las normas más detalladas. El autor también analiza la influencia y la aplicación de las normas jurídicas internacionales en el derecho italiano y los posibles enfoques diferentes para la definición de discapacidad entre estos dos niveles. El documento también resume las decisiones judiciales más relevantes sobre el tema y describe, a través de datos estadísticos, la situación actual del mercado de trabajo en relación con el empleo de las personas con discapacidad, así como la eficacia de los instrumentos de derecho analizados. Por último, el autor analiza el papel de las universidades en la colocación de los jóvenes titulados con discapacidad y da ejemplos de las mejores prácticas y programas específicos
Regulating labour at the border between employment and self-employment : An enduring challenge
The chapter examines the foundations and evolution of labour law in Europe, focusing on the dividing line between subordination and self-employment to explain the reasons and logic behind these developments. In light of this analysis, the chapter explores ongoing changes in the field, such as platform work and post-pandemic conditions. It identifies the primary function of labour law as governing power dynamics and analyses the tools still used to fulfil this function, particularly through the examination of judge-made law. The findings also illuminate the broader implications of the current legal framework for social law, collective action, working time, and workplace dimensions
Subordinazione o dipendenza? Uno studio sulla linea di demarcazione tra lavoro subordinato e lavoro autonomo in sei sistemi giuridici europei
This article presents a comparative analysis of six countries (France, Germany, Italy, Slovakia, the Netherlands, and the United Kingdom) that aims to examine the distinction between work under an employment contract (subordinate work) and self-employment, shedding light on the main criteria used by the law and judges to identify the two concepts and also provides an overview of how legal systems have tackled the problem of forms of work that lie halfway between work under an employment contract and self-employment. It also provides a uniform basis for discussions and a critical assessment of the various approaches that these legal systems have chosen to shape the concept of employment contract/subordinate work or other legal statuses that ensure protection. In the final section, some conclusions are drawn about the studied countries, and the new concept of ‘subjection’ is introduced to reorganise the protection granted by labour law since it absorbs and expands the concept of subordination upon the consideration that the former can better match the current socio-economic scenario. Indeed, the latter scenario is described in section one of the article. Lastly, the study stresses the need to protect the genuine self-employed through mechanisms to ensure social protection in cases of sickness, long-term impediments to work and retirement.Este artículo presenta un análisis comparativo de seis países (Francia, Alemania, Italia, Eslovaquia, los Países Bajos y el Reino Unido) que tiene como objetivo examinar la distinción entre el trabajo subordinado y el trabajo por cuenta propia. Asimismo, el artículo investiga los principales criterios utilizado por la ley y los jueces para identificar los dos conceptos en cada uno de los países mencionados y también describe cómo algunos sistemas juridicos han configurado un tercer género distinto a los señalados. Este artículo proporciona una base uniforme para las discusiones y una evaluación crítica de los diversos enfoques que estos sistemas legales han elegido para dar forma al concepto de contrato de trabajo / trabajo subordinado u otros conceptos juridicos que garanticen la protección. En la parte final, se extraen algunas conclusiones sobre los países estudiados, y se introduce el nuevo concepto de 'sujeción' para reorganizar la protección otorgada por la legislación laboral. De hecho, este último puede adaptarse mejor al escenario socioeconómico actual y absorbe y expande el concepto de subordinación. El escenario socioeconómico se describe en la primera parte del artículo. Por último, el estudio subraya la necesidad de proteger a los autónomos genuinos a través de mecanismos para garantizar la protección social en casos de enfermedad, impedimentos a trabajar a largo plazo y la pensión adecuada.Il saggio include, nella sua parte centrale, una analisi comparata su sei sistemi giuridici (Slovacchia, Olanda, Germania, Regno Unito, Francia e Italia) volta ad esaminare la distinzione, in tali paesi, tra lavoro subordinato e lavoro autonomo e, qualora presente, fra questi ed un terzo status legale. In particolare, sono stati sottoposti ad analisi i criteri distintivi utilizzati dalla legge e dalla giurisprudenza in ciascuno di detti ordinamenti. La finalità di questa parte del saggio è quella di fornire una base uniforme alla discussione e valutazione critica dei differenti approcci utilizzati in questi sistemi legali per dare forma a quegli status giuridici che assicurano la protezione del diritto del lavoro. La terza sezione intende contribuire a tale dibattito traendo delle conclusioni dalla analisi comparata ed introducendo il concetto di ‘assoggettamento’ come possibile catalizzatore delle tutele al posto del concetto di subordinazione onde assorbirne e ampliarne la portata. Si ritiene, infatti, che la categoria dell’‘assoggettamento’ possa ‘leggere’ meglio l’attuale scenario socioeconomico nel quale le categorie giuridiche necessariamente debbono inserirsi. Un affresco critico di tale scenario è, infatti, fornito nella prima sezione del saggio. Nelle ultime righe del saggio è rivolto un invito ai legislatori ad operare al fine di garantire anche ai lavoratori autonomi ‘genuini’ strumenti più efficaci che siano volti a garantire loro protezione in caso di malattia o impedimenti di lungo termini ad operare sul mercato nonché il diritto ad una pensione adeguata
The Effects of Neoliberalism in European Labour Law: The meaning of labour and the need for a different constitutional compromise
This article aims to identify continuity between the main neoliberal schools that had a role in making the European legal order and the conception of labour and 'work activity' embedded in the European legal framework. The consequences of this contiguity are also discussed. In particular, the concepts of 'working activity' and 'undertaking' elaborated by the Court of Justice are used as a driver of the analysis to detect signs of the mentioned influences. A two-phase approach is adopted to develop the research. First, a review is provided of relevant ECJ judgments that testify to the Court's position on the topics discussed in the article. Second, the cultural common ground between the interpretation of the legal framework found in case law and specific neoliberal theories is highlighted. The meta-principles that are identified through the analysis are then compared with those derived from the rights recognised in the constitutions proclaimed in the second half of the 20th century to show the significant discontinuity that endangers the very existence of the European Union as a political project and has destabilised the constitutional order of many European countries. As the founding principles of the EU legal order kickstarted a containment of labour and social rights, the call for change at the roots of European "Constitutional law" is becoming increasingly urgent. The formal proclamation of the Charters of Fundamental Rights at the European level (not least because of the way in which rights are recognised) has not in itself proved to be capable of transcending the original matrix of the European order
A hybrid attempt to regulate labour : Recent developments under the European Union's legal framework
This chapter analyses the making of the European Commission Guidelines regulating the application of competition law to self-employed persons' collective bargaining and the European Directive regulating platform work. It draws on interviews with European labour representatives that participated in the policymaking process and a legal comparative analysis of the different versions of the Guidelines and the Directive that have been issued by European institutions and discussed by European actors. Furthermore, it reconstructs the perspective of labour representatives on the most contentious points of the two texts and provides a legal analysis of the most controversial aspects of these regulations

A critical assessment of the EUCJ case law on the manifestation of religious convictions at the workplace
The paper aims to present a doctrinal assessment of the ECJC case-law on the freedom to manifest one’s religious affiliation on the workplace to show internal inconsistencies among four judgments (namely Bougnaoui v. Micropole, Achbita v. G4S Secure Solu-tion, Vera Egenberger v. Evangeli-sches Werk für Diakonie und Entwicklunge V, IR vs. JQ) and between them and the ECtHR case law as well as fallacies in the Court legal reasoning. The analysis intends also to bring to light how both the ECJC and the ECtHR accepted a specific idea of neutrality which is in stark contrast with the very reason of the European anti-discrimination law so embarking on a dangerous path. The paper also intends to contribute to the debate concerning the potential space allegedly opened by those judgments to reasonable accommodation of believers at the workplace
