Penguasaan tanah ada yang bersifat legal, ada juga yang bersifat illegal. Penguasaan tanah secara legal berbentuk penguasaan secara fisik dan/atau yuridis, sedangkan penguasaan tanah secara illegal hanya berbentuk penguasaan fisik saja, yang biasa dikenal dengan penguasaan tanah tanpa hak. Dalam penelitian ini, penulis melakukan analisis terhadap putusan Pengadilan Negeri Palembang Nomor : 29/Pts.Pid/CR/2009/PN/PLG, dimana Dinem binti Karyo Dikromo dan Satino alias Yono bin Joyo yang memiliki Akta Pengoperan Hak Tanah Usaha No : 02/KLD/2004 tanggal 2 Januari 2004 yang dibuat di Kantor Camat Kalidoni Palembang dinyatakan bersalah melakukan tindak pidana penguasaan tanah tanpa hak, melanggar Pasal 2 dan Pasal 6 huruf b dan c UU No.51/PRP/1960. Untuk itu, penulis mengambil permasalahan apakah Putusan Pengadilan Negeri Palembang Nomor : 29/Pts.Pid/CR/2009/PN/PLG sudah tepat? Metode penelitian yang digunakan penulis adalah penelitian hukum normatif yang bersifat deskriptif. Data penelitian memperlihatkan bahwa Putusan Pengadilan Negeri Palembang Nomor : 29/Pts.Pid/CR/2009/PN/PLG sangat tidak tepat. Hakim dalam putusannya telah menghilangkan hak Dinem dan Yono atas tanah tersebut yang diperolehnya berdasarkan Akta Pengoperan Hak Tanah Usaha No : 02/KLD/2004. Hakim melakukan pemeriksaan semata-mata hanya didasarkan pada ancaman hukuman yang didakwakan terhadap Dinem dan Yono, tanpa melihat substansi dan hal-hal yang melatarbelakangi timbulnya perkara. Going Beyond Counting First Authors in Author Co-citation Analysis
Full text linkThe present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
