    Giudizio di esecuzione e diritto alla conoscenza del procedimento: riflessioni de iure condito e de iure condendo

    Il contributo affronta il tema della necessaria conoscenza, da parte dell’interessato, dell’atto di vocatio in ius nel giudizio di esecuzione penale. Dopo aver ricostruito il sistema delle notifiche alla luce delle modifiche introdotte dalla riforma Cartabia, l’autore critica l’orientamento giurisprudenziale che esclude, nella fase esecutiva, l’applicazione delle garanzie previste per il giudizio di cognizione in materia di conoscenza del procedimento. Alla luce dei principi costituzionali e convenzionali in materia, propone, altresì, un’interpretazione costituzionalmente orientata che consenta di estendere al giudizio di esecuzione – in via esegetica o attraverso un giudizio incidentale di legittimità – alcune tutele previste in tema di processo in assenza, ovvero la disciplina prevista dall’art. 598-ter c.p.p.The contribution addresses the issue of the individual’s necessary awareness of the vocatio in ius in criminal enforcement proceedings. After reconstructing the system of notifications in light of the changes introduced by the Cartabia reform, the author critiques the prevailing case law, which, in the enforcement phase, excludes the application of the safeguards established for the trial phase concerning the defendant’s awareness of the proceedings. In light of the relevant constitutional and conventional principles, the author also proposes a constitutionally oriented interpretation that would allow for the extension to the enforcement phase - either through interpretation or by means of an incidental constitutionality review - of certain safeguards applicable to proceedings held in absentia, as well as the rules set out in art. 598-ter of the Italian Code of Criminal Procedure

    Dopo aver inquadrato il diritto alla libertà morale e la tutela che gli è riconosciuta nell'ordinamento, l'autore concentra l'attenzione sul captatore informatico e sull'opinione giurisprudenziale secondo cui il suo utilizzo non inciderebbe sulla capacità di autodeterminazione dell'individuo. L'esito della riflessione è che una lesione della libertà morale sia, invece, determinata da talune metodiche ingannevoli utilizzate per provocare l'installazione del malware con la collaborazione inconsapevole del destinatario.After framing the right to mora/ freedom and its protection accorded by law, the author focuses attention on the trojan horse used for investigation and on the case /aw according to which its use would not affect the individual's ability to self-determinate. The outcome of the reflection is that an injury to mora/ freedom is, instead, determined by certain misleading methods used to get the installation of malware with the unwitting cooperation of the recipient

    La sentenza in commento invita ad una riflessione sulla particolare condizione del soggetto che, affetto da una malattia fisica irreversibile, risulti incapace di partecipare al processo. La disciplina dettata dal legislatore agli artt. 70 ss. c.p.p., rivisitata dalla Riforma Orlando, è infatti tutta incentrata sulla incapacità di una partecipazione cosciente al processo e rievoca, dunque, un problema psichiatrico, non puramente fisico. Viene, però, da chiedersi se in un sistema processuale evoluto ed ispirato al riconoscimento delle garanzie anche la posizione del soggetto affetto da una grave patologia fisica non meriti tutela e quale essa possa essere.The ruling of the Court of Cassation provides an opportunity to deepen the theme of the particular condition of the defendant who, suffering from an irreversible physical illness, is unable to attend the trial. The discipline provided by Article 70 et seq. of the Criminal Procedure Code, as reviewed by the Orlando Reform, contains rules applicable only to the irreversible inability caused by mental illness or by altered mental conditions that are consequence of physical illness, but not to inability caused by physical illness. The author investigates about the protection that an evolved criminal procedural system, inspired by recognizing guarantees, should offer to a defendant that is unable to participate in the criminal trial because of an irreversible physical illness

    Se expone la interpretación de Franz Hinkelammert y las posiciones afines a dicha interpretación entre la comunidad de investigadores especialistas en el pensamiento de David Hume. La investigación consta de dos partes. En la primera se expone la interpretación que Franz Hinkelammert hace sobre A Treatise of Human Nature de David Hume. En la segunda se busca mostrar la correspondencia entre dicha interpretación y las posiciones o interpretaciones propias de la comunidad de especialistas en el pensamiento de David Hume en torno a dos ejes argumentativos: el principio de causalidad y el principio de justicia. De ese modo se compara la correspondencia entre ambas interpretaciones para evaluar hasta qué punto es factible sostener la interpretación que Franz Hinkelammert hace sobre el método de pensamiento de David Hume como válido.The research exposes the interpretation of Franz Hinkelammert and the positions related to this interpretation among the community of scholars specializing in the thought of David Hume. The investigation consists of two parts. In the first one is exposed the interpretation that Franz Hinkelammert makes about A Treatise of Human Nature by David Hume. In the second one, it seeks to show the correspondence between this interpretation and the positions or interpretations proper to the community of specialists in the thought of David Hume around two axes: the principle of causality and the principle of justice. In this way the correspondence between the two interpretations is compared to evaluate to what extent it is feasible to support Franz Hinkelammert's interpretation of David Hume's method of thought as valid

    Burkitt lymphoma is a non-Hodgkin lymphoma that is endemic in the Equatorial Belt of Africa, usually affecting children and adolescents with primary head-neck or abdominal involvement. Primary cardiac lymphomas are rare entities (1.3% of all primary cardiac tumors) of difficult clinical identification. Delayed discovery contributes to significant mortality. We report a case of a primitive Burkitt lymphoma in a 14-year-old Cameroonian immunocompetent child, presenting with signs and symptoms of severe right inflow impairment. Echocardiography revealed a right atrial mass involving the right atrial ventricular junction. Surgical excision and chemotherapy regimens, administered according to established protocols, were effective in inducing complete remission at 6 months

    In 1333, rabbi Isaac Chelo from Aragon and his family set out to the East intending to settle in Jerusalem. One result of his journey is the rabbi’s description of Palestine and Syria that has remained. Isaac Chelo’s work is structured according to an idea in which the magic number seven plays a prominent part. The author described seven wonders of Jerusalem, seven routes leading to the Holy City, on each he mentioned seven remarkable places, seven major synagogues, and referred to seven prophets and seven cabalistic books. Despite this close implementation of a predefined pattern, the account makes for a valuable source enabling the historian to look at the Holy Land through the eyes of an adherent of the Mosaic religion. As an added advantage, the narrative is by an educated author who was well qualified to observe, correctly understand, and describe the places he visited and the relics he saw there. In describing the routes, the author focused equally on places and figures referred to in the Bible, and on mementoes of notable rabbis; in vain would we look for more detailed information on the current political, social, or religious situation in the Holy Land, nor is the slightest mention to be found of plants, animals, climate, or landscape
