TANGGUNG JAWAB AUSTRALIA ATAS PENCEMARAN LAUT OLEH MINYAK DARI KILANG MINYAK MONTARA MENURUT HUKUM INTERNASIONAL
ABSTRAK
Laut merupakan salah satu sumber daya alam yang wajib dilestarikan agar tetap dapat menjadi penunjang hidup bagi manusia dan mahluk hidup lainnya demi kelangsungan dan peningkatan kualitas hidup itu sendiri. Namun, dalam perkembangannya timbul berbagai permasalahan di laut, khususnya pencemaran laut yang sisebabkan oleh minyak. Pada tanggal 21 Agustus 2009 telah terjadi kecelakaan dalam pengoperasian kilang minyak lepas pantai Montara oleh PTTEP Australasia di wilayah ZEE Australia yang mengakibatkan tumpahnya minyak ke perairan Laut Timor dan menyebar ke wilayah Zona Ekonomi Eksklusif (ZEE) Indonesia. Hal ini menimbulkan dampak negatif pada lingkungan laut dan berimbas kepada perekonomian serta kesehatan masyarakat pesisir Nusa Tenggara Timur (NTT).
Metode pendekatan yang dipergunakan dalam penulisan skripsi ini adalah yuridis normatif dan hasil penelitiannya disajikan secara deskriptif analitis dengan mengkaji dan meneliti data-data sekunder berupa sumber-sumber hukum internasional dan bahan-bahan kepustakaan terkait untuk mengetahui dan memahami tentang tanggung jawab negara atas pencemaran laut oleh minyak yang berasal dari kegiatan bawah laut yang beroperasi di wilayah yurisdiksinya.
Berdasarkan penelitian yang dilakukan penulis, dapat diketahui bahwa Australia sebagai negara pantai yang memberikan izin kepada PTTEP untuk melakukan kegiatan ekplorasi dan ekploitasi di wilayah ZEE nya, juga memiliki tanggung jawab berupa kewajiban-kewajiban untuk membersihkan dan memulihkan semua dampak pencemaran dan membayar kompensasi atas segala bentuk kerugian yang dialami oleh korban pencemaran. Kewajiban-kewajiban tersebut berdasarkan ketentuan yang terdapat dalam UNCLOS 1982, khususnya Pasal 56, Pasal 60, Pasal 194 ayat 2. Klaim ganti rugi diselesaikan melalui perundingan antara kedua negara. Guna menyelesaikan masalah yang berkaitan dengan ganti rugi pencemaran laut oleh minyak, penulis menggunakan prinsip-prinsip seperti Sic Utere Tuo Ut Alienum Non Laedas, Prinsip Kehati-hatian, Prinsip Pencegahan, Prinsip Tanggung Jawab Negara, dan lain-lain. Berkaitan dengan penyelesaian klaim ganti rugi, terdapat beberapa hal yang perlu diperhatikan, antara lain perlu adanya penelitian untuk mendapatkan data yang akurat, serta pengembangan ketentuan hukum nasional terkait pencemaran yang bersifat lintas batas
Depression, anxiety, and stress disorders detection in students during the Covid-19 pandemic using Naïve Bayes algorithm
During the Covid-19 pandemic, students in Indonesia carried out bold learning from home as a social effort during the pandemic. This bold learning process is considered to be still less effective and efficient and has resulted in some students, especially students having homework during the brave learning period. This has an impact on the psychology of students such as the emergence of depression, anxiety, and stress. Sources of psychological disorders not only from academics but from within themselves also affect mental health. The results of a survey on mental health during the pandemic conducted by the Association of Indonesian Mental Medicine Specialists (PDSKJI) showed that 64.8% of respondents experienced psychological problems in the age group of 19-24 years and over 60 years. In this study the author will make a system of Tests for Depression, Anxiety and Stress Disorders in Students. The results of this test are the severity of each psychological disorder and treatment recommendations based on the test results. The psychological scale used in this study is the DASS-42 (Depression, Anxiety, and Stress Scale) which has 42 statements and 3 categories of disorders, namely depression, anxiety, and stress. Each category has 5 levels, namely normal, mild, moderate, severe, and very severe. The Test System for Depression, Anxiety, and Stress Disorders for Students uses the Naïve Bayes method with the accuracy of the dataset obtained by 86.44%, so it can be said that this system is running according to the purpose
