A ciascuno il suo? Giudice costituzionale e Legislatore tra separazione dei poteri e tutela dei diritti fondamentali: il caso dell’aborto
The present essay aims at reflecting, in a comparative perspective, on the role and functions of constitutional Courts in the relationship between the (formal?) principle of the separation of powers and the “substantial” protection –or even judicial creation –of fundamental rights. Dealing with the constitutional doctrines of originalism and living constitutionalism, it will be shown that the “elephant in the room” refers to the way the Constitution is interpreted and applied by Courts and the limits it has when judges are called to decide on sensitive issues which involve ethics and politics (e.g. abortion)
L’opinione dissenziente nelle Corti costituzionali: un formante giurisprudenziale con influenza sul procedimento legislativo?
The paper deals with the role and functions of the dissenting opinion in Constitutional Courts in a comparative perspective, focusing especially on the
interaction between judicial activity and lawmaking process. On the one side, particular attention will be paid to the influence the dissent can have on how Judges apply the law and parliamentary Assemblies act. On the other one, it will be highlighted that the dissenting opinion could also contribute to the shaping of a certain relationship between Judges and Parliaments, in order to favour a dialogue between different points of view and to consolidate the way both of them work

Il presente articolo affronta – alla luce delle suggestioni provenienti dall’ultimo volume di Robert Hazell e Timothy Foot – il tema della Royal Prerogative nell’ordinamento costituzionale del Regno Unito. A partire da una breve definizione introduttiva dei suoi caratteri formali, l’attenzione sarà concentrata sulle declinazioni concrete che essa ha sperimentato nel corso della storia, guardando in particolare ad alcuni profili istituzionali che ne hanno rappresentato lo svolgimento (la nomina del Primo Ministro, lo scioglimento parlamentare anticipato, la promulgazione delle leggi, la ratifica dei trattati internazionali, la prorogation della Camera dei Comuni). Infine, si guarderà alla possibilità di sistematizzarne (o addirittura riformarne) alcuni aspetti strutturali, senza modificarne i contenuti.The essay aims – looking at the suggestions coming from the latest book by Robert Hazell and Timothy Foot – at analysing the topic of the Royal Prerogative in the United Kingdom. Starting from a brief definition of its formal characteristics, attention will be paid to the concrete developments it has experienced throughout history, looking in particular at the way this power has been applied in some fundamental areas of constitutional law (the appointment of the Prime Minister, the early parliamentary dissolution, the royal assent of laws, the ratification of international treaties, the prorogation of the House of Commons). Finally, some remarks will be made on the possibility of “codifying” (or even reforming) some structural aspects of the Royal Prerogative, without changing its contents

Dopo aver inquadrato l’argomento in una dimensione “olistica” – nella quale si integra il correlato diritto al cibo adeguato – specifica attenzione viene prestata alla regolamentazione in materia di food loss and waste: in questi termini,
si analizzano le normative di rango internazionale e sovranazionale, nonché quelle di alcuni ordinamenti nazionali, con riferimento ai diversi profili concreti nei quali si declina la lotta contro lo spreco alimentare. Infine, alcune riflessioni a proposito

Il presente contributo affronta i temi dell’accesso al cibo e della lotta contro lo spreco alimentare attraverso il prisma del principio costituzionale di dignità umana in una prospettiva di diritto comparato. In particolare, prestando soprattutto attenzione all’intervento della giurisprudenza in materia, si cercherà di cogliere i profili comuni delle pronunce di alcune Corti, sia in relazione al riconoscimento di un diritto “positivo” di accesso al cibo a partire da altri principi costituzionali, sia rispetto alla possibilità di implementare in sede giudiziaria l’esistenza di un “autonomo” diritto all’implementazione di politiche contro lo spreco alimentare.The present essay aims at addressing the issues of access to food and fight against food waste through the prism of the constitutional principle of human dignity in a comparative law perspective. Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
