    Iran’s Responsibility for the MV Mercer Street Attack under International Law

    The use of new technological developments in warfare, such as unmanned aerial vehicles (UAVs or drones), has become a threat to international law due to the infliction of unnecessary suffering and injuries. In late July 2021, the MV Mercer Street, managed by Israeli-owned Zodiac Maritime, was attacked by three one-way drones while transiting on the high seas of Oman. In such a situation, international peace and security are threatened. Based on an investigation by U.S. Central Command (CENTCOM) and all evidence available, the Group of Seven (G7) foreign ministers pointed to Iran as the state responsible for the attack. This conclusion was based on the fact that the vertical fin was identical to those seen on an Iranian-designed and manufactured one-way attack “kamikaze” UAV series. The investigations stated that Iran was actively involved. However, Iran rejected any responsibility for the attack. What is Iran’s responsibility for the MV Mercer Street incident from an international legal perspective? The research aims to determine the international legal perspective on the use of armed force. The study is normative legal research, in which the data are collected through a statutory approach and case approach. The result of the study shows Iran's responsibility is necessary for using armed drones as an advantage of new technologies that do not consider the principles of necessity and proportionality in armed conflict. Furthermore, the research provides an understanding of Iran's responsibility under international law regarding using armed forces against other states

    Augusto Roa Bastos: entre Nambréna e ausência, uma escritura caleidoscópica

    Tese (doutorado) - Universidade Federal de Santa Catarina, Centro de Comunicação e Expressão, Programa de Pós-Graduação em Literatura, Florianópolis, 2015.O presente trabalho tem a finalidade de demonstrar como a escritura de Augusto Roa Bastos se articula, com o passar do tempo, a uma multiplicidade de elementos em constante movimento e desenvolve, assim, uma escritura caleidoscópica. Nambréna, palavra guarani que remete ao desprezo pelo autóctone como resquício de um sistema colonial e segue com os seus tentáculos na sociedade paraguaia, se apresenta desde os primeiros escritos roabastianos sendo um desses componentes. Outras características importantes como a realidade delirante, um texto ausente que ecoa no silêncio e na consciência, juntamente com a experiência do exílio, atuam na sua escritura como rizoma em multiplicidade de conexões que se estabelecem entre e no interior das obras e são utilizadas como em um caleidoscópio, por isso uma escritura caleidoscópica. Para tanto, a leitura crítica do primeiro livro de contos  El trueno entre las hojas (1953)  se faz basilar para a análise desses movimentos que foram, com o passar do tempo, sendo utilizados e modificados e, como frêmito, reverberam em Contravida (1995) e Madama Sui (1996). José Manuel Silvero desenvolve um discurso filosófico sobre a condição de nambréna. A concepção de rizoma, de Deleuze e Guattari, serve de direção na construção dos elementos da escritura caleidoscópica, do mesmo modo os autores que tratam de escritura e de autoria, como Roland Barthes, Walter Benjamin e Michel Foucault, além de outros teóricos que são referenciais para a construção dessa perspectiva de leitura de uma escritura caleidoscópica.Abstract : The present work has the objective of showing how the writing of Augusto Roa Bastos articulates itself with the passage of time at a multiplicity of elements in constant motion and develops, thus, a kaleidoscopic writing. Nambréna, Guarani word that refers to the spite for the autochthone as a residue of a colonial system that carries on its tentacles in Paraguayan society, presents itself since the early roabastian writings being one of its components. Other important characteristics such as the delirious reality, an absent text that echoes in the silence and in conscience, along with the experience of exile, act in his writing as a rhizome in multiplicity of connections that are established between and inside the work and are used as in a kaleidoscope, thus a kaleidoscopic writing. To this end, the critical reading of the first short story book  El trueno entre las hojas (1953)  is made basic for the analysis of these movements that were with the passing of time being used and modified and, as a shiver, reverberate in Contravida (1995) and Madama Sui (1996). José Manuel Silvero develops a philosophical discourse on the condition of nambréna. The concept of rhizome, by Deleuze and Guattari, functions in the direction of the construction of the elements of kaleidoscopic writing, in the same way as with the authors who deal with writing and authorship, such as Roland Barthes, Walter Benjamin and Michel Foucault, besides other theorists that are referential to the construction of this perspective of the reading of a kaleidoscopic writing

    WTO Trade War Resolution for Japan's Chemical Export Restrictions to South Korea

    The research analyses the trade war between South Korea and Japan from the perspective of international law. The trade war involving South Korea and Japan was triggered by a decision by the Supreme Court of South Korea which ordered several Japanese companies to pay compensation to victims of Japanese forced labor during World War II. As a result, on July 1, 2019, Japan imposed restrictions on chemical exports to South Korea. South Korea accused Japan of violating international trade regulations concerning export restrictions. Therefore, South Korea took action by boycotting goods from Japan. The two countries resolved to remove each other from the whitelist of countries that obtain preferential trade status via their activities. The research method used is normative legal research with a case approach. The result shows that the trade war involving Japan and South Korea worsened bilateral relations. The World Trade Organization (WTO) carried out several mechanisms related to solving the problem, namely through consultation and conciliation involving the two countries, but it still needs to resolve the issue. It was also planned to establish a panel between South Korea and Japan by the WTO, but it has not been implemented until now and beyond the timeframe set by the WTO in establishing the Panel. Therefore, the study proposes that South Korea and Japan can initiate arbitration as a solution for another effort to resolve the problem because the arbitration mechanism obtains binding and final decisions.DOI: https://doi.org/10.22304/pjih.v9n3.a

    Kafala v. Human Rights Migrant Workers at the 2022 Qatar World Cup

    The research analyzes violations of human rights against immigrant workers at the 2022 Qatar World Cup. After receiving the privilege of hosting the 2022 World Cup, Qatar was faced with the problem of migrant workers, which has become a concern of the world community. Migrant workers who build infrastructure face discriminatory and exploitative treatment, and hundreds of migrant workers are found working on infrastructure development for the 2022 World Cup, where workers are affected by human rights violations by the companies where they work. The problem is due to the existence of the Kafala system, which is considered to be the root cause of all aspects of the migrant workforce in infrastructure development in Qatar through 2022. The research method used is normative legal research with a case approach. The results of the study show that the sponsorship kafala system implemented by Qatar only facilitates the occurrence of modern slavery through the exploitation of the rights of migrant workers. Therefore, the research examines Qatar\u27s actions on human rights violations and the International Labour Organization (ILO) accountability in efforts to influence policies related to migrant workers in Qatar

    Street Art en acción: del graffiti artesanal al soporte digital

    [EN] Graffiti includes different modalities which go from direct action –“Writing”, “Subway Art”, “Hip Hop Graffiti”I to indirect graffiti, promulgated on its own artistic field as “Stencil Art”, going through the new labels of “Postgraffiti”, “Neografitti”, “Street Art” or “Urban Art” of the end of the 0s, until the current animated graffiti, perhaps the last link of the chain, where craftwork finds a digital ally. We will analyse the work of some artists and illustrators who, not satisfied with only painting walls, have dedicated a long time and effort to create animations “stock motion” with graffiti. This is the case of Blue’s animated graffiti, or Insa’s animated Gifs, which can only be visualized in the Web. Other artists conceive the graffiti as an integral part of the work which afterwards will be envisioned in a different support from the wall in which it was gestated. As examples of it we find the photographs of Alexander Orion, also author of a performance of “urban cleaning” in Sao Paulo, or the interactive graffiti of Sweza, in which the interaction of a pedestrian provided with a QR code of a Smartphone is required to visualize the work the artist proposes. We will end up with a critical reflection around the esthetical and conceptual connotations of the handcrafted graffiti and the animated graffiti of last generation.[ES] El Graffiti incluye diferentes modalidades que van desde la acción directa -el Writing, el Subway Art, el Hip Hop Graffiti- al graffiti indirecto promulgado dentro del propio ámbito artístico como es el Stencil Art, pasando por las nuevas etiquetas de Postgraffiti, Neograffiti, Street Art o Arte urbano de finales de los 90, hasta el graffiti animado actual, quizás último eslabón de la cadena, donde la artesanía encuentra un aliado digital. Analizaremos la obra de algunos artistas e ilustradores que, no conformes solamente con pintar paredes, han dedicado mucho tiempo y esfuerzo a realizar animaciones ‘stock motion’ con graffiti. Tal es el caso de los graffiti animados de Blu, o los Gif animados de Insa, que sólo se pueden ver en la Web. Otros artistas conciben el graffiti como parte integrante de la obra que posteriormente será visionada en un soporte diferente al muro donde fue gestado. Son un ejemplo las fotografías de Alexander Orion, autor también de una performance de ‘limpieza urbana’ en San Paulo, o los graffiti interactivos de Sweza, en los que se requiere la interacción del peatón provisto de un lector QR de un smartphone para visualizar la obra que nos propone el artista.     [EN] In the present academic work is exposed the study realized on two paints which are entitled Holy Family, dated at the end of the 19th century and realized by José Estruch Martinez. Elaborating thereby a historical approximation to the author Jose Estruch Martinez and to Ferrer Estelles's legacy by which the pictures are located nowadays in the Real Colegio-Seminario of Corpus Christi of Valencia. It have been realized with an analysis to the iconography, to the composition, to technical information and to the conservation. Starting from a visual examination of the pieces of art, a photographic gathering and a bibliographical detailed consultation. It has developed a global vision of the paints and has established a proposition of conservation that assures the safeguard of these.[ES] En el presente trabajo se exponen los estudios realizados sobre dos obras tituladas Sagrada Familia datadas a finales del siglo XIX, realizadas por José Estruch Martínez.Elaborando así una aproximación histórica a su autor y al legado de Ferrer Estellés por el cual las obras se ubican actualmente en el Real Colegio-Seminario de Corpus Christi de Valencia. Se han realizado análisis a nivel iconográfico, compositivo, técnico y conservativo. Todos ellos partiendo de un examen organoléptico de las piezas, la realización de registros fotográficos y una consulta bibliográfica pormenorizada.     The role of density-dependence regulation in the misleading effect of the Aznalcollar mining spill on the booted eagle fecundity

    The aim of this study was to assess the exposure and potential effects of the toxic elements released by the Aznalcollar spillage on the fecundity of the booted eagle (Hieraetus pennatus) population of Doñana National Park. We measured As, Cd, Cu, Pb, Zn, Sb and Tl levels in the blood of 24 individuals after the accident and also used data of reproductive performance of the species from 1976 to 2000. While As, Sb and Tl were below their detection limits and only 3 samples were above detection limit for Cd (0.02–0.04 μg/dl), mean levels of Cu, Zn and Pb (μg/dl) were found to be 38.736, 532.937 and 0.719, respectively, in fledglings; and 66.112, 652.571 and 1.825, respectively, in adults. These levels were higher in adults, but they did not differ significantly between age classes and were at safe levels. In addition, a positive relationship between relative fecundity and the combination of Cu, Zn and Pb was observed. Following the mining spill, the mean population fecundity was lower (0.536 fledglings per pair in the population) than before (1.093). However, the decrease in fecundity over time was also related to the increase of breeding pairs, suggesting a density-dependent regulation and nullifying the mining spillage effect. Thus, although raptors have proved to be highly valuable biomonitors of environmental pollution, we must be especially cautious and go beyond the apparent effects that sometimes we quickly believe to detect, leading us to reach mistaken conclusions that could affect our management plans.This work was supported by funding from Fundación Migres through a collaboration project with Cobre Las Cruces, S.A.
