Le dol du tiers : du droit romain au nouveau livre 5 du Code civil
La réforme du droit des obligations s’est emparée de la question de l’incidence d’un vice de consentement causé par un tiers sur la validité d’un contrat conclu entre la victime du vice de consentement et son cocontractant. Jusqu’alors, seule la violence causée par un tiers constituait un motif d’annulation du contrat (art. 1111 C. civ. ancien). En cas de dol par contre, il était exigé que les manœuvres dolosives émanent du cocontractant, à l’exclusion du tiers (art. 1116 C. civ. ancien)

The development of normativity in international law: the use of historical discourse in Alberico Gentili’s De legationibus. – The aim of this article is to examine the sources used and the method employed by Alberico Gentili in his De legationibus, to elaborate a norm for the law of embassies. Although legal sources feature prominently in this treatise, the majority of them are derived from a variety of sources from Antiquity (historians, philosophers, rhetors, poets, etc.). Alberico Gentili mainly uses historical sources, and more specifically the exemplum, in his treatise. By mobilizing historical exempla alongside legal sources, the jurist created a rational normative system capable of responding to the diplomatic challenges of the sixteenth century brought about by constantly evolving practice
La coutume romaine à la fin de la République : une approche relationnelle
La prise en considération des textes littéraires dans l’analyse du phénomène coutumier à la fin de la République amène à repenser la coutume en termes de modes de la relation et, plus globalement, à s’interroger sur l’opportunité d’une approche relationnelle du droit romain.
L’analyse du mos et de la consuetudo en termes relationnels démontre qu’à la fin de la République, les substantifs désignaient deux notions encore distinctes, à savoir des modes de la relation. Alors que le mos présente dès l’origine une dimension normative puisqu’il vise un comportement strictement formalisé dans le cadre des rôles sociaux et est le fruit d’une obligation sociale nécessaire, la consuetudo exprime d’abord la fréquence des échanges sociaux avant de désigner la relation dont elle devient la condition.
Cependant, loin d’épuiser les questions relatives à la présence d’un paradigme relationnel, ces approches interrogent sur l’opportunité d’adopter une perspective relationnelle pour interroger ou réinterroger l’élaboration du droit dans le monde antique

Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
"Glocalisation" : définitions et applications actuelles
Over the past decades, colonialism has been heavily challenged by historical schools of thought breaking with imperialist and ethnocentric paradigms. These schools of thought promote pluricultural approaches to the political expansion of past societies from Antiquity up to the 20th century AD. They highlight the impact of local contingencies in the transformation of both the colonists and the indigenous communities. Romanization is no exception to this pattern. This century-old concept, which is clearly rooted in a modern colonial context, has provided a useful tool to describe the (diverse and often largely positive) impact of Roman rule in the provinces. However, recent methodological advances and new discoveries indicate the lack of consistency of this concept to describe the complexity of collective identities that emerged regionally and through time in the Roman world. Recent research indeed highlights the elusive character of “Roman culture”. Studying the transformations undergone by the conquered territories implies that one can securely identify the distinctive features of Roman culture, and the way these were perceived and adopted by indigenous communities. However, Roman civilization transformed over time as well as regionally, as a result of the expansion of the Roman territory and the granting of Roman citizenship. Both historical and archaeological records testify to the persistence of some local traditions after the Roman conquest and to their adoption by the Romans. These processes, labelled “cultural resistances” since the 1960s, denote the profound disruption of a societal system following the colonial intrusion, and the ability of this system to survive and assert itself within an exogenous (yet imposed) culture. While this concept does leave more room for the characterization of the conquered cultures, it implies a nucleated vision of the Roman world because the focus of most investigations is the province. It also reinforces a two-sided approach to the study of the Roman world, and thereby perpetuates the idea of a Roman supremacy. Since the early 2000s, several scholars have begun to reassess aspects of Roman religion and institutions through the prism of different concepts borrowed from the anthropology of mass-consumerism. One of these concepts is “glocalization” ; it has started to be used only a few years ago by a limited number of scholars in Roman Studies. It seems to have provided so far a satisfactory way to describe the Roman society as being both “global” (that is, homogeneous across the Roman territory) and “local” (regionally specific); namely, “glocal”. This society is seen as the result of the interconnection between one model originating from Rome and a range of indigenous practices persisting across the conquered territory

L’analyse des substantifs mos et consuetudo en termes relationnels démontre qu’à la fin de la République ceux-ci désignaient deux notions encore distinctes. Exprimée par mos, la dimension relationnelle relève d’une codification sociale, empreinte d’obligations évoluant suivant le rôle social adopté par les individus dans des circonstances déterminées. Par contraste, la consuetudo désigne un type d’amicitia fondé sur la fréquence de rapports sociaux. Le fondement relationnel de la coutume apporte ainsi un éclairage nouveau sur la dimension normative qu’elle est amenée à présenter. Cependant, loin d’épuiser les questions relatives à la présence d’un paradigme relationnel en droit romain, cette approche souligne l’opportunité d’adopter une perspective relationnelle pour interroger ou réinterroger l’élaboration du droit dans le monde antique
