Riflessioni comparative sulla riforma dell’arbitrato in Giappone

    No full text

Sensitivity analysis of analytically—corrected acoustic metamaterials into the spacetime domain

    No full text
The present work is focused on the sensitivity analysis of analytically–corrected acoustic metamaterials with respect to the variation of relevant parameters for aeronautical applications. The performance decay of acoustic metamaterials designed in static conditions when operating in a moving flow can be mitigated using a design process involving coordinate transformations capable of recasting the convective wave equation in the form of the static D’Alembertian. To this aim, a spacetime reformulation of the problem is needed in order to ensure the formal invariance of equations under the action of spacetime coordinate transformations. The considered test case sees a circumferential domain occupied by a metafluid embedded by a conventional medium characterized by a uniform background flow and within which a monopole source is located. All the numerical simulations are done in the frequency domain using the commercial finite element method solver. A parametric study is conducted to analyze the influence of the acoustic source position with respect to the background flow and the variation of the intensity of the latter

Going Beyond Counting First Authors in Author Co-citation Analysis

The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

State, Law, and Religious Syncretism in Japan: A Jurist's Perspective

    No full text
The foreign observer is often struck by how Japanese people practice different religion in a syncretic way. Most Japanese, in fact, define themselves at the same time Buddhist and Shintoist, and see no contradiction in that. From a legal point of view, it is interesting to analyze how the State has (or has not) intervened in this religious identity phenomenon, occasionally favoring Buddhism, Shinto, or taking a neutral stance. This paper carries out a diachronic analysis of the legislation on religion: starting from a succinct historical description, it also takes into account the most recent developments on the topic. The paper includes some decision by the Supreme Court of Japan on the principle of a lay State, and the criticism towards religious education in schools after the enactment of the 2006 Education Law

Nomophilacy and beyond: Comparative reflections on judicial precedents by supreme jurisdictions in Italy and Japan

    No full text
The issue of how civil law jurisdictions rely on precedents in the absence of a firm stare decisis rule is one of the most debated topics in comparative law. While most studies focus on the convergence of legal systems and/or rely on socio-legal reflections, this paper employs an institutional approach based on the comparison of the supreme courts of Italy and Japan, two civil law countries that share many similarities in history, perceptions of the civil litigation system, and eventual drift towards a quasi-precedential model. The study tries to demonstrate that even when there are no formally binding precedents, technical, procedural rules make supreme courts' decisions fundamental for the formation of norms. The analysis highlights the different weight each factor (i.e. structure and functioning of the supreme courts, reforms in civil procedure, access to justice) and actor (i.e. judges, scholars) has in the formation and application of precedents in Italy and Japan

GABAB receptor as therapeutic target for drug addiction: from baclofen to positive allosteric modulators

The present paper summarizes experimental and clinical data indicating the therapeutic potential of the GABAB receptor agonist, baclofen, in the treatment of alcohol use disorder (AUD) and substance use disorder (SUD). Multiple preclinical studies have demonstrated the ability of baclofen to suppress alcohol drinking (including binge – and relapse-like drinking), oral alcohol self-administration, and intravenous self-administration of cocaine, nicotine, amphetamine, methamphetamine, morphine, and heroin in rodents. Some randomized, controlled trials (RCTs) and case reports support the efficacy of baclofen in suppressing alcohol consumption, craving for alcohol, and alcohol withdrawal symptomatology in alcohol-dependent patients. Data from RCTs and open studies investigating baclofen efficacy on SUD are currently less conclusive. Interest in testing high doses of baclofen in AUD and SUD treatment has recently emerged. Preclinical research has extended the anti-addictive properties of baclofen to positive allosteric modulators of the GABAB receptor (GABAB PAMs). In light of their more favourable side effect profile (compared to baclofen), GABAB PAMs may represent a major step forward in a GABAB receptor-based pharmacotherapy of AUD and SUD

Yellow eels 15-18 cm and 22.25 cm total length. reared in fresh water at 22.24 °C and on commercial eel food, were treated with 17-alfa-methyltestosterone (MT) and with 17-alfa-ethynilestradiol (EE) given with the diet. A very high proportion of the untreated and the MT treated eels developed as males. A significantly high proportion of the EE treated eels with e high dose (1 mg/kg of food) differentiated as females. In 22.25 cm eels the effect was weaker
