The Problem of Legitimacy in the European Polity. Is Democratization the Answer?
Full text linkThe authors discuss potential sources of legitimacy of the EU, i. e. of the normative bindingness of its decisions. After rejecting the views that such legitimacy is either not needed, not feasible, or provided for already, they focus upon the corrosive impact of the EU upon democratic legitimacy within member states. Brussels-based 'governance' is essentially uncontested and can hardly provide for the legitimacy that results from the interplay between government and opposition within nation states. The problem boils down to achieving legitimacy in the absence of the political community of a 'demos'. The paper outlines a solution to this problem that relies on the apparently oxymoronic model of a 'republican empire' - a political community, that is, which is held together not by the bonds of some presumed sameness, but, to the contrary, by the shared contractual recognition of the dissimilarity of its constituent parts from which legitimacy can flow.democracy; legitimacy; diversity/homogeneity; governance; democratization

Between political power and the gears of capital: Claus Offe and the concept of selectivity of contemporary State institutions

In the work of Claus Offe, the concept of state selectivity plays a central role in his effort to explain the functioning of contemporary capitalism, which would have been consolidated, from the last century, according to the author, as different models of the Welfare State . In this sense, the present work will seek to investigate, starting from an acceptance of the existence of such a function of selectivity described by the German social scientist, whether this selectivity of State institutions would operate, in fact, from an internal logic of political organization on the way of production, or, rather, as a state imperative imposed by capitalist development in its contemporary stage, having its origin, therefore, in the market mechanisms themselves. We will start from the historical development of the relationship between political power and the organization of the workforce, working then on the concept of selectivity. In a third moment, we will analyze the actions of the contemporary State aimed at maintaining/expanding capital accumulation rates. Finally, we will address the two main contemporary accumulation paradigms, that is, Keynesianism and neoliberalism, their limits and the role of state actions in the functioning of such models.

Na obra de Claus Offe, o conceito de seletividade estatal cumpre papel central em seu esforço por explicar o funcionamento do capitalismo contemporâneo, que teria se consolidado, a partir do século passado, segundo o autor, como modelos diversos de Estado de Bem-Estar Social. Nesse sentido, o presente trabalho buscará investigar, partindo de uma aceitação da existência de tal função de seletividade descrita pelo cientista social alemão, se essa seletividade das instituições do Estado operaria, de fato, a partir de uma lógica interna de organização política sobre o modo de produção, ou, antes, como um imperativo estatal imposto pelo desenvolvimento capitalista em seu estágio contemporâneo, tendo sua origem, portanto, nos próprios mecanismos de mercado. Partiremos do desenvolvimento histórico da relação entre poder político e a organização da força de trabalho, trabalhando, em seguida, o conceito de seletividade. Num terceiro momento, analisaremos as ações do Estado contemporâneo voltadas à manutenção/expansão das taxas de acumulação do capital. Por fim, abordaremos os dois principais paradigmas de acumulação contemporâneos, isto é, o keynesianismo e o neoliberalismo, seus limites e o papel das ações estatais no funcionamento de tais modelos.
