No full textAbstract: The work treats of civil liability, damages and imputability. First the author explores the notion of imputability, liability and guilt and the “actiones liberae in causa”. Then it analyzes the autonomy between criminal and civil liability. Afterwards, the focus is on natural and legal incapacity: the younger age group and the mentally ill. Then the work analyzes the contributory negligence of the incapacitated person and the compensation of non-pecuniary damage. Imputability and strict liability is also considered. Afterwards, the work analyzes compensation for damages occasioned by incapable and the liability of parties responsible for negligent supervision. At last, the work examines the evidence release under Italian Civil Code article 2047 and the compensation when strict liability can’t be stated
Design for form postponement: do not overlook organization design
No full textPurpose - The purpose of this paper is to develop a theory of the organizational changes related to the production-planning process that facilitate application of form postponement (FP), an increasingly popular operations-design principle meant to alleviate the negative impact of product variety and customization on operational performance.
Design/methodology/approach - To achieve the theory-building objective, a multiple-case study involving four cases in the machinery industry was designed. In the inductive theory-building process, the authors borrowed from the information-processing theory to further corroborate the internal validity and generalizability of the findings.
Findings - The theory proposed by the author indicates that greater utilization of lateral relations in the production-planning process, higher production-planning frequency, greater degree of self-containment of the production-planning task, and simplification of the production planning-related environment favor application of FP.
Research limitations/implications - The level of analysis of the theory is the production-planning process of a product family within a company. Future research could extend inquiry of the organizational antecedents of FP at both higher and lower levels of analysis, such as the organization as a whole or the individuals participating in the production-planning process.
Practical implications - The theory supports managerial decision making by suggesting how to redesign the organization part involved in the production-planning process of a product family in order to apply FP. The difficulty and cost of this organizational redesign effort should be taken into account when companies consider FP implementation.
Originality/value - Past research has focused on changes to product design and to the manufacturing and supply chain process that enable FR This paper augments the understanding of FP enablers by developing the first model of organizational antecedents of FP. It also responds to calls for more research integrating insights from organization theory and operations/supply chain management

No full textO presente trabalho busca investigar a trajetória política de Cipriano Barata no
período compreendido entre a adesão da Bahia às Cortes de Lisboa até o ano de 1835, quando
o baiano encerrou a atividade de redator da série de periódicos intitulado Sentinela da
Liberdade. Busquei delinear como o periodista concebeu a organização do nascente Estado
nacional brasileiro, baseando-se na defesa da descentralização política da monarquia
constitucional portuguesa nas Cortes de Lisboa e no nascente Estado Imperial em 1823 e na
busca por reformas federativas no período regencial. O estudo procurou investigar o sentido
atribuído às noções de cidadania e de federalismo, assim como o conceito de nação nos
escritos do autor. A essas palavras foram atribuídos novos significados no período,
simbolizando a difusão de uma nova cultura política fundada no liberalismo. The present work search the investigate political trajectory of Cipriano Barata in the
period understood between the support of the Bahia the Court of Lisbon by the year 1835,
when the Bahia ended the series editor activity of periodic entitled Sentinel of Liberty. I
sought to outline how the journalist conceived Brazilian organization National State and
based on the defense of political decentralization of constitutional monarchy in Lisbon Courts
and the nascent Imperial State in 1823, and the search for federal reforms regency period. The
study sought to investigate the meaning attributed the notions of citizenship and federalism as
well as the concepts of nation present in the writings of the author. These words were
assigned new meanings in the period, symbolizing the propagation of a new political culture

No full textO presente trabalho procura estudar o sacramento da Eucaristia a partir de um documento patrístico. Para tal objetivo, utilizaremos como fonte o texto da Carta 63 de S. Cipriano de Cartago, considerado o primeiro “tratado” sobre a Eucaristia. Em atenção da coerência entre a Lex orandi e a Lex credendi, Cipriano bateu-se pela defesa da prática ritual e litúrgica da Igreja que, no cálice eucarístico, oferece vinho misturado com água, em nome do vínculo profundo entre cristologia, eclesiologia e sacramentologia. É o que mostraremos, relendo, traduzindo e estudando Carta 63 de Cipriano, procurando mostrar como o autor, embora mais pastor do que teólogo, argumenta e fundamenta a sua posição pastoral, em defesa da tradição litúrgica e eclesial. Nesta defesa, mais do que uma resposta meramente "canónica" ou circunstancial de um pastor atento aos "abusos litúrgicos", lemos uma cabal teologia eucarística, fundamentada biblicamente, onde está já implícito este posterior axioma: a Igreja faz a Eucaristia, tal como a eucaristia faz a Igreja. É sobretudo esta lucidez e atualidade teológica e pastoral que nos interessa no pastor africano do século III.The present study aims to examine the sacrament of the Eucharist from the perspective of patristic literature. For this purpose, we will employ as a source the text of Letter 63 from Saint Cyprian of Carthage, regarded as the earliest known “essay” on the Eucharist. Sensitive to the coherence between the Lex orandi and the Lex credendi, Cyprian struggled for the defense of the ritual and liturgical practice of the Church, which offers wine mixed with water in the eucharistic chalice, attending to the profound link between christology, eclesiology and sacramentology. In this paper, we will present, translate, and study the Letter 63 of Cyprian, seeking to demonstrate how, despite his pastoral rather than theological background, the author argues and justifies his pastoral position in defense of liturgical and ecclesial tradition. In this defense, rather than a mere “canonical” or circumstantial response from a pastor aware of “liturgical abuses”, we find a comprehensive Eucharistic theology, grounded in Scripture, which implicitly asserts that the Church makes the Eucharist, and that the Eucharist makes the Church. It is primarily this clarity and contemporary relevance at both theological and pastoral level that we seek to examine in this African pastor of the 3rd century

Beyond the bodice ripper: innovation and change in the romance novel industry
No full textRomance novels have changed significantly since they first entered the public consciousness. Instead of seeking to understand the changes that have occurred in the industry, in readership, in authorship, and in the romance novel product itself, both academic and popular perception has remained firmly in the early 1980s when many of the surface criticisms were still valid. Using Wendy Griswold’s (2004) idea of a cultural diamond, I analyze the multiple and sometimes overlapping relationships within broader trends in the romance industry based on content analysis and interviews with romance readers and authors. Three major issues emerge from this study. First, content of romance novels sampled from the past fourteen years is more reflective of contemporary ideas of love, sex, and relationships. Second, romance has been a leader and innovator in the trend of electronic publishing, with major independent presses adding to the proliferation of subgenres and pushing the boundaries of what is considered romance. Finally, readers have a complicated relationship with the act of reading romance and what the books mean in their lives. Understanding the enduring appeal of the happily ever after and the emotional escape are central to their enjoyment.Ph.D.Includes bibliographical referencesby Andrea Cipriano Barr
