Les cercueils de la maison funéraire Germain Lépine à Québec. La vitre du dernier regard : 1845-1945
L’auteure pose un regard neuf sur l’évolution des cercueils à Québec à partir du milieu du xixe siècle. Après avoir découvert deux spécimens en bois munis d’une vitre conservés de génération en génération par la famille de Cécile et Robert Lépine, elle consulte les archives de la maison funéraire Germain Lépine fondée en 1845 dans le quartier Saint-Roch et ayant eu sa place d’affaires au 715 rue Saint-Vallier Est jusqu’en 1975. Sa démarche permet de retracer différentes catégories de cercueils et de discerner le rôle que ceux-ci jouaient dans les rites mortuaires, notamment ceux des enfants et des adolescents.The author of this article takes a fresh look at the evolution of caskets in Québec City since the mid-nineteenth century. Having discovered that several generations of the Cécile and Robert Lépine family handed down two wooden caskets that each included a glass window, she consulted the archives of the Germain Lépine Funeral Home, founded in 1845. It stood at 715 Saint-Vallier East in the Saint-Roch district of Québec City until 1975. Her enquiry has uncovered different categories of caskets and also the roles they played in funeral rites, most notably after the deaths of children and adolescents
The political economy of hedge fund regulation
The currency crises and episodes of market unrest of the 1990s sparked a series of regulatory initiatives to reform the Global Financial Architecture. One of these initiatives tackled the activities of hedge funds, a type of investment vehicle that was frequently cited as one of the causes of these crises. The key research question of this thesis is why efforts to regulate an apparently destabilising aspect of financial markets failed, despite the setting up of an ad hoc forum at the international level (the Financial Stability Forum) and various domestic initiatives in the US, the country where most hedge funds operate.
The thesis develops a theoretical framework that examines this regulatory inaction through three explanatory models. The first model draws upon mainstream economic accounts and argues that the empirical evidence did not justify more interventionist public regulation of hedge funds. The second model assumes that a form of relational power has been exercised at the regulatory table: those actors with an interest in leaving hedge funds unregulated prevailed over those that favoured a more mandatory approach. The third model argues that it was not just relational power that determined outcomes, but mainly the power of the structure of meaning within which discussions took place and problems were framed. This structure of meaning led to a particular formulation of the problem at stake, which excluded other concerns and actors from the regulatory agenda.
Each model is analysed for its policy implications. The first model leads to regulatory solutions that rely upon private actors' due diligence and self-assessment of risk. The second model leads to policy options that favour a greater inclusion of developing countries and other stakeholder groups in decision-making processes in global finance. The third model leads to a rethinking of the very tenets of financial market regulation and of the financial theories used to explain and govern the market. The thesis argues that the third model is better able to grasp the complexity of power beyond the seemingly technical nature of financial regulation. For this reason, it is deemed more suitable to provide policy solutions that challenge the current neo-liberal framework of regulation
LGBTQ+ Rights and Legal Recognition in India: The Path Forward
Saurabh Kirpal, an Indian senior advocate, author, and LGBTQ+ rights activist, was born on April 18, 1972, the son of B. N. Kirpal, a former Chief Justice of India. Saurabh completed a bachelor’s degree in physics at St. Stephen’s College, Delhi, followed by law degrees from the University of Oxford and the University of Cambridge. After a short tenure with the UN in Geneva, he returned to India and has been practising law in the Supreme Court of India for over 20 years, specialising in civil, commercial, and constitutional law. Kirpal was also counsel for the landmark case decided in 2018 that decriminalised consensual same-sex relations in India. Kirpal has also been serving on the board of the Naz Foundation Trust, an NGO that advocates for LGBTQ+ rights. Kirpal was designated a senior advocate by the Delhi High Court in March 2021. Kirpal is in a long-term relationship with Nicolas Germain Bachmann, a Swiss human rights activist
L’évolution du droit des successions dans ses rapports avec la famille
Les principales étapes de l’évolution du droit des successions au Québec sont l’introduction de la liberté de tester, la loi de 1915 relative aux droits successoraux du conjoint survivant, l’accession récente de la famille naturelle à la vocation successorale et, enfin, la réforme globale du droit des successions, qui, quoique adoptée le 15 avril 1987, n’est pas encore en vigueur.L’auteur examine les éléments les plus significatifs de cette évolution, sous l’angle de la protection des intérêts de la famille, en mettant particulièrement en relief les changements qu’apporte le droit nouveau.The main steps of the law of succession in Quebec have been the introduction of the freedom of willing, the amendment to the Quebec Code in 1915 admitting the surviving consort as a legal heir, the recent accession of the natural members of the family to the abintestate succession and, finally, the global reform of the law of succession, which though voted on April 15, 1987, is not yet in force.The author analyzes the most meaningful elements of this evolution, from the viewpoint of the protection of the family, emphasizing particularly the changes brought about by the new law
Patient-Reported Outcome Measures for Fatigue in Patients on Hemodialysis: A Systematic Review
BACKGROUND:
Fatigue is a prevalent and debilitating symptom in patients receiving hemodialysis. We aimed to identify and evaluate the characteristics and psychometric properties of patient-reported outcome measures for fatigue in patients receiving hemodialysis, to inform the selection of a robust and feasible measure for use in randomized trials in hemodialysis. STUDY DESIGN:
Systematic review of outcome measures for fatigue. SETTING & POPULATION:
Patients receiving hemodialysis. SEARCH STRATEGY & SOURCES:
MEDLINE, Embase, PsycINFO, and CINAHL from inception to April 2017 were searched for all studies that reported fatigue in patients receiving hemodialysis. ANALYTICAL APPROACH:
With a focus on addressing methods, items (individual questions) from all measures were categorized into content and measurement dimensions of fatigue. We assessed the general characteristics (eg, number of items and cost) and psychometric properties of all measures. RESULTS:
From 123 studies, we identified 43 different measures: 24 (55%) were developed specifically for the hemodialysis population (of which 18 were nonvalidated author-developed measures for use in their study only), 17 (40%) for other populations, and 2 (5%) for chronic kidney disease (all stages). The measures assessed 11 content dimensions of fatigue, the 3 most frequent being level of energy (19 [44%]), tiredness (15 [35%]), and life participation (14 [33%]); and 4 measurement dimensions: severity (34 [79%]), frequency (10 [23%]), duration (4 [9%]), and change (1 [2%]). The vitality subscale of the 36-Item Short Form Health Survey (SF-36) was the most frequently used (19 [15%] studies), but has only been tested for reliability in hemodialysis. Of the fatigue-specific measures, the Chalder Fatigue Scale was the only one evaluated in hemodialysis, but the full psychometric robustness remains uncertain. LIMITATIONS:
For feasibility, we searched for validation studies in the hemodialysis population using the names of measures identified in the primary search strategy. CONCLUSIONS:
A very wide range of measures have been used to assess fatigue in patients receiving hemodialysis, each varying in content and length. Many have limited validation data available in this population. A standardized and psychometrically robust measure that captures dimensions of fatigue that are important to patients is needed to estimate and improve this disabling complication of hemodialysis
