The Research on Financial Services Dispute Settlement Scheme
近年隨著經濟發展,各類金融市場交易活動也日益頻繁。針對各類金融交易衍生之爭議,除透過耗費勞力時間費用之訴訟途徑解決外,如何因應金融爭議之特性,建置一迅速、簡便、公正、獨立、專業的訴訟外處理機制,亦是金融市場健全發展之重要輔助措施。
我國目前之金融消費爭議處理機制,消費者需按往來機構之類別,分別向銀行業、證券期貨業及保險業之不同申訴管道提出。而各業別之爭議處理管道不一,各管道之法源依據、處理流程及拘束力等均有差異,對消費者爭議解決之協助程度亦可能有別。
而英國為解決消費者與金融機構間之爭議,依據「2000年金融服務與市場法」(the Financial Services and Markets Act 2000,以下簡稱FSMA 2000)設立英國金融服務評議人機制(Financial Ombudsman Service,以下簡稱FOS),以獨立於金融主管機關之專家身分,協助解決相關金融消費爭議,提供消費者訴訟外爭議解決機制之選擇。
本文透過對英國FOS機制之組織架構、運作模式、處理範圍、功能及執行成效等方面加以分析,及就我國相關處理機制之運作及成效等加以研究,並檢討我國現行運作所遭遇之問題。從而比較我國相關金融消費爭議處理機制與英國制度之異同,以探討在我國現行金融環境及法規制度下,FOS制度引進我國之必要性及可行性,並研提將我國現行之金融消費爭議處理機制整合為類似FOS制度,即設立整合式專責爭議處理機構之可能方式。最後,本文提出對我國金融消費爭議處理機制未來可行之調整方向,其中包含短期與長期之建議,以期更即時有效地改善我國現行之處理機制,並提供我國金融主管機關未來研訂政策之參考。The disputes between financial institutions and consumers are different from other kinds of disputes. How to settle the financial service disputes in a quick, simple, fair and independent way is the important supporting measures for the sound development of the financial market.
In our country, the financial service disputes are settled depending on its financial industries, so that the consumers should claim their complaints to different organizations. However, the outcomes of the disputes vary because of the different bases of establishment, the type of organization, the procedure, and the enforcement of those organizations. In UK, the Financial Ombudsman Service, FOS, was set up by the Financial Services and Markets Act 2000, FSMA 2000, as an independent public body to help settle individual disputes between consumers and businesses providing financial services.
Therefore, this thesis focuses on the research and comparison of the function, procedure, responsibility and outcomes of the financial services disputes of the FOS in UK and the dispute settlement schemes in our country. This thesis intends to find out the problems of our dispute settlement schemes and the possible ways to establish such kind of integrated dispute settlement organization of UK. Based on the above analysis, the thesis proposes the short-term and long-term suggestions to effectively improve the financial services dispute settlement scheme in our country
A Raman probe for selective wrapping of single-walled carbon nanotubes by DNA
In this paper, we discuss nanotube diameter selectivity in DNA wrapping of single-walled carbon nanotubes (SWNTs) under high-shear sonication and present Raman evidence for the selective wrapping. The DNA wrapping induces an upshift (an increase in wavenumber) of the radial breathing mode (RBM) bands in the Raman spectra of SWNTs, which indicates strong interaction between nanotubes and DNA. The extent of the upshift correlates well with the change in the intensity of the RBM bands upon DNA wrapping, and larger upshifts correspond to larger intensity changes. The intensity changes represent wrapping selectivity, and differ from tube to tube due to varying diameters and electronic properties. The shift of the RBM bands thus represents a practical probe for wrapping selectivity and the extent of the shifts indicates different electronic structures of core nanotubes hybridized with DNA
Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
Variations on the Author
“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Dispelling the Myths Behind First-author Citation Counts
We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. We have done our best to complete the author checklist relating to the use of animals in the hut study. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
