KAJIAN YURIDIS AGUNAN YANG DIAMBIL ALIH (AYDA) OLEH BANK: KAJIAN YURIDIS AGUNAN YANG DIAMBIL ALIH (AYDA) OLEH BANK
Banks in providing credit to community always prioritize the principle of prudence, however, any credit that has been provided by the bank has a risk. To minimize the risk of non performing loan by the debtor, banks often require collaterals. The collaterals submitted by the debtor is mostly in the form of land rights which is then be charged to the Encumbrance Right. When the debtor can’t pay the credit, the bank can execute the encumbrace right certificate of the collateral. However, in the fact that the execution of the encumbrance rights is not as easy as imagined, there are many obstacles that occur, so the bank tries to find other alternatives for the settlement of non performing loan with the Foreclosed Collateral (AYDA) process. In this study the author tries to examine the settlement of non performing loan by the Foreclosed Collateral (AYDA) process in terms of Law On Encumbrance Right. The conclusion in this study is, that the settlement of non performing loans through Foreclosed Collateral (AYDA) process as regulated in article 12 A of the Banking Law has violated the provisions of articles 12 and 20 of the Law On Encumbrance Right. This type of research is a normative legal research with a statutory approach and a legal concept analysis approach. Keywords : non performing loan, bank, collateral, AYD

Effect of White Noise in Relieving Vaccination Pain in Premature Infants
The purpose of this study was to evaluate the effect of white noise as a distraction method in relieving procedural pain caused by vaccination for premature infants. This experimental study was performed at a neonatal intensive care unit (NICU) of a university hospital in Turkey between July and September 2013. The study population was composed of 75 premature infants (35 in the study group and 40 in the control group) who met the inclusion criteria. Premature infants in the study group were exposed to white noise using MP3 players placed at the head of the infants' open crib for 1 minute before vaccination. The white noise continued until 1 minute after vaccination. Premature infants in the control group were not exposed to white noise. The Premature Infant Information Form, Intervention Follow-up Form, and Premature Infant Pain Profile (PIPP) were used to collect study data. Descriptive statistics, chi-square test, and independent sample t-tests were used to evaluate the data. The pain level of the control group (PIPP = 14.35 +/- 2.59) was significantly higher than the pain level of the study group (PIPP = 8.14 +/- 3.14) (p < .05). The authors found that 67.6% of the infants in the study group had moderate pain during vaccination and only 2.9% had severe pain. Most of the infants in the control group (82.5%) had severe pain, whereas 17.5% had moderate pain (p < .05). White noise was found to be effective for this sample; however, there is a dire need for extensive research on white noise and its use with this vulnerable population. Peran Dan Tanggung Jawab Notaris Dalam Pembuatan Akta Terkait Pengambilalihan Agunan (Ayda) Sebagai Alternatif Penyelesaian Kredit Macet (Studi Kasus Pada Bank M Di Palembang)
This study discusses the role and the responsibility of a notary in making a deed related to the takeover of collateral (AYDA) as an alternative settlement of bad loans. Banks in channeling credit certainly need a notary as a bank partner who plays a role in making credit-related deeds. One of the settlements of bad loans at banks is by taking over collateral (AYDA), which is an asset obtained by the bank either through auction or outside the auction from the owner of the collateral, if the owner of the collateral/debtor is negligent in fulfilling his obligations. However, the implementation of AYDA often causes problems in settlement because the collateral is non-marketable, so that in the process of selling the collateral the bank has difficulty in disbursing it. The problems raised by the author are regarding the implementation of the settlement of bad loans at banks through the takeover of debtor\u27s collateral (AYDA); and the role and responsibilities of the Notary in making the deed related to the takeover of the debtor\u27s collateral. To answer this problem, a normative juridical legal research method with an explanatory typology is used. The data analysis was carried out qualitatively. The results showed that in the settlement of bad loans, the bank made an offer in the form of paying off all debtor\u27s debts, the debtor sold the collateral himself during the agreed time period or took over the credit to another bank, if the offer did not find results, the bank had to do AYDA. In the case of collateral that is difficult to disburse and cannot cover all of the debtor\u27s debt, the bank seeks to add additional collateral and make quick sales. Notaries as bank partners are responsible for the risks that arise in the deed they make. Therefore, a notary must be careful and uphold his professional ethics so as not to deviate from his authority
ABSTRACTThe Banking Law stipulates that the execution of collateral can be carried out in two ways, namely through auction or under the hand. In practice, selling by auction doesn't always work out quickly. The bank then takes steps to take over the collateral, namely by buying through auction (AYDA). AYDA on the transfer of land and/or buildings will result in tax obligations for banks in the form of BPHTB. In the Banking Law, a bank's obligation as a buyer can be postponed for a period of 1 (one) year until the bank finds an AYDA buyer. Therefore, the author wants to examine the fulfillment of BPHTB's obligations in the takeover of land and/or building collateral by banks through auctions and the legal certainty of delaying BPHTB obligations in the perspective of Banking Law and the HKPD Law. The research method used is normative juridical by examining problems based on library materials. This study uses a legal approach and a conceptual approach with descriptive analytical research specifications and qualitative juridical data analysis methods. Based on the results of research it can be concluded that according to the HKPD Law, the fulfillment of the outstanding BPHTB must be paid by the auction winner at the time of appointment of the auction winner, namely the date of the auction. Meanwhile, according to the Banking Law, the obligation of BPHTB can be suspended for 1 (one) year. The dualism of this arrangement gives rise to different interpretations in its application. The ways that can be done to overcome this are by interpreting and improving regulations. Improvements were made by revising the HKPD Law related to when BPHTB became payable and provisions for exemptions for banks regarding the payment of BPHTB on AYDA by banks through auctions. In addition, the mandate of the Banking Law to make a Government Regulation that regulates the procedure for purchasing collateral and its disbursement needs to be realized. Keywords: ayda through auction; bphtb; legal certainty
Validity and reliability of Turkish version of the scales of perceived stigma for children with epilepsy and their parents
Purpose: This study aims to establish a Turkish version of the scales of perceived stigma amongst children with epilepsy and their parents by adopting the scales developed by Austin et al. This study also aims to analyse the scales' validity and reliability in evaluating stigma perceptions amongst the aforementioned population. Methods: The population of this methodological study consisted of parents and 85 epileptic children between 9 and 16 years old. This population visited the paediatric neurology clinic of a hospital in Erzurum Province, Turkey, between April 2015 and January 2016. The scales of perceived stigma amongst children with epilepsy and their parents, as well as its Turkish version, were used as measuring tools. Experts were also consulted for their opinions. Meanwhile, Bartlett's test, Kaiser–Meyer–Olkin (KMO) index, exploratory factor analysis, principal component analysis, varimax rotation and scree plot test were used to determine the validity of the study. Moreover, the coefficients of Cronbach's α and Pearson's product-moment correlation were used to identify internal consistency, homogeneity and thus reliability. Results: Evaluations and analyses indicated that the Turkish version of the child and parent scales can be used with a single dimension. The mean scores of such scales were 24.02 ± 8.47 and 15.68 ± 4.04, respectively. All item-total score correlations of the child and parent scales were found to be significant (P < 0.05). The KMO coefficient of the child scale was 0.94, whereas the chi-square value of Bartlett's test of sphericity was significant at 209.311 (P < 0.05). Moreover, the KMO coefficient of the parent scale was found to be 0.80, whereas the chi-square value of Bartlett's test of sphericity was found to be significant at 209.311 (P < 0.05). The Cronbach's α coefficients were 0.95 and 0.87 for the child and parent scales, respectively. Conclusion: The Turkish version of the child and parent scales of perceived stigma is valid and reliable in measuring the perception of stigma amongst children with epilepsy and their parents.
