Since 2003 the Chapter on Italian Copyright Law in the Treatise is written and updated every year by A. Musso (M. Fabiani had written it through 2002). As well as all the other national chapters (plus a chapter on European Law and a general Introduction), the "Italian" chapter deals with the Italian Law on Copyright and related rights, updated every year with all the relevant new provisions and the main decisions of higher and lower courts. In this 23rd release, a substantial and deeper review/update off all the issues related to copyright or related rights has been made by the Author, especially on links with international subject-matter (e.g. comparison of terms), on-line uses and possible infringement by Internet Service Providers (with changes in the main index, too). Due to the many entries in alphabetical order, every new release is divided in two papery volumes: the entry "Italy" is in Volume 2
ITALY
From 2003 to 2016, Prof. Alberto Musso has written and up-dated every year this Chapter, priorly written by Prof. Mario Fabiani. In particular, since 2003, the Chapter has analyzed the main changes in Italian Copyright Law, both from European sources - the Italian implementation of Directive 2001/29/EC on the harmonisation of certain aspects of copyright and related rights in the information society (legislative decree N° 68/2003); of Directive 2001/84/EC on the resale right for the benefit of the author of an original work of art (Legislative Decree N° 118/2006); of Directive 2011/77/EU on the term of protection of copyright and certain related rights (Legislative Decree N° 22/2014); of Directive 2012/28/EU on certain permitted uses of orphan works (Legislative Decree N° 163/2014) - and from only national provisions (e.g. Articles 15, sec. 3, and 15-bis of the Italian Copyright Act on public performances of protected works in libraries, museums or cultural clubs.; the link with the Regulation of the Italian Authority on Communication about copyright protection on the net, pursuant to Article 32-bis of Legislative Decree N° 177/2005, and to Legislative Decree n° 9/2008 on audiovisual rights on sport events, etc.). These positive sources are always accompanied - also with criticism - by a wide description of case law and scholars' constructions of law and pratice of copyright and related rights in text and footnotes
This research has been conducted especially by examining the preaching of Cornelio Musso, one of the genre's most representative voices, not yet adequately studied. The interest in the figure and work of Musso lies not only in the role this Franciscan preacher played in doctrinal and spiritual spheres during the time of the Council, but also in the rhetorical and stylistic novelty of his sermons, in their humanistic background, in the relationships he held with the contemporary literary and cultural scene, especially in Padua and Rome, and, finally, in the contribution that his collections of sermons gave to the evolution of Italian prose
Conservation and Sustainability: the interconnection among natural and cultural values
The concept of sustainability is today widespread almost everywhere, but its meaning has different interpretations depending on the contexts in which it is used (environmental, social, economic). Sustainability is often talked about in terms of energy or materials requalification otherwise of the construction site processing, but this approach considers only a limited aspect of the sustainability and disregards the conservation problems.
Some misunderstandings relating to the concept of sustainability in conservation have recently been highlighted and today the balance of ecosystems, the social progress and the economic well-being are closely related to each other and cannot be seen separately. These issues must be seen in a broader context of sustainable development, in which the protection of cultural heritage plays a decisive role. However, although the concept of sustainability has very ancient roots, its relationship with culture still appears rather weak and not very concrete.
In the mid-nineteenth century John Ruskin already provided an important anticipation of the concept of sustainability, interpreted as the need to maintain resources without compromising the enjoyment rights of future generations. In his famous aphorism no. 29 he emphasized the responsibilities of each generation towards the following ones; these words already contain “in nuce” the essence of sustainability.
Although the positive impact of cultural heritage on the “four pillars of sustainable development” (economy, society, environment and culture) has been demonstrated by a recent study (Cultural Heritage Counts for Europe, 2015), actually the cultural issues still take up a marginal position in the policies of the 2030 Agenda .
Cultural heritage was long absent from the sustainable development debate, despite its relevance to human develop and its great potential to contribute to social, economic and environmental goals.
Starting from the relationship between conservation and sustainability – understood as the need to maintain resources without compromising the enjoyment rights of future generations – it seems necessary to consider the close interconnection between natural and cultural heritage in the city of Porto. The geographical location is indeed a strongly characterizing element and the conservation of architecture is inseparable from the landscape protection. An integrated approach is necessary to associate development (not only tourism progress, but socio-economic growth and well-being in general) with conservation, examining in a systemic way the features and the elements to be safeguarded together with the risks of damage or loss of natural and cultural resources
A first contribution to the history of Italian SETI
The first seminal paper about SETI, Searching for Interstellar Communications, published in Nature on 19 September 1959, was written by an American author, Philip Morrison, and another Italian, Giuseppe Cocconi. Nonetheless, from then on, for 30 years Italy has not taken part in the research that arose from that article. But in 1990 two Italian guys, Claudio Maccone and Stelio Montebugnoli, met while participating in the Bioastronomy meeting held in Val Cenis, and the history of Italian SETI began. From then on, the contributions by Italian investigators to search for extraterrestrial civilizations have constantly increased, both in number and quality, but so far nobody had tried to tell their history. In 2024, on the occasion of the IAC Milano 2024, a first contribution appeared, in a book written by myself (“Ascoltando l’infinito silenzio. L’Italia e la ricerca delle civiltà extraterrestri”), but which could count on several contributions from the main protagonists of Italian SETI. In this paper I present the main topics covered in the book and the possible future developments of this work
Effects of repeated hydraulic loads on microstructure and hydraulic behaviour of a compacted clayey silt
Soils used in earth constructions are mostly unsaturated, and they undergo frequent drying-wetting cycles (repeated hydraulic loads) due to changes in climatic conditions or variations of the ground water level, particularly at shallow depths. After compaction, changes in water content can significantly influence the hydromechanical response of the construction material, which therefore has to be assessed for repeated hydraulic loads. This research investigates the effect of such loads on the microstructure and hydraulic behaviour of a silty soil, typically used in the construction of embankments and dykes, with the aim of providing a better understanding of the consequences of drying-wetting cycles on the response of the material over time. Experimental tests were performed to study the impact of drying-wetting cycles on the water retention, hydraulic conductivity and fabric of compacted specimens. Fabric changes are documented to take place even without significant volumetric strains, promoting an irreversible increase in the hydraulic conductivity and a reduction in the capacity to retain water compared to the as-compacted soil. The fabric changes are interpreted and quantified by means of a hydromechanical model, which accounts for the evolving pore size distribution at different structural levels. The proposed model reproduces quite well the microstructural observations, together with the evolution of the water retention behaviour and of the hydraulic conductivit
