    L'actio quod metus causa: peculiarità e aspetti problematici legati alla tutela del soggetto al quale è stato indotto metus

    Nella prima parte della tesi è analizzata la clausola edittale sul metus riportata in D.4,2,1 e la fattispecie con essa tutelata; ci si chiede quali strumenti a tutela della vittima della violenza il pretore avesse introdotto con tale clausola edittale. La soluzione proposta è che anche l'a.q.m.c., insieme alla in integrum restitutio e alla exceptio metus, dipendesse dal ratum non habebo. Si considera, poi, la ricostruzione palingenetica del commento di Ulpiano all'editto sul metus, dalla quale emerge come il giurista tenti di circoscrivere le ipotesi in cui il metus fosse giuridicamente rilevante, fissandone i presupposti: gravità del male minacciato; contrarietà al diritto e illiceità della minaccia; serietà del male minacciato; effettiva formulazione della minaccia; esistenza di un danno; esistenza di un nesso causale diretto tra minaccia e negozio o comportamento estorto. Da ciò si evince come l'attenzione dei giuristi fosse concentrata sulla vittima della violenza, piuttosto che sull'autore della violenza, sulla violenza stessa e su chi fosse da considerare autore della violenza. Questa prospettiva, per certi versi nuova, pone il problema della funzione degli strumenti introdotti dal pretore e in particolare dell'azione. Nella seconda parte della tesi si studia l'a.q.m.c., che per le peculiarità delle caratteristiche tramandateci nella compilazione giustinianea è stata a lungo vista come il frutto della fusione postclassica tra la i.i.r. e l'a.q.m.c. classica, che sarebbe stata una pura azione penale. Inizialmente si esamina la “penalità” dell'a.q.m.c. e la funzione della pena prevista nella sua formula. Nell'a.q.m.c., nonostante la previsione nella formula di una condanna al pagamento del quadruplo, sono assenti diverse caratteristiche, riconducibili alle azioni penali in senso puro. Si propone, dunque, l'esame delle singole caratteristiche dell'a.q.m.c. per cercare di ricostruire la struttura della formula dell'azione e di conseguenza per determinarne la effettiva funzione. Si considera, per prima, la clausola restitutoria, la presenza della quale e l'importante ruolo ad essa assegnato nell'azione giustificano anche la collocazione dell'a.q.m.c. nell'editto, insieme alla i.i.r., sotto il titolo “De in integrum restitutionibus”. Questa caratteristica dell'azione può spiegare la possibilità di esercitare la stessa nei confronti del terzo di buona fede, possessore del bene estorto. Si considera, poi, l'ampia sfera dei soggetti passivamente legittimati all'a.q.m.c. Dallo studio delle fonti emerge che passivamente legittimati all'azione erano l'autore della violenza che avesse tratto un lucrum dal negozio estorto e il terzo ad quem res pervenit. L'a.q.m.c., così come la exceptio metus, era in rem scripta, pertanto l'attore nella intentio della formula avrebbe dovuto indicare soltanto il “fatto” che gli fosse stato indotto metus, e che in conseguenza di ciò il convenuto avesse tratto un lucrum. L'estesa legittimazione passiva conferma l'ipotesi che l'azione non fosse volta alla punizione dell'autore della violenza, ma piuttosto alla tutela della vittima di violenza. La struttura dell'azione, che emerge dallo studio delle sue caratteristiche, ne fa emergere la funzione: riportare la vittima della violenza nello status quo ante. In caso di mancata restitutio si giunge alla condanna al pagamento del quadruplo, nel quale è ricompreso, almeno a partire da Giuliano (D.4,2,14,9), il valore della res. L'estesa legittimazione passiva dell'azione e la sua funzione restitutoria non risulterebbe contraddetta dall'esistenza di un'azione in id quod ad eum pervenit nei confronti dell'erede dell'autore della violenza. La classicità della funzione soprattutto restitutoria dell'a.q.m.c. sembrerebbe trovare la conferma nei testi letterari contenenti informazioni sul primo strumento introdotto dal pretore a tutela della vittima di metus, la formula Octaviana, con la quale, come ricorda Cicerone, “Cogebantur Sullani homines quae per vim et metum abstulerant reddere”. Si conclude, quindi, che l'azione q.m.c. non fosse volta alla punizione dell'autore della vis, ma piuttosto al ripristino della situazione giuridica della vittima della violenza e che l'induzione di metus fosse considerata, da parte dei giuristi romani, non tanto come illecito da punire, ma piuttosto come un “fatto” che induceva un soggetto a porre in essere fatti o atti a lui svantaggiosi, così da rendere opportuna la tutela della vittima di minacce.In the first part of the thesis I investigate the edictal clause about metus ( D.4,2,1 ); I consider which remedies the praetor had provided for the victim of acts of duress or coercion with such clause. The solution I put forward is that also a.q.m.c., as well as the in integrum restitutio and the exceptio metus, was dependent from the ratum non habebo I consider next the palingenetic reconstruction of Ulpian's comment to the edict on metus, from which it emerges the jurist's attempt to define the cases in which the metus was to be taken as juridically relevant, by defining its requirements: the threatened evil had to be a serious one, the threat had to be contrary to the law; it had to be explicitly formulated, the plaintiff should have suffered an actual damage because of it, there had to be a direct causal link between the threat and the extorted negotium or behaviour. We can conclude that the jurists' focus was on the victim of the act of violence rather than on its author and on the act itself. Such a view, which is in some respects new, raises the problem of the function of the remedies defined by the praetor, and in particular of the action. In the second part therefore I focus on the a.q.m.c., whose features – as described in the Corpus Iuris Civilis - are so peculiar that the action has been long considered as the result of a post-classic fusion of the in integrum restitutio with the classical a.q.m.c.; the latter would have been a pure penal action. I consider first the issue of the penal profile of the a.q.m.c. and the function of the penalty in its formula. As a matter of fact, in the action several distinctive features of a typical penal action are missing. I examine therefore in details each feature of the a.q.m.c., so that I can try to reconstruct the structure of its formula, and its main function as a result. The first feature under scrutiny is the clause of restitution, whose presence and importance for the action are the reasons for the a.q.m.c. inclusion, together with the i.i.r., under the title “De in integrum restitutionibus” in the Digest. Such feature explains the possibility for the plaintiff to exert the action towards bona fide third parties, who had acquired the extorted thing. I also review critically the large number of subjects who could be sued with the action. From the sources it emerges that the plaintiff could sue the author of the coercion - if he gained a lucrum from the extorted negotium – but also a third party ad quem res pervenit. The a.q.m.c., as well as the exceptio metus, was in rem scripta; as a consequence, the plaintiff had only to declare, in the intentio of the formula, that he had acted because of fear, and that as a result the defendant had gained a lucrum. A passive legitimation so wide reinforces the hypothesis that the main aim of the action was the protection of the victim rather than the punishment of the author. The structure of the action, as it emerges from the study of its characteristics, clarifies its main function: to restore the victim in the status quo ante. Only if the restitutio does not occur, the payment of the quadruplum is required; it includes – at least since Julian (D.4,2,14,9) - the value of the res. Neither the wide passive legitimation nor its function of restitution look compromised from the existence of an action in id quod ad eum pervenit , to be used against the heir of the author of the violence. The classical origin of the restitutory function as the main aim of the a.q.m.c. looks confirmed in the literary sources which give some informations on the first remedy given by the praetor to the victim of metus, the formula Octaviana, using which “Cogebantur Sullani homines quae per vim et metum abstulerant reddere”, as reported by Cicero. I conclude therefore that the a.q.m.c. did not focus on the punishment of the author of the vis, but rather on the restoration of the juridical position of the victim of metus, and that the induction of metus was considered, by the Roman jurists, rather as a “fact” causing a person to estabilish acts or facts to his own disadvantage, than as a crime

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

    “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.     Dispelling the Myths Behind First-author Citation Counts

    We conducted a full-scale evaluative citation analysis study of scholars in the XML research field to explore just how different from each other author rankings resulting from different citation counting methods actually are, and to demonstrate the capability of emerging data and tools on the Web in supporting more realistic citation counting methods. Our results contest some common arguments for the continued use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more sophisticated methods

    We have done our best to complete the author checklist relating to the use of animals in the hut study. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used

    The article aims to reflect on the role of the words ‘nisi restituent’ in the edictal clause referred to by Ulpiano in 14 ad ed. D. 4.9.1pr., with which the praetor promised to grant of an actio de recepto. More specifically, the article investigates, also on the basis of other sources (including, in particular, Ulp. 14 ad ed. D. 4.9.3.5 and Ed. Theod. 119), whether the formula of the actio de recepto contained a restitution clause and, if so, what could have been the implications of such a presence, both from the perspective of the entrepreneur and from that of the customer.L’articolo si pone l’obiettivo di riflettere sul ruolo delle parole ‘nisi restituent’ nella clausola edittale riportata da Ulpiano in 14 ad ed.
