Introduzione al biodiritto: la bioetica nel diritto costituzionale comparato
L’obiettivo principale di questo lavoro consiste nel sottoporre a verifica critica, alla luce di tematiche e di casi specifici, alcune delle categorie che abitualmente si utilizzano nei ragionamenti giuridici dedicati alle questioni di bioetica. La prospettiva da cui condurre l’analisi – non solo a motivo della formazione personale di chi scrive, come si vedrà subito – non sarà quella della filosofia del diritto, area che finora ha nutrito gran parte della riflessione biogiuridica, ma quella del diritto costituzionale comparato. I principali riferimenti, quindi, non andranno a concetti come verità, bene, natura o verso le teorie dell’utilitarismo, relativismo, neocontrattualismo, principialismo, ecc., ma si rivolgeranno a previsioni costituzionali, a leading cases, a disposizioni normative e ad interpretazioni dottrinali tutte esaminate all’interno di un quadro di riferimento logico-concettuale riconducibile al diritto costituzionale ed al metodo comparato. PARVOVIRUS INFECTION AND KAWASAKI DISEASE: ONE DISEASE FOR TWO SIBLINGS
Introduction: Kawasaki disease (KD) is rarely described in siblings in the same time. In these cases, an infectious trigger must be excluded.
Objectives: We describe the clinical course of two brothers who showed severe KD all at once, secondary to Parvovirus infection.
Methods: A 9-month-old female showed fever, pallor, vomiting, bilateral non-secreting conjunctivitis, rash. Anamnesis revealed that 12 days before, she had fever, spontaneously resolved. At admission, 9 days after fever onset, she showed fever, conjunctivitis, pharyngitis, rash, and cervical adenopathy. Haematological parameters showed: leukocytosis, neutrophilia; anaemia; CRP: 2.31; ESR: 120. ECG and echocardiography were normal, including coronary Z-scores. She showed positive Parvovirus IgM. Spontaneous defervescence occurred. Further cardiological evaluation was performed to exclude a pericarditis secondary to Parvovirus, and at day 26 after fever onset, coronary artery lesions (CAL) were documented: proximal right coronary artery Z-score of 6.02; left main coronary Z-score: 5.72; left anterior descending Z-score: 5.78. The child was promptly treated with IVIG plus ASA. A further echocardiographic evaluation showed worsening of CAL, with a sacciform aneurysm in the left anterior descending artery (Zscore: 5.08). Laboratory test did not show inflammation; however, the girl was treated with 3 bolus doses of intravenous methylprednisolone (30 mg/kg/dose). The Z-score of CAL did not change and the patient was treated with anakinra (4 mg/kg/day), with a progressive improvement of CAL, and after 2 months, Z-scores normalized. The 7-year-old brother presented fever, vomiting at the same time of the sister, with spontaneous resolution after 4 days. Four days later, he presented again fever with abdominal pain, tachypnoea and tachycardia, secondary anuria. He had: leukocytosis, neutrophilia, anemia; CRP: 0.24; CPK: 773; creatinine: 0.77; BUN: 111; elevated myocardial necrotic enzymes (c-Troponin T: 91.4; Pro-BNP: > 70.000). Echocardiogram showed generalized hypokinesia, a severe reduction of the ejection fraction (EF) (20-25%); increased left atrium (Z-score: 3.3) and mitral valve with moderate insufficiency. He received dopamine, dobutamine, furosemide plus steroids. He showed a constant improvement of echocardiographic parameters, plasmatic enzymes and clinical signs. In 16th day he was discharged with an EF of 45% and persistent septal hypokinesia. However, specific serology anti-Parvovirus was tested and showed increased IgM, with negative IgG. The cardiological outcome revealed a progressive improvement of EF, which reached the 50%.
Results: CAL significantly improved after anakinra, at the contrary, the clinical evolution in the brother was different.
Conclusion: We describe familial KD in two siblings which had the same infectious trigger (Parvovirus). The brother was diagnosed as a post-viral myocarditis. However, considering the two parallel and different evolution, the girl showed late CAL with aneurisms, and the brother a Kawasaki shock syndrome picture with myocardial dysfunction. Viral illnesses are recognised trigger of KD, and in these cases the rareness is the coincident KD in two siblings, with different and severe clinical course. Noteworthy, the girl had aneurisms which resolved with anakinra, a therapy which has been recently shown to be promising for this disease. Present distribution of the threatened killifish Aphanius fasciatus (Actinopterygii, Cyprinodontidae) in the Maltese Islands
A survey of the nine localities from which the threatened Killifish Aphanius fasciatus has been recorded in the Maltese Islands showed that large and thriving populations exist at Salina, at the Simar and Ghadira bird sanctuaries and in reservoirs at Marsa and Ghadira. The Simar and Ghadira populations are introduced and originate from a mixture of animals collected from Salina and Marsa. The provenance of the Marsa population is unknown but it is possibly autochthonous to the Marsa area. The Salina and possibly the Marsa populations seem to be the only remaining natural populations of this species in the Maltese Islands.peer-reviewe
L’insegnamento del diritto comparato nelle università italiane: (aggiornamento dati: dicembre 2009) = The Teaching of Comparative Law in Italian Universities (data updated: December 2009)
Quanto spazio viene offerto al diritto comparato negli atenei italiani? Questo lavoro si propone di rispondere a questa domanda alla luce dei grandi cambiamenti che hanno investito il sistema dell’istruzione universitaria negli ultimi anni. Questo rapporto si basa sulle informazioni contenute nel database dell’offerta formativa gestito dal MIUR (http://offf.miur.it/index.html) e fa riferimento alla situazione aggiornata all’anno 2009. Il lavoro si propone anche di rispondere alle seguenti domande: ‐ In che modo il diritto comparato può garantire l’apprendimento delle conoscenze, abilità e competenze nelle varie classi di diplomi universitari? ‐ In che modo il diritto comparato diventa parte dell’istruzione del giurista? ‐ In che modo il diritto comparato può far parte del percorso formativo di studenti che non sono destinati ad intraprendere le tradizionali carriere del giurista di professione (avvocato, giudice, notaio)? ENGLISH ABSTRACT How much weight is given to Comparative Law in Italian universities? This work attempts to answer this question in light of the great changes that have affected the Italian higher education system in the recent years. This report is based on the information contained in the “offerta formativa database”, implemented by MIUR (Italian Minister for the Universities; http://offf.miur.it/index.html). While presenting a situation portrayed by MIUR data in 2009, this paper is also aimed at answering the following questions: ‐ How can comparative law ensure the learning of knowledge, skills and competences in the various classes of university degrees? ‐ How can comparative law become part of the jurist’s education? ‐ How can comparative law become part of the educational path of students who will not necessarily pursue the traditional careers of a professional jurist (lawyer, judge, notary)? Kawasaki disease triggered by parvovirus infection: An atypical case report of two siblings
Background: There are reports of the familial occurrence of Kawasaki disease but only a few reports described Kawasaki disease in siblings. However, the familial cases were not simultaneous. In these patients the idea of infective agents as trigger must be considered. Case presentation: We describe two siblings with atypical presentations of Kawasaki disease; the sister was first diagnosed as having parvovirus infection with anemia and the brother was diagnosed as having myocarditis. The first patient was a 9-month-old Caucasian girl with fever, conjunctivitis, rash, and pharyngitis, and later she had cervical adenopathy, diarrhea and vomiting, leukocytosis, and anemia, which were explained by positive immunoglobulin M against parvovirus. However, coronary artery lesions with aneurysms were documented at day 26 after fever onset. An infusion of intravenous immunoglobulin and high doses of steroids were not efficacious to resolve the coronary lesions. She was treated with anakinra, despite a laboratory test not showing inflammation, with prompt and progressive improvement of coronary lesions. Her 7-year-old Caucasian brother presented vomiting and fever at the same time as she was unwell, which spontaneously resolved after 4 days. Four days later, he again presented with fever with abdominal pain, associated with tachypnea, stasis at the pulmonary bases, tachycardia, gallop rhythm, hypotension, secondary anuria, and hepatomegaly. An echocardiogram revealed a severe hypokinesia, with a severe reduction of the ejection fraction (20%). He had an increase of immunoglobulin M anti-parvovirus, tested for the index case of his sister, confirming the suspicion of viral myocarditis. He received dopamine, dobutamine, furosemide plus steroids, with a progressive increase of the ejection fraction to 50%. However, evaluating his sister's history, the brother showed a myocardial dysfunction secondary to Kawasaki shock syndrome. Conclusions: We report on familial Kawasaki disease in two siblings which had the same infectious trigger (a documented parvovirus infection). The brother was diagnosed as having post-viral myocarditis. However, in view of the two different and simultaneous evolutions, the girl showed Kawasaki disease with late coronary artery lesions and aneurysms, whereas the brother showed Kawasaki shock syndrome with myocardial dysfunction. We stress the effectiveness of anakinra in non-responder Kawasaki disease and the efficacy on coronary aneurysms
CONSTRUÇÃO DE FORMAS ESTÉTICAS NA DRAMATURGIA DE DOC COMPARATO
In this work, we seek to point out authorship marks that permeate the dramaturgical work of Doc Comparato through Stylistic analysis. We use Genetic Criticism fundamentals to associate his process of construction of forms with the search for the aesthetic that guides his poetic project. Observing manuscripts, especially handmade, we can identify preferences, rejections and rhythmic recurrences in the author's way of writing. With this, we assume that the marks of authorship are composed of a combination of traits present in the genesis. Starting from the pragmatic understanding that the text is an object of communication and, in this way, takes into account the addressing of the work, we see in the erasures and choices moments of awareness of what one wants to say and how it will be said. The construction of an expressive form involves stylistic choices that characterize the author and his essence. Among the traits that add up to the understanding of authorship marks in Doc Comparato’s plays, we highlight its rhythm of genesis, main references and influences, aesthetic defenses, recurring themes and characteristics of the autograph manuscripts.Neste trabalho, buscamos apontar marcas de autoria que permeiam a obra dramatúrgica de Doc Comparato por meio da análise Estilística. Utilizamos fundamentos da Crítica Genética para associar seu processo de construção de formas à busca da estética que norteia seu projeto poético. Observando manuscritos, especialmente os autógrafos, podemos identificar preferências, rejeições e recorrências rítmicas no modo de fazer do autor. Com isso, presumimos que as marcas de autoria são compostas por uma combinação de traços presentes na gênese. Partindo da compreensão pragmática de que o texto é um objeto de comunicação e, desta forma, leva em consideração o endereçamento da obra, vemos nas rasuras e escolhas momentos de tomada de consciência do que se deseja dizer e de forma será dito. A construção de uma forma expressiva passa por escolhas estilísticas que caracterizam o autor e sua essência. Dentre os traços que somam para a compreensão das marcas de autoria nas peças teatrais de Doc Comparato, destacamos seu ritmo de gênese, principais referências e influências, defesas estéticas, temáticas reincidentes e características dos manuscritos autógrafos
Il diritto comparato nella giuspubblicistica britannica dall'inizio dell'Ottocento alla prima guerra mondiale
The essay develops an analysis of the history of comparative law within the UK scholarship between the Nineteenth and the Great War. It specifically focuses on the thought of Jeremy Bentham, John Austin, John Stuart Mill, Henry Sumner Maine, Walter Bagehot, Frederick Pollock, Frederic William Maitland and Albert Venn Dicey. The Author argues that although in those years academic teaching of comparative law had not yet acquired stability within British universities, legal doctrine addressed comparative studies contributing to the development of comparative methodology. Moreover, the century of full industrialization and democratization was characterised by structural elements acting as incentives if not directly to the growth of the comparative sensitivity, at least to the formation of favourable conditions for comparative studies
Seleção Lexical no Processo Criativo de Doc Comparato
Lexicographical words represent things - physical or abstracts - and are also plenty of expressive shapes, which are socially built. The grammatical use of words disseminates denotative meanings and metaphorical effects that engage emotions. The context in which words are placed creates a feedback cycle between the sign and the psychic images that it evokes. Through the analysis of the manuscripts of the Brazilian dramatist, Doc Comparato, we shall observe the movements of experimentation and lexical choice along the creative process of his writing of the script Jamais (Never) - also called Calabar or A tribute to the treason. We are going to verify the changes on the effects of meaning by comparing the reviews applied to the text, following the author\u27s search for the grammatical shape that gives life to the idea. In order to analyze the metamorphosis of the writing process we shall use the fundaments of Genetic Criticism and the Stylistic to evaluate the results reached by the author - considering that a dramaturgical text is made to be staged and, for being so, must predict the impact of the sounds of words and also the actions that follow them.Palavras lexicográficas significam coisas - materiais ou abstratas - e também são carregadas de contornos expressivos atribuídos socialmente. O emprego gramatical dos vocábulos veicula sentidos denotativos, mas também é capaz de alçar efeitos metafóricos, acionadores de emoções. O contexto em que as palavras se inserem gera um sistema de retroalimentação entre o signo e as imagens psíquicas que ele evoca. Por meio da análise de manuscritos do dramaturgo Doc Comparato, vamos observar o movimento de experimentação e seleção de palavras no processo de criação do roteiro da peça Jamais (também chamada de Calabar ou O elogio à traição). Verificaremos as alterações nos efeitos de sentido comparando os tratamentos dados ao texto, acompanhando a busca do autor pela forma gramatical que dará vida à ideia. Vamos aplicar os fundamentos da Crítica Genética, para analisar as metamorfoses no processo de escritura, e a Estilística, para avaliar os resultados alcançados pelo autor - considerando que o texto dramatúrgico é escrito para ser encenado e, assim, deve prever o impacto sonoro das palavras e também as ações que as acompanham
