No full textIl saggio esplora il confronto tra la legittimazione ad agire per il risarcimento del danno
ambientale in Francia e in Italia, evidenziando un approccio giuridico divergente. La Francia,
attraverso il concetto di préjudice écologique pur, riconosce una legittimazione diffusa a enti pubblici,
associazioni ed enti collettivi, promuovendo una giustizia ambientale partecipativa. L’Italia, invece,
adotta un modello più centralizzato, conferendo allo Stato un ruolo predominante nel perseguire il
risarcimento del danno ambientale puro, limitando la possibilità di intervento di altri soggetti solo
laddove si tratti di préjudice écologique derivé. L’analisi evidenzia come il modello francese sia più
democratico e inclusivo rispetto all’impostazione italiana, che potrebbe beneficiare di una maggiore
apertura alla società civile per una tutela ambientale più capillare ed efficace.This paper explores the comparison of legal standing for compensation for
environmental damage in France and Italy, highlighting a divergent legal approach. France, through
the concept of préjudice écologique pur, grants widespread standing to public bodies, associations
and collectives, promoting participatory environmental justice. Italy, on the other hand, adopts a
more centralized model, giving the State a predominant role in pursuing compensation for pure
environmental damage, limiting the possibility of intervention to territorial entities, individuals and
associations only where préjudice écologique derivé is involved. The analysis shows that the French
model is more democratic and inclusive than the Italian approach, which could benefit from greater
openness to civil society for more widespread and effective environmental protection
