    I contributi raccolti in questo Volume ruotano tutti attorno allo stesso tema della mobilità del lavoro e delle persone nell’Unione europea. La diversità degli approcci con cui il tema è affrontato rispecchia in parte la particolare sensibilità degli Autori, in parte la loro provenienza disciplinare: se gli studiosi del diritto dell’UE si concentrano sull’evoluzione (o “involuzione”) della giurisprudenza (Bartoloni) e del diritto derivato dell’Unione, con particolare attenzione ai clivage tra Stati membri affioranti nel difficoltoso processo di riforma (Costamagna, Morsa), i giuslavoristi (Borelli e Orlandini) intrecciano le analisi delle trasformazioni del diritto europeo con le prassi di istituzioni pubbliche nazionali, imprese transnazionali e lavoratori, alla ricerca di maggior effettività di tutela di questi ultimi; il costituzionalista (Menéndez), infine, predilige lo sguardo storico e ordinamentale complessivo, all’interno del quale l’evoluzione della disciplina europea della libera circolazione delle persone non è che un elemento – sia pure assai significativo – del più ampio processo di svuotamento del costituzionalismo democratico-sociale uscito dal secondo conflitto mondiale

    The National Labour Policies in the context of the Europe 2020 strategy and of the European Economic Governance, by Silvia Borelli The author presents the main priorities of the Europe 2020 strategy and the different steps of the European Semester of the European Economic Governance. The system of the European measures to solve the economic crisis is completed by the analysis of the “Six Pack”, the EuroPlus Pact and the Treaty on Stability, Coordination and Governance. The author clarifies how the European Employment Strategy has been fully absorbed by the European Economic Governance. After considering some of the new European economic framework’s consequences on Member States’ labour policies and on social dialogue, the author focuses on the recent review of Italian labour policies, performed by European Commission as part of the European Semester

    Since 2001, « quality of employment » has been at the core of the political, academic and practical agenda, and has fed a wide-ranging debate. For the first time, a scientific work takes stock of legal and normative understanding of quality of employment in Europe. In order to develop an interdisciplinary dialogue, the book underlines the importance of law in the debate on quality of employment and suggests to adapt European concepts and tools, with the purpose of enriching the scientific reflection by a rigorous legal approach. To this end, the authors analyse the relevance of the concept of quality of employment in international, European and comparative law, considering several topics such as collective and labour rights, social security, non-discrimination and equality at work. Moreover, from «Capabilities» perspective, the authors propose concrete and realistic paths for maintaining the European concept of quality of employment and European social Law in the framework of ILO Decent Work Agenda
