    «Внутренне перемещенные лица» как категория теоретизирования и социальной практики

    У статті розглядається феномен вимушеної внутрішньої міграції, а саме такого його наслідку, як виникнення певної групи населення – внутрішньо переміщені особи (ВПО). Обґрунтована необхідність концептуалізації поняття «внутрішньо переміщені особи». Термін «внутрішньо переміщена особа» розглянуто в перспективі його виникнення та подальшого становлення як категорії теоретизування та соціальної практики; проведено його розмежування з поняттями «біженець» та «економічний мігрант»; виділені два основних незмінних критерія, що характеризують внутрішнє переміщення та розглянуто поняття «затяжне внутрішнє переміщення». Виділено найбільш поширені напрямки вивчення ВПО, що представлено в іноземних та вітчизняних дослідженнях. Проаналізовано теорії міграції, які були адаптовані до проблематики вимушеної внутрішньої міграції. Показано евристичний потенціал певних соціологічних теорій, а саме – теорії самоактуалізації А. Маслоу, теорії категорізації Г. Тежфела та Дж. Тернера, теорії акультурації (адаптації) Дж. Беррі, теорії травми соціальних змін П. Штомпки, теорії інкультурації, що можуть скласти основу для створення окремої концептуальної рамки досліджень щодо вимушеного переміщення та внутрішньо переміщених осіб.The author analyzes the works of foreign and Ukrainian researchers, emphasizing there is need to theorize this concept. In Ukrainian and foreign discourses, much attention is paid to empirical studies of IDP, but there are no work in which the nature of this phenomenon is explained by theories and concepts. Therefore, the purpose of this article is to conceptualize the concept of IDP. This concept has been actively used since the beginning of the 1990s, despite the fact that about 10 million people were drawn to forced labor or expelled from their country for racial, religious or political reasons during the Second World War. The author highlights two unchanging characteristics of the IDP phenomenon: the involuntary nature of the movement, migration inside of the national borders. IDP is much broader than the refugee concept, it involves displacement because of certain natural disasters and development projects. IDP differs from the concept of an economic migrant by means of the nature of migration. For IDP, it is characteristic of pushing migration, for the economic migrants is attractive way of migration. The article also describes the phenomenon of protracted internal displacement. The author considers certain theories trough that IDP can be investigated. It should be noted, that there are practically no theoretical approaches among the migration theories that are devoted exclusively to the conceptualization of the phenomenon of internally displaced persons, because most theories deal with interstate migration. Migration theories have been adapted to the issues of IDP in this paper. Among them: push / pull theory, the theory of migration systems (networks), the concept of a three-stage migration process. The article emphasizes that these theories can be used for studying IDPs, but not in the dimensions of «the country of departure – the country of arrival», but in the «regional» dimension of a particular country. Also among the theories are fruitful for consideration IDPs: A. Maslow’s theory of self-actualization, the theory of categorization by H. Tajfel and J. Turner, the theory of acculturation (adaptation) J. Berry, the theory of the trauma of social changes by P. Sztompka, the theory of inculturation. The author make a conclusion on the necessity of further comprehensive sociological research on IDPs and the using of a disciplinary approach.В статье рассматривается феномен вынужденной внутренней миграции, а именно такого его последствия, как возникновение определенной группы населения – внутренне перемещенные лица (ВПЛ). Обоснована необходимость концептуализации понятия «внутренне перемещенные лица». Термин «внутренне перемещенное лицо» рассмотрено в перспективе его возникновения и дальнейшего становления как категории теоретизирования и социальной практики; проведено его разграничение с понятиями «беженец» и «экономический мигрант»; выделены два основных неизменных критерия, характеризующих внутреннее перемещение и рассмотрено понятие «затяжное внутреннее перемещение».Выделены наиболее распространенные направления изучения ВПО, что представлено в иностранных и отечественных исследованиях. Проанализированы теории миграции, которые были адаптированы к проблематике вынужденной внутренней миграции. Показано эвристический потенциал определенных социологических теорий, а именно – теории самоактуализации А. Маслоу, теории категоризации Г. Тежфела и Дж. Тернера, теории аккультурации (адаптации) Дж. Берри, теории травмы социальных изменений П. Штомпки, теории инкультурации, которые могут составить основу для создания отдельной концептуальной рамки исследований по вынужденному перемещению и внутренне перемещенных лицах

    Deep Reinforcement Learning Environment Approach Based on Nanocatalyst XAS Diagnostics Graphic Formalization

    The most in-demand instrumental methods for new functional nanomaterial diagnostics employ synchrotron radiation, which is used to determine a material’s electronic and local atomic structure. The high time and resource costs of researching at international synchrotron radiation centers and the problems involved in developing an optimal strategy and in planning the control of the experiments are acute. One possible approach to solving these problems involves the use of deep reinforcement learning agents. However, this approach requires the creation of a special environment that provides a reliable level of response to the agent’s actions. As the physical experimental environment of nanocatalyst diagnostics is potentially a complex multiscale system, there are no unified comprehensive representations that formalize the structure and states as a single digital model. This study proposes an approach based on the decomposition of the experimental system into the original physically plausible nodes, with subsequent merging and optimization as a metagraphic representation with which to model the complex multiscale physicochemical environments. The advantage of this approach is the possibility to directly use the numerical model to predict the system states and to optimize the experimental conditions and parameters. Additionally, the obtained model can form the basic planning principles and allow for the optimization of the search for the optimal strategy with which to control the experiment when it is used as a training environment to provide different abstraction levels of system state reactions

    Quantitative Structural Description of Zeolites by Machine Learning Analysis of Infrared Spectra

    Application of machine learning (ML) algorithms to spectroscopic data has a great potential for obtaining hidden correlations between structural information and spectral features. Here, we apply ML algorithms to theoretically simulated infrared (IR) spectra to establish the structure-spectrum correlations in zeolites. Two hundred thirty different types of zeolite frameworks were considered in the study whose theoretical IR spectra were used as the training ML set. A classification problem was solved to predict the presence or absence of possible tilings and secondary building units (SBUs). Several natural tilings and SBUs were also predicted with an accuracy above 89%. The set of continuous descriptors was also suggested, and the regression problem was also solved using the ExtraTrees algorithm. For the latter problem, additional IR spectra were computed for the structures with artificially modified cell parameters, expanding the database to 470 different spectra of zeolites. The resulting prediction quality above or close to 90% was obtained for the average Si–O distances, Si–O–Si angles, and volume of TO4 tetrahedra. The obtained results provide new possibilities for utilization of infrared spectra as a quantitative tool for characterization of zeolites.</i

Відправним є тези про існування основного та додаткового зобов’язання і їх належне виконання зобов’язання. Встановлено, що ідея появи досліджуваних інститутів завдячує потребі в надійному виконанні зобов’язань, гарантуванні інтересів кредитора. Вона у подальшому збагатилось під впливом економічних та соціальних процесів, становлення самого цивільного права як універсального засобу регулювання товарообороту та забезпечення недоторканності власності. Термінологічний різнобій у тлумаченні чим забезпечується виконання зобов’язань спричиняє складнощі у правозастосуванні і є неприпустимим. Дисертант вважає що забезпечення належного виконання зобов’язань – передбачені нормами чинного законодавства та застосовані сторонами зобов’язання додаткові обтяжуючі інститути цивільного права, що спонукають боржників до належного виконання їхніх юридичних обов’язків шляхом можливості застосування до них чи третіх осіб у зобов’язанні визначених сторонами зобов’язання чи законом мір майнового впливу. Передбачені ЦК види забезпечення виконання зобов’язань різні за підставами виникнення, ступенем впливу на боржника, засобами досягнення мети, наслідками для кредитора та інших учасників забезпечувального зобов’язання. Автор виділив чотири групи видів забезпечення виконання зобов’язань: 1) загально цивілістичні; 2) спеціальні (галузеві); 3) інституційні; 4) подвійного призначення. Види забезпечення зобов’язань синхронізовані із підставами їхнього виникнення.The dissertation deals with the research of types of providing proper fulfillment of obligations in Civil Law. The basics for the research were the theses on the existence of main and additional obligations and the necessity of their proper fulfillment. It has been examined that the idea of emergence of the institutions had been predetermined by the necessity to stabilize commodity turnover especially in proper fulfillment of obligations, guarantee interests of a creditor. Subsequently it was enriched under the influence of economic and social processes in the making of Civil Law as a universal means of adjusting commodity turnover and ensuring inviolability of property. There exists a terminology discord in interpretation by what is provided implementation of obligations causes the interpretation what providing of obligations is ensured with and it causes impermissible difficulties. The candidate for Law Sciences holds that providing proper fulfillment of obligations envisaged by the standards of standing legislation other institutions of civil law used by the parties of obligation induce debtors to perform their legal duties property as there is a threatening possibility of application to them or third persons in the obligation of certain by the sides of executing towards them or third persons in the obligation determined by the parties of obligation or law measures of property influence. According to the Civil Code of Ukraine types of providing fulfillment of obligations are different in their background, extent of influence on a debtor, means for achieving goal, consequences for a creditor and other parties involved in the fulfillment of obligation. Differentiation of types of providing proper fulfillment of obligations is based on the system of obligation law. The author distinguishes four groups of types of providing obligations: 1) general civilian; 2) special (branch) envisaged by the acts of civil law; 3) institutional; 4) two-aimed (a type of obligations and it ensures the interests of the parties in other obligations or other civil law relations.Диссертация посвящена исследованию видов обеспечения надлежащего исполнения обязательств в гражданском праве. Отправными для исследования стали тезисы о существовании основного и дополнительного обязательства и объективной необходимости их надлежащего исполнения. Установлено, что идея появления исследуемых институтов предопределена потребностями стабилизации товарооборота, особенно в надлежащем исполнении обязательств, гарантированости интересов кредитора. Впоследствии она обогатилась под воздействием экономических и социальных процессов, становления самого гражданского права как универсального средства регулирования товарооборота и обеспечения неприкосновенности собственности. Обращено внимание на существование терминологических разногласий в толковании чем обеспечивается исполнение обязательств, что вызывает сложности в правоприменении, а при наличии формализованного дуализма частного права приводит к противоположным решениям по однотипным делам, что является недопустимым. Диссертант считает, что обеспечение надлежащего исполнения обязательств – предусмотренные нормами действующего законодательства и примененные его сторонами дополнительные институты гражданского права, понуждающие должников к надлежащему выполнению их юридических обязанностей под угрозой возможности применения к ним или третьим лицам в обязательстве определенных сторонами обязательства или законом мер имущественного воздействия. Предусмотренные ГК Украины виды обеспечения исполнения обязательств разные за основаниями возникновения, степенью влияния на должника, средствами достижения цели, последствиями для кредитора и других участников обеспечительного обязательства.     Measuring the viscous flow behaviour of molten metals under shear

    This thesis was submitted for the degree of Doctor of Philosophy and awarded by Brunel University.The flow behaviour of liquid metals (Sn, Pb and Sn-Pb eutectic) under different shearing conditions is investigated. Experiments were performed with two designs of concentric cylinder viscometers: rotating the inner cylinder (Searle) and rotating the outer cylinder (Couette). The latter technique is uncommon and the equipment was optimised with standard oils. The flow behaviour for the metals differs in the two systems. The curves of “apparent” viscosity versus shear rate may be divided into two regimes: I. At lower shear rates (<200 s-1): a reduction of “apparent” viscosity with shear was observed with both viscometers. It is suggested that the high density and high surface tension of the metals and eccentricity between the cylinders at low shear rates, leads to instabilities. Results at low shear rates were therefore discarded and further detailed analysis would be required for a fuller understanding of this behaviour. II. At higher shear rates: a steady, shear-independent behaviour of “apparent” viscosity with shear rate is observed in the Couette system (upto 600 s-1) whereas in the Searle system the “apparent” viscosity increases with shear rate (upto 2600 s-1). From hydrodynamic theory about Newtonian fluids, it is suggested that in the Searle type viscometer, the fluid is unstable and Taylor vortices are expected at low shear rates (~80 s-1). This gives rise to an increase in the “apparent” viscosity with shear rate. Whereas, in the Couette type, the flow is more stable, resulting in a steady “apparent” viscosity. This interpretation is consistent with liquid metals behaving as Newtonian fluids, but further research is required to confirm this. The author suggests further experiments, with the prime one being the investigation of the fluid with counter and co-rotation of the cylinders in order to observe more complex flows. The results are expected to have implications in the modelling of flow for liquid metal processes, especially the initiation of Taylor vortices under the unstable flow conditions produced by rotating the inner cylinder

    Державне регулювання у сфері обігу віртуальних активів в Україні

    У статті досліджено правові норми для визначення заходів державного регулювання діяльності учасників ринку віртуальних активів в Україні. Проаналізовано норми Закону України від 17 лютого 2022 року № 2074-ІХ «Про віртуальні активи». Зазначається, що до учасників ринку віртуальних активів законодавець відніс надавачів послуг, пов’язаних з обігом віртуальних активів, і користувачів таких послуг. Послуги, пов’язані з обігом віртуальних активів, включають послуги зі зберігання або адміністрування віртуальних активів або ключів віртуальних активів, послуги з обміну віртуальними активами, послуги з передачі віртуальних активів, посередницькі послуги, пов’язані з віртуальними активами. Автор наголошує, що діяльність постачальників послуг, пов’язана з обігом віртуальних активів, дозволяється лише за умови отримання дозволу на надання послуг, пов’язаних з обігом віртуальних активів відповідного виду. Крім того, встановлено розмір плати за видачу дозволу на надання послуг, пов’язаних з обігом віртуальних активів, для резидентів і нерезидентів України та зазначено, що видача такого дозволу здійснюється відповідно до у порядку, встановленому Національною комісією з цінних паперів та фондового ринку. При цьому незрозуміло, що саме мав на увазі законодавець під «дозволом». Враховуючи, що за такий дозвіл надавачі послуг, пов’язані з обігом віртуальних активів, повинні будуть заплатити певну суму, автор припускає, що це буде «державний дозвіл на право надання послуг, пов’язаних з обігом віртуальні активи» і для його отримання надавачі послуг повинні будуть відповідати певним умовам, встановленим відповідним державним органом. Це свідчить про те, що український законодавець запроваджує ліцензування надавачів послуг, пов’язаних з обігом віртуальних активів, хоча чомусь не вживає термін «ліцензування». Цей факт також підтверджується встановленими цим Законом вимогами до осіб, які планують провадити діяльність з надання таких послуг, які за своєю суттю є «ліцензійними умовами». Вимоги до порядку отримання «дозволу» аналогічні вимогам до порядку отримання ліцензій, закріплених у Законі України від 02.03.2015 № 222-III «Про ліцензування видів господарської діяльності». Підкреслено, що діяльність постачальників послуг, пов’язаних з обігом віртуальних активів, допускається виключно за умови отримання дозволу на надання послуг, пов’язаних з обігом віртуальних активів відповідного виду. Підсумовано, що український законодавець при формуванні заходів державного регулювання діяльності учасників ринку віртуальних активів застосував ліцензування, скориставшись позитивним зарубіжним досвідом. Problem settings. The article examines the legal provisions for determining the measures of state regulation of the activities of virtual assets market participants which the Ukrainian legislator decided to apply in the sphere of circulation of such assets in Ukraine. The article analyzes the provisions of the Law of Ukraine No. 2074-IX “On Virtual Assets” dated February 17, 2022, which defines the State regulation of the virtual assets market as the implementation by the State, represented by the National Securities and Stock Market Commission and the National Bank of Ukraine, of comprehensive measures to streamline, control and supervise the virtual assets market, regulate the rules of operation of service providers related to the circulation of virtual assets, as well as measures to prevent and counteract abuses and violations in the virtual assets market. The study of legal regulation problems in the field of virtual assets was carried out such scientists as: S. Honcharenko [1, p. 152-157], A. Ovcharenko [2, p. 200-202], N. Arkhireyska, O. Kuchkova [3], V. Korneev [4, p. 40-46], O. Lyzunova [5, p. 196-199], O. Kud, M. Kucheryavenko, E. Smуchok [6, p. 33], V. Ryadinska [7, p. 152-157], A. Protsenko [8, p. 130-134], V. Polatai [9, p. 155-162] and others. The target of the research is to analyze the norms of Law No. 2074-IX to determine measures of state regulation of the activities of participants in the virtual assets market, which the Ukrainian legislator decided to apply in the sphere of circulation of such assets. Article’s main body. It is stated that the legislator has classified service providers related to the circulation of virtual assets and users of such services as participants of the virtual assets market. Services related to the circulation of virtual assets include services for the storage or administration of virtual assets or virtual asset keys, services for the exchange of virtual assets, services for the transfer of virtual assets, intermediary services related to virtual assets. The author emphasizes that the activities of service providers related to the circulation of virtual assets are allowed only subject to obtaining a permit for the provision of services related to the circulation of virtual assets of the relevant type. In addition, the amount of the fee for issuing a permit for the provision of services related to the circulation of virtual assets for residents and non-residents of Ukraine is fixed and it is noted that the issuance of such a permit is carried out in accordance with the procedure established by the National Securities and Stock Market Commission. At the same time, it is not clear what exactly the legislator meant by “permission”. Conclusions and prospects for the development. Taking into account that for such a permit providers of services related to the circulation of virtual assets will have to pay a certain amount of money, the author assumes that it will be a “state permit for the right to provide services related to the circulation of virtual assets” and in order to obtain it, service providers will have to meet certain conditions established by the relevant state body. This shows that the Ukrainian legislator introduces licensing of service providers related to the circulation of virtual assets, although for some reason does not use the term “licensing”. This fact is also confirmed by the requirements established by this Law for persons who plan to carry out activities for the supply of such services, which are essentially “licensing conditions”. The requirements for the procedure of obtaining a “permit” are similar to the requirements for the procedure of obtaining licenses enshrined in the Law of Ukraine No. 222-III “On Licensing of Economic Activities” dated March 2, 2015. It is summarized that the Ukrainian legislator in the formation of measures of state regulation of the activities of virtual assets market participants applied licensing, taking advantage of positive foreign experience

    Talactoferrin alfa versus placebo in patients with refractory advanced non-small-cell lung cancer (FORTIS-M trial)

    Background: Talactoferrin alfa is an oral dendritic cell (DC)-mediated immunotherapy (DCMI). We tested whether talactoferrin was superior to placebo in advanced non-small-cell lung cancer (NSCLC). Patients and methods: An FORTIS-M trial was an international, multicenter, randomized, double-blind comparison of talactoferrin (1.5 g p.o. BID) versus placebo BID, in patients with stage IIIB/IV NSCLC whose disease had failed two or more prior regimens. Treatment was administered for a maximum of five 14-week cycles. The primary efficacy end point was overall survival (OS); secondary end points included 6- and 12-month survival, progression-free survival (PFS), and disease control rate (DCR). Results: Seven hundred and forty-two patients were randomly assigned (2:1) to talactoferrin (497) or placebo (245). The median OS in the intent-to-treat (ITT) population was 7.66 months in the placebo arm and 7.49 months in the talactoferrin arm [hazard ratio (HR), 1.04; 95% CI, 0.873-1.24; P = 0.6602]. The 6-month survival rates were 59.9% (95% CI, 53.4% to 65.8%) and 55.7% (95% CI, 51.1% to 59.9%), respectively. The 12-month survival rates were 32.2% (95% CI, 26.3% to 38.2%) and 30.9% (95% CI, 26.8% to 35%), respectively. The median PFS rates were 1.64 months and 1.68 months, respectively (HR, 0.99; 95% CI, 0.835-1.16; P = 0.8073). The DCRs were 38.4 and 37.6%, respectively [stratified odds ratio (OR), 0.96; 95% CI, 0.698-1.33; P = 0.8336]. The safety profiles were comparable between arms. Conclusions: There was no improvement in efficacy with talactoferrin alfa in patients with advanced NSCLC whose disease had failed two or more previous regimens. © The Author 2013.     From Humorous Post to Detailed Quantum-Chemical Study: Isocyanate Synthesis Revisited

    Isocyanates play an essential role in modern manufacturing processes, especially in polyurethane production. There are numerous synthesis strategies for isocyanates both in industrial and laboratory conditions, which do not prevent searching for alternative highly efficient synthetic protocols. Here, we report a detailed theoretical investigation of the mechanism of sulfur dioxide-catalyzed rearrangement of the phenylnitrile oxide into phenyl isocyanate, which was first reported in 1977. The DLPNO-CCSD(T) method and up-to-date DFT protocols were used to perform a highly accurate quantum-chemical study of the rearrangement mechanism. An overview of various organic and inorganic catalysts has revealed other potential catalysts, such as sulfur trioxide and selenium dioxide. Furthermore, the present study elucidated how substituents in phenylnitrile oxide influence reaction kinetics.
