    Il contributo, partendo dall’analisi delle argomentazioni sviluppate dalla Corte di Giustizia UE nella sentenza 15 dicembre 2022, causa C-577/21, in merito alla portata dell’espressione “danni alle persone” impiegata nell’art. 3 della dir. 2009/103/CE, recentemente modificato dalla dir. 2021/2118, si sofferma sulla distinzione tra l’obbligo di assicurazione veicoli, imposto dalla richiamata normativa unionale, ed il risarcimento dei danni ascrivibili alla responsabilità civile dell’assicurato, oggetto, invece, di regolamentazione autonoma da parte dei singoli Stati membri. In tale direzione esso ripercorre l’evoluzione che ha interessato, nell’ordinamento tedesco, la risarcibilità del danno non patrimoniale, anche attraverso un’analisi compartiva con l’esperienza italiana, e si sofferma, altresì sulla risarcibilità del danno non patrimoniale conseguente a lesioni di non lieve entità, sancita dal codice delle assicurazioni private.The paper, starting from the analysis of the arguments developed by the EU Court of Justice in its decision of 15 December 2022, case C-577/21, regarding the scope of the expression "personal injuries" used in article 3 of directive 2009/103/EC, recently amended by directive 2021/2118, focuses on the distinction between the obligation to insure vehicles, imposed by the above mentioned EU legislation, and the compensation of damages attributable to the civil liability of the insured party, which is subject to autonomous regulation by the individual member States. In this direction, it outlines the evolution that has affected the compensation of non-pecuniary damage in the German legal system, also through a comparative analysis with the Italian experience, and finally focuses on the compensation of non-pecuniary damage resulting from injuries of a non-small entity, as provided by the Italian Private Insurance Cod

    Dal 2019 la Corte di giustizia dell’Unione europea ha iniziato a confrontarsi con la portata applicativa, che il lemma «accident» presenta nell’art. 17.1 della Convenzione di Montreal del 1999, per l’unificazione di alcune regole relative al trasporto aereo internazionale. In tale percorso, i giudici europei hanno mostrato di voler superare l’interpretazione che tale termine, usato nell’omologa previsione della Convenzione di Varsavia-l’Aja, aveva ricevuto sotto l’egida di tale regime disciplinare, ove era stato correlato alla realizzazione di un rischio inerente al trasporto aereo. L’esigenza di oltrepassare tale impostazione, espressione di una visione ancora troppo pionieristica dell’aviazione commerciale, si lega alla necessità di valorizzare il nuovo e delicato sistema di equilibri, tra i contrapposti interessi delle parti del contratto di trasporto, realizzato dallo strumento internazionale del 1999, che, tuttavia, non può legittimare una nozione soggettiva di «accident». Il lavoro opera una ricostruzione delle decisioni della Corte rese, rispettivamente, il 19 dicembre 2019 n. 532, in causa C-532/18, ed il 12 maggio 2021 n. 70, in causa C-70/20 anche alla luce dei lavori preparatori della Convenzione di Montreal, evidenziandone i limiti ed i possibili sviluppi futuri.Since 2019, the Court of Justice of the European Union has begun to confront the applicative scope, which the lemma «accident» presents in Article 17.1 of the Montreal Convention of 1999, on Unification of Certain Rules Relating to International Carriage by Air. In doing so, the European judges have shown a desire to overcome the interpretation that this term, used in the corresponding provision of the Warsaw-Hague Convention, had received under that disciplinary regime, where it had been related to the realization of a risk inherent in air transport. The need to go beyond this approach, which is the expression of a still too pioneering vision of commercial aviation, is linked to the need to enhance the new and delicate system of balance, between the opposing interests of the parties to the contract of carriage, created by the 1999 international instrument, which, however, cannot legitimize a subjective notion of «accident». The paper operates a reconstruction of the decisions of the Court rendered, respectively, on December 19, 2019 No. 532, in Case C-532/18, and on May 12, 2021 No. 70, in Case C-70/20 also in the light of the preparatory work of the Montreal Convention, highlighting its limits and possible future developments

    Lo scritto analizza una recente ed importante ordinanza delle Sezioni Unite della Corte di Cassazione su uno dei criteri di collegamento contenuti nell'art. 33 della Convenzione di Montreal del 1999, sul trasporto aereo internazionale. Nella decisione i giudici hanno fornito un'interpretazione particolarmente evolutiva del criterio rappresentato dal luogo ove il vettore «possède un établissement par le soin duquel le contrat a été conclu»/«has a place of business through which the contract has been made» nel caso di acquisto on-line del titolo di viaggio. Tale luogo, infatti, secondo il collegio deve essere identificato, in applicazione del principio di prossimità, con il «luogo in cui l’acquirente del titolo di viaggio» è «portato a conoscenza dell’accettazione della proposta formulata con l’invio telematico dell’ordine e verosimilmente» del pagamento del corrispettivo, fatto coincidere con il domicilio dell’acquirente.The paper analyzes a recent and important decision of the United Sections of the Italian Court of Cassation on art. 33 of the Montreal Convention of 1999, on international air transport. More precisesly the judges provided a particularly evolutionary interpretation of the criterion represented by the place where the carrier «possède un établissement par le soin duquel le contrat a été conclu» /«has a place of business through which the contract has been made», when the travel ticket has been purchased on-line. According to the Court, this place must be identified, in application of the proximity principle, with the «place where the purchaser of the ticket» has be «made aware of the acceptance of the proposal formulated by sending the the order and probably» the payment of the consideration, made to coincide with the domicile of the purchaser

    Il saggio analizza l'evoluzione registrata nell'interpretazione dell'articolo 28 della Convenzione di Varsavia-l'Aja e dell'articolo 33 della Convenzione di Montreal del 1999, sul trasporto aereo internazionale, dalla seconda metà del secolo scorso ad oggi. Attraverso un esame dettagliato delle decisioni giurisprudenziali e delle riflessioni della dottrina sulla portata dei criteri di connessione fissati da tali norme, lo scritto si sofferma con particolare attenzione sull'ambito di applicazione del criterio del "place of business through which the contract has been made" nel caso di acquisto diretto online del biglietto di viaggio, alla luce dell'ordinanza 2019 n. 18257 delle Sezioni Unite della Corte di Cassazione e della decisione della Corte di giustizia resa nella causa Guaitoli c. easyJet Airline Co.Ltd.The essay analyzes the recorded evolution in the legal interpretation of Article 28 of the Warsaw Convention and Article 33 of the 1999 Montreal Convention, on International Air Transport, from the second half of the last century up today. Through a detailed examination of the judgments and of the reflections made by the doctrine on the scope of the connection criteria set by the aforementioned standards, the written focuses in particular on the application scope of the “etablissement / place of business” of the carrier. In this way the paper deals with the problems related to the direct online purchase of the travel ticket and the evolutionary interpretation of the indicator mentioned above in light of the 2019 Ordinance no. 18257 of the United Sections of the Italian Court of Cassation and of the decision made by the EU Court of Justice in the case Guaitoli c. easyJet Airline Co.     Il lavoro, dopo aver tratteggiato l’evoluzione che ha interessato il quadro regolatorio unionale in materia di obbligo di installazione, sui veicoli commerciali impiegati nel trasporto stradale, del tachigrafo, si sofferma sull’interpretazione di due disposizioni del reg. (CE) n. 561/2006, relativo all’armonizzazione di alcune disposizioni in materia sociale nel settore dei trasporti su strada, alla luce della decisione della Corte di giustizia del 9 settembre 2021, causa C-906/19. Il contributo, opera, infatti, una dettagliata analisi interpretativa degli art. 3, lett. a, e 19.2 del testo normativo europeo nel caso di uso misto del veicolo, ossia nel caso in cui lo stesso veicolo sia, al contempo, impiegato in attività soggette iure proprio alle previsioni del reg. (CE) n. 561/2006, ed in un servizio di trasporto di linea di passeggeri di percorso non superiore ai 50 km, non soggetto, invece, all’operatività del provvedimento.The paper, after outlining the evolution that has affected the EU regulatory framework regarding the obligation to install the tachograph on commercial vehicles used in road transport, focuses on the interpretation of two provisions of reg. (CE) n. 561/2006, on the harmonization of certain social legislation relating to road transport, in light of the decision of the Court of Justice of 9 September 2021, case C-906/19. The assay, in fact, carries out a detailed interpretative analysis of the art. 3, lett. a, and 19.2 of the above mentioned European Regulation in the case of mixed use of the vehicle, i.e. in the event that the same vehicle is, at the same time, used in activities subject to the provisions of reg. (CE) n. 561/2006, and in a scheduled passenger transport service with a route not exceeding 50 km, not subject, on the contrary to the scope of the Regulation

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

    “Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship

    Appropriate Similarity Measures for Author Cocitation Analysis

    We provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature.
