Children's right to information in civil proceedings in Italy.
The present article refers to the sections of the Italian National Report
drafted by the author in the context of her participation in the Minor’s right to information
in eu civil actions project; such a project focused on children’s right to
information within the framework of civil proceedings in the eu. In the article, emphasis
has been put on how the child’s right to be informed in this specific context
is enshrined in the Italian legal system. Furthermore, the paper analyses the right
at issue under the perspective of case law, referring mainly to the Italian Corte di
cassazione, the European Court of Human Rights and the Court of justice of the European Union
La normativa relativa al database Eurodac sotto il profilo della tutela del diritto alla protezione dei dati personali.
In questo contributo dapprima si affronta la questione dell’applicabilità delle garanzie previste dal GDPR anche ai richiedenti protezione internazionale nell’Unione europea, rispetto al trattamento dei loro dati personali nel sistema automatizzato Eurodac. In seguito, saranno brevemente analizzati due profili problematici: quello relativo al possibile uso della coercizione al fine di raccogliere, di questi soggetti, le impronte digitali e quello inerente alla soglia minima d’età necessaria per procedere al trattamento di tali dati, nel quadro della proposta di riforma avanzata in materia dalla Commissione europea nel maggio 2016

La responsabilità per lesione del diritto all'interruzione della gravidanza a causa dell'omessa diagnosi di malformazione del nascituro si colloca nel quadro generale della responsabilità medica, la cui qualificazione giuridica ha costituito l'oggetto di un lungo percorso di evoluzione da parte della giurisprudenza della Corte di Cassazione
How coercive fingerprinting could violate migrants' dignity
This paper aims at investigating whether and under which circumstances coercive fingerprinting in respect to migrants, especially asylum seekers, could amount to degrading treatment. The question has arisen following a 2015 Staff Working Document released by the European Commission, which doesn’t exclude the application of coercion for the purposes of fingerprinting incoming migrants. Neither was this possibility excluded by the Commission in proposal com 2016 (272), for a Eurodac Regulation replacing eu Regulation 2013/603. The analysis is divided in two steps. First, the paper deepens the question whether coercive fingerprinting applied to a vulnerable person, regardless of his/her status, could amount to degrading treatment. Secondly, the focus is placed on migrants, especially when they are in seek of international protection
Les normes régissant le traitement des donnés à caractère personnel des demandeurs d'asile dans l'Union européenne à la lumière des principes du Règlement UE 2016/679.
In the present work, the principles on which the EU General Data Protection Regulation 2016/679 is based, have formed a reference point to examine the kind of legal protection people seeking asylum in the EU receive concerning their personal data. The aim of the research is to answer the question whether this protection varies depending on the circumstance that the data subject applies for asylum. We will appreciate how significant the matter at issue is if we consider, on the one hand, that data protection is a universal right; on the other hand, that democracy requires all people to be treated as equals in regard to their fundamental rights, independently of their ethnic origin or, more broadly, a condition – as the one of asylum seeker – linked to sensitive aspects
Certificato successorio europeo: alcune osservazioni critiche.
The paper focuses on the European Certificate of Succession, established by EU Regulation No. 650/2012: a number of issues linked to its application are examined. According to Article 63 of the Regulation, in cross-border inheritances the Certificate may essentially be used to demonstrate the status and the rights of each heir in more than one Member State. Nevertheless, given that this instrument appears to be modelled after the German Erbschein, its usage could lead to some differences in treatment between (on the one hand) an heir whose situation is entirely regulated by Italian law and (on the other hand) an heir subject to both Italian and German – or even French – law
"Crisi migratoria": il ruolo del giudice nella tutela dei minori
Les causes de fragilité des mineurs étrangers arrivés irrégulièrement en Europe sont plusieurs : tout d’abord, le difficile voyage entrepris, ensuite, la séparation traumatique de la famille d’origine, et encore, la crainte pour les modalités d’accueil à l’arrivée. Ces éléments ne font que s’ajouter à la vulnérabilité naturelle des mineurs, surtout lorsqu’ils ne sont pas accompagnés. L’article analyse comment, depuis 2011, les juges ont protégé les enfants étrangers dans le contexte de la crise migratoire. Sont examinées, en premier lieu, les décisions des juges nationaux, italiens et français et, en second lieu, les décisions de la Cour de justice UE et de la Cour européenne des droits de l’homme. L’étude comparative de ces jurisprudences permet ainsi d’encadrer la question de façon plus globale

The contribution aims at shedding some light on children’s fundamental rights in the
context of cross-border civil proceedings in family matters. In particular, the child’s right to
receive adequate information before, during and after a judicial proceeding is examined.
Through an analysis of international and EU sources of hard law and soft law, as well as
the current status of children’s right to information in the Italian legal system, the Authors
wish to describe the current state of the art in the implementation and promotion of this
right, as well as to propose the possible future actions that could be undertaken, in the future,
by the international community and the national lawmaker and institutions

The paper corresponds to the speech given by the Author (entitled «Unfair terms in consumer contracts: a perspective based on case law, with a special focus on the EU Court of Justice») when participating in the conference «Aktuelle Entwicklungen im Europäischen und internationalen ZVR» (University of Sassari, 26-27 September 2023): the Author has briefly examined the concept of “unfair” contractual terms by putting the stress on a number of questions of particular interest, such as the limits surrounding the possible “replacement” of such clauses
