Поняття та види строків у процедурі вирішення виборчого спору
Get PDFIn the article, the author established the nature and types of terms for resolving electoral disputes. It is concluded that it is advisable to establish the essence of the term as a legal category; it is used in the consideration and resolution of administrative disputes, including election disputes. It is substantiated that the term must be understood as a certain time period, determined by the calendar date or event, with the onset of which the person arises or terminates the right to act in a certain way. The terms in consideration and resolution of electoral cases are classified according to a number of criteria - the method of protecting violated suffrage; time of application of the right to appeal a management decision; stages of the election process; time criterion for their calculation; conditions of their occurrence; their substantive nature; opportunities for their recovery. Given the nature of the time limit for applying to the court as a variety of terms in the consideration and resolution of electoral disputes, it was concluded that it would be appropriate to classify them as defined by the substantive rules of administrative law. Attention is drawn to the fact that maintaining the norm on defining the terms of appeal to the administrative court as a guarantee of the protection of electoral rights in the structure of the Code of Administrative Procedure of Ukraine is a compulsory measure of legal regulation, they should be eliminated as part of law-making activities to develop and adopt the Electoral Code of Ukraine. It is emphasized that classifying the term of appeal to the administrative court as a guarantee of ensuring the implementation of suffrage to the category of material terms allows us to conclude that it should be understood as a limitation period. It is noted that it becomes especially relevant to solve the problem of legislatively determining the length of time for appeal to an administrative court as a category of material terms, and accordingly to solve the question of whether it is reasonable to apply the category of “reasonableness” to the determination of their duration, used in the Code of Administrative Procedure of Ukraine to determine the period during which a court must consider the matter or carry out other procedural actionsВ статье автором установлено сущность и виды сроков решения избирательных споров. Сделан вывод о целесообразности установления сущности срока как правовой категории, применяется в рассмотрении и решении административных споров, в том числе избирательных споров. Обосновано, что под сроком необходимо понимать определенный временной период, определяется календарной датой или событием, с наступлением которого у лица возникает или прекращается право определенным образом действовать. Сроки в рассмотрении и решении избирательных дел классифицированы по ряду критериев - способом защиты нарушенного избирательного права; времени применения права на обжалование управленческого решения; стадии избирательного процесса; временного критерия их вычисления; условия их наступления; их содержательной сущности; возможности их восстановления. С учетом сущности срока обращения в суд в качестве разновидности сроков в рассмотрении и решении избирательных споров сделан вывод о целесообразности их отнесения к категории сроков, определенных материальными нормами административного права. Акцентировано внимание, что сохранение нормы об определении сроков обращения в административный суд как гарантии защиты избирательных прав в структуре Кодекса административного судопроизводства Украины является вынужденной мерой правового регулирования, должны быть устранены в рамках реализации правотворческой деятельности по разработке и принятие Избирательного кодекса Украины. Подчеркнуто, что отнесение срока обращения в административный суд как гарантии обеспечения реализации избирательного права к категории материальных сроков позволяет сделать вывод о целесообразности его понимание как срока исковой давности. Отмечено, что приобретает особую актуальность решения проблемы законодательного определения продолжительности сроков обращения в административный суд как категории материальных сроков, и соответственно решения вопроса целесообразности применения к установлению их продолжительности категории «разумности», употребляемое в Кодексе административного судопроизводства Украины для определения периода, в течение которого суд должен рассмотреть дело или осуществить другие процессуальные действияУ статті автором встановлено сутність та види строків вирішення виборчих спорів. Зроблено висновок щодо доцільності встановлення сутності строку як правової категорії, що застосовується у розгляді та вирішенні адміністративних спорів, в тому числі виборчих спорів. Обґрунтовано, що під строком необхідно розуміти певний часовий період, що визначається календарною датою чи подією, з настанням якої у особи виникає чи припиняється право певним чином діяти. Строки у розгляді та вирішенні виборчих справ класифіковано за рядом критеріїв - способом захисту порушеного виборчого права; часу застосування права на оскарження управлінського рішення; стадії виборчого процесу; часового критерію їх обчислення; умови їх настання; їх змістовної сутності; можливості їх поновлення. З врахуванням сутності строку звернення до суду як різновиду строків у розгляді та вирішенні виборчих спорів зроблено висновок про доцільність їх віднесення до категорії строків, визначених матеріальними нормами адміністративного права. Акцентовано увагу, що збереження норми про визначення строків звернення до адміністративного суду як гарантії захисту виборчих прав у структурі Кодексу адміністративного судочинства України є вимушеним заходом правового регулювання, що має бути усунено в межах реалізації правотворчої діяльності з розробки та прийняття Виборчого кодексу України. Підкреслено, що віднесення строку звернення до адміністративного суду як гарантії забезпечення реалізації виборчого права до категорії матеріальних строків дозволяє зробити висновок про доцільність його розуміння як строку позовної давності. Going Beyond Counting First Authors in Author Co-citation Analysis

counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

Get PDF“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
Get PDFWe provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
