    La Parte generale del diritto civile ha introdotto all’art. 9 una disposizione in materia ambientale che fissa il principio secondo cui tutte le attività nell’ambito del diritto civile devono contribuire a preservare le risorse naturali e proteggere l’ambiente. Si tratta di una disposizione innovativa che si pone in continuità con le politiche ambientali intraprese dalla Cina rivolte a realizzare una crescita economica più sostenibile e più rispettosa dell’ambiente. L’art. 9 costituisce tuttavia un principio a carattere generale e pertanto il contributo si propone di analizzare il contesto politico e legislativo in cui si è formata la disposizione al fine di comprendere le sue possibili ricadute pratiche in termini di applicazione concreta

    La Belt and Road Initiative (BRI) costituisce l’ambizioso progetto della Cina che, all’interno della going out policy, ha lo scopo di dare nuovo impulso agli investimenti cinesi all’estero. L’estensione della BRI, in termini sia territoriali sia di obiettivi prefissati, pone tuttavia alcune rilevanti questioni in materia di protezione ambientale, alla luce delle evidenti ricadute che un progetto di tali dimen- sioni potrebbe provocare sull’ambiente.     Il contributo si propone di esaminare le disposizioni in materia di sviluppo sostenibile, in particolare quelle a tutela dell’ambiente, contenute nel Comprehensive Agreement on Investment (CAI), il recente accordo sugli investimenti concluso in linea di principio dalla Cina e dall’Unione Europea. Dopo una breve ricostruzione sul concetto di sostenibilità ambientale nell’ordinamento giuridico cinese, l’analisi sarà rivolta all’approfondita descrizione del contenuto della Sezione IV del CAI, soffermandosi in particolare sulla parte dedicata agli investimenti e alla protezione ambientale. Infine, saranno svolte alcune osservazioni conclusive circa l’efficacia delle disposizioni del CAI nel raggiungere l’obiettivo di sviluppo sostenibile che Cina e UE hanno incluso nell’accordo.The paper examines the sustainable development provisions, and particularly those related to the protection of the environment, set in the Comprehensive Agreement on Investment (CAI), the recent agreement concluded in principle by China and the European Union. After a brief reconstruction of the concept of environmental sustainability in the Chinese legal system, the analysis will provide an in-depth description of the content of Section IV of the CAI, focusing specifically on the part dedicated to investment and environmental protection. Lastly, some concluding remarks will be drawn on the effectiveness of the CAI provisions in achieving the objective of sustainable development that China and the EU included in the agreement

    The Chinese Frontiers of Data Protection: The Personal Information Protection Law (PIPL)

    With the rise of the Internet, data have become one of the most valuable economic assets and, as a consequence, they have received special attention from law-makers seeking to define the legal framework to regulate the flow of data and safeguard individuals from the risks associated with the processing and use of such data. China has also recently embarked on the path to define its data governance regime. A recent step in this direction was taken in 2021 with the enactment of the Personal Information Protection Law (PIPL). The aim of this paper is to analyse the legal framework of personal information protection within the Chinese legal system, focusing on the set of rules provided in the PIPL. After an introductory reconstruction of the concept and the meaning of “personal information” in the Chinese context, the paper focuses firstly on a general description of the main features of the new Law, and secondly on the most relevant provisions in regard to the transnational dimension of data flow, i.e., the territorial scope of the PIPL and the cross-border transfer of personal information

    Going Beyond Counting First Authors in Author Co-citation Analysis

    The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
